Hi.

 

I'm with Lloydstsb of which i had a £100 overdraft limit , i got into some difficulty paying this back due to circumstances changing, because i couldn't pay back straight away they started charging me fees between £25 to £60 and now owe them nearly £400 .

 

I came to an arrangement of £5 per week to pay back to them which i've been doing for a year or just over now.

 

What i need to know is would i be able to claim anything back from them or am i lumbered with paying them the whole £400 due to myself getting into problems and if i can where on earth do i start. i can't really afford to take a big company to court due to being on benefits.

Hi rosey and welcome to the forum:)

 

This site will help you to recover YOUR MONEY, which has been unlawfully taken from your account, whatever the amount.

 

I to am in receipt of benefits and have successfully managed to take on Natwest twice and won, I am currently taking on Halifax and Lloyds TSB, with Abbey in the pipe line as they have just done to me what Lloyds have done to you. So, rosey there is light at the end of the tunnel.

 

You only incur costs once you commence court proceedings. Even then, depending on your income and type of benefits you receive you are able to get some help with this. But that is a little way down the line and isn't worth worry about at the moment.

 

Have you had a chance to have a read of all the information contained in this site yet? If not, I can not stress how important it is that you do so. It will all seem exceptionally daunting at first but you'll get the hang of it all in the end.

Once you've read through these, and read aggain, it's a good idea to post a new thread in the Lloyds TSB forum so that fellow comrades, including myself, can assist you with any queries that you may have. Do not keep posting new threads, stick to this one, otherwise the admin staff may slap your wrist:p

 

It may be worth having a butchers at the follwoing thread in light of the new OFT (Office of Fair Tradings) test case with regards to bank charges. It's nothing to worry about at the moment, but it is certainly worth knowing.

Go for it rosey. Everyone here is behind you. The test case could delay things but we don't know until we try do we?

The worst thing that can happen is you have to wait for your money - so don't think about what you could do with it (I made that mistake).

Carry on as you are, make the claim, and when you eventually win - wow its like winning the lottery.

Above all try not to worry. Any problems just post something on your thread and people will reply with support.

I think what broke dave is saying is go through the necessary proceedures and if you get no joy, then hit them with court proceedings.

Hi and thanks for all the advice so far.

 

I have another 2 questions before i send a letter to the bank.

 

Firstly can i still claim back charges even though i'm still paying back the bank £370 i owe at £5 every month which was arranged for the £100 overdraft i had.

 

Do i have to send the £10 even if i have all my statements and what should i write in the letter.

 

I'm absolutely scared stiff of what i should say . thanks

You can claim back your bank charges even though you owe them money and if you have all your statements then there is no need to request them saving you £10 :) . So the next step is the preliminary letter along with your schedule of charges.

Hi well i sent my first letter off on the 2 aug so fingers crossed :)

 

I've just one question really just to make sure they do owe me the money. as i said i had a £100 overdraft 3 yrs ago but now owe the bank £331 due to charges they placed on to my account , i have not paid all this off yet as i pay £5 a month back to them which was arranged which i've now been paying for months . am i still entitled to anything even though i haven't paid it all back yet.

rosey, rosey, when are you going to get it....it is your money they've unlawfully taken, so of course you're entitled to get it back:)

 

Good on you for taking the first steps and posting the PRELIM, give them exactly 14 days (and to be fair I opted for 14 working days), then hit them with your LBA (Letter Before Action). Remember this is your claim, and your timescale, stick to it, not theirs.

give them exactly 14 days (and to be fair I opted for 14 working days),

 

As the banks dont play fair I would recommend you opt for 14 days only which is what you state in your letter and as said above remain rigid to the timescale.

No, I agree the banks do not play fair, but it does not mean we have to sink to their levels:)

 

Considering Lloyds aren't open on a Saturday it will only be deemed fair and reasonable, by the court, if dealt with in this manner. However, the choice as always is entirely up to you.
