I understand all the stuff about the test case, but on Friday returned home to find HSBC has offered an out of court settlement of £1,007.68 for our claim. We signed the forms and sent them off immediately - with the postal strikes and stuff I am now concerned the offer will be retracted, even though they will recieve the acceptance within their specified 10 days.

 

Can you confirm that those who have agreed settlements will be paid?

From what has been seen so far you will be ok! They have made an offer and they must honour it!

Thanks thats class. It means in the space of a month we have got £2,000 back from HSBC. After the test case is over I hope our final account will enable us to get back £4,000 - we just missed the boat to enter into court for this one. Decided to test the process before going for the main vein. Still Its sorted out our holiday over christmas.

Thanks for bring my attention to this - thats a real help. I am still continuing to follow advise from the powers that be. The confusion is that I have not recieved any statments to enter the court process on line yet. I contacted the Information Commissioner about the lack of response and they are pursing it. They then put me onto the Financial people who advised not to submit court process online as (1) have no statements and (2) will not be accepted.

 

I can provide evidence that I am still proceeding by obtaining statements with the emails I have sent to Information Commissioner

The advice from the powers that be on this site is to file your claim direct with the courts as the particulars of claim that are now recommended are to lengthy for the online claim form. I will post a copy for you to look at now.
