Hello all,

 

We've got our Lloyds court hearing today, but I'm just wondering if it's worth going. Reason being, my mum heard on the radio that due to the OFT report, all cases are being postponed, pending the outcome of the OFT case.

 

Is it still worth turning up anyway, just to see what happens?

 

We did receive a letter from SC&M saying that their clients were interested in coming to a settlement, but after responding to that on the 14th June 2007, we've heard nothing since.

 

Bit nervous to be honest...

 

 

Should we lose, what costs can we expect to have to pay?

You should still go, it is not for the banks of the OFT or FSA to decide when it has gone to court, it is up to the courts so you should definutly go still

 

the banks have to apply to the court for the hearing to be suspended and i very much dont think they would have yet.

 

they probably wont even turn up and you may win by default

Definitely, definitely go and please let us know how you go on later.

 

Thing is, you have had a letter offering settlement but received no response so everything is on your side.

Well....bit of a waste of time, to be honest. In and out within 5 minutes.

 

Case has been suspended pending outcome of OFT case.

 

SC&M did try to say that they had not received our reply to their settlement letter but fortunately we had not only our response but the recorded delivery details. We gave them another copy and that was about it.

 

So have to wait the outcome now and see where we go from there.

This tends to fly in the face of the advice on their website which states:

 

Q: What if I have already been made an offer?

A: We will stand by any offer to settle a complaint or court claim that we have already made to our customers. If you have received an offer to settle from us which is still outstanding we will be writing to you again shortly. Our letter will explain that customers have two months to decide whether to refuse our offer and wait for the decision in the test case. If you do choose to refuse an offer, and return the settlement amount to us, your complaint will be held and recorded by us until there is a final decision in the test case. We will then contact you again as soon as possible to finally resolve your complaint.
