Hi all!

I have followed this forum with interest for a few weeks now and sort of followed your advice on most things. To cut a long story short, Lowell are chasing me (shortly after i registered in the electoral roll in my new address) for nearly £200 for a supposed Abbey National bank account from five years ago. I know i did have an account with Abbey but i also know i NEVER borrowed any money so i have no idea where this debt is coming from. I have got five letters from Lowell, one of them returning my cheque asking for my consumer credit agreement, telling me my debt didnt fall under that agreement. I wrote and asked them what agreement it fell under them, but they just sent a letter saying they would send someone round.

I have now written this one for them using bits of Scouser9's letter (thanks!). Can someone give me some feedback on it, ia m not sure what i am saying is true!

I Do Not Acknowledge any Debt.

In response to your latest letter, please refer to my letter sent on the 2nd of August, in which I stated I had asked Abbey for a Subject Access Request in accordance to the Consumer Credit Act 1974.

I enclose a copy of it here.

Please note you have been unable to provide a copy of my Consumer Credit Agreement in regards to this supposed debt, in accordance to the Consumer Credit Act 1974. You have also failed to provide me with a reason why this supposed debt is not covered by the aforementioned act. You have so far failed to provide any documents supporting your claim.

I do not want you to visit my premises. Please remember that there is only an implied license under English Common Law for certain people to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.).


Please therefore take note that, I revoke license under English Common Law for you, or your representatives to visit me at my property and if you do so without my permission, you will then be liable to damages for a tort of trespass. You would also be conspiring in a trespass if you sent someone to visit me nevertheless. I will call the police and report you for harassment every time I get a ‘doorstep visit’ from you.

I am severely disappointed and disgusted by the way your company communicates and has repeatedly failed to provide and proof in regards to any supposed outstanding debts. Please also note I am keeping copies of all our correspondence including your refusal to provide me with a copy of my Consumer Credit Agreement or in its default, a statement or a reason why this supposed debt is not covered by it.

Please reply to me only in writing.
