    • it is NOT A FINE.....this is an extremely important point to understand no-one bar a magistrate in a magistrates criminal court can ever fine anyone for anything. Private Parking Tickets (speculative invoices) are NOT a criminal matter, merely a speculative contractual Civil matter hence they can only try a speculative monetary claim via the civil county court system (which is no more a legal powers matter than what any member of Joe Public can do). Until/unless they do raise a county court claim a CCJ and win, there are not ANY enforcement powers they can undertake other than using a DCA, whom are legally powerless and are not BAILIFFS. Penalty Charge Notices issued by local authorities etc were decriminalised years ago - meaning they no longer can progress a claim to the magistrates court to enforce, but go directly to legal enforcement via a real BAILIFF themselves. 10'000 of people waste £m's paying private parking companies because they think they are FINES...and the media do not help either. the more people read the above the less income this shark industry get. where your post said fine it now says charge .............. please fill out the Q&A ASAP. dx  
    • Well done on reading the other threads. If ECP haven't got the guts to do court then there is no reason to pay them. From other threads there is a 35-minute free stay after which you need to pay, with the signs hidden where no-one will read them.  Which probably explains why ECP threaten this & threaten that, but in the end daren't do court. As for your employer - well you can out yourself as the driver to ECP so the hamster bedding will arrive at yours.  Get your employer to do that using the e-mail address under Appeals and Transfer Of Liability.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

If you take your claim to court, do you have to specify if you wish to be paid by cheque. I will be putting 2 claims into the sheriffs court in Aberdeen tomorrow against Barclaycard and Marbles, but both my accounts have been paid off with a settlement figure and are no longer used. I dont want the companies saying they will credit my account, as they sometimes say they will, or i wont see any monies.

You should make it clear to the defendants that you want the refund made by cheque,and that you will not consider the claim as settled if they do not comply.

This of course will be standard practice in the case of closed accounts.

Ho hum,

 

all of this waiting is beginning to get boring now. Especially as other people seem to be 'winning' without even going to the MCOL stage. Apparently (thanks Lucy & Suzanne) Mr Tommy at Head Orofice seems to be willing to negotiate with individuals and agree terms before going to Court. Interesting, I wonder if that is because he has realised that by agreeing at that stage he is 'saving' the bank Cobblers' fees. All I can say is that it must be worth a try before you get to the MCOL, once you submit to the Court I guess it is too late. But if you do give Tommy a call, make sure you know what you want and what you are prepared to accept by way of a settlement, this is where some form of compromise may have to be made - but nothing ventured, nothing gained.

Phoned up the court yesterday to see if they had a look at the case yet, they say i should hear from them in a week or so.

 

Got home today to a letter from Cobbetts:

 

We refer to the above matter.

 

Our client consideres that your challenge to its charges would fail in court. Our client believes that its charges are fair bla,bla,bla, our clientdoes not believe that your claim has any prospect of succeeding.

 

However, as a gesture of good will, bla,bla,bla, our client is willing to offer you a good will geture of 1100.00.

 

I do not intend to accept this offer as it only equals half of my claim.

I must reply to them by Friday the letter states, any advice on a response, not to good with letters.

Ive heard rumours that its that bad on the desks that they cant even find the cups fir elevenses........they are burried under the paperwork.

just occasionally I have them, in between sorting out the Banks, National Defence and trying to watch superleague on BBC. I must admit to being a Salford Reds fan, but Saints has always been up there, a Man City fan and a Sale Sharks fan. Although I must confess to having been to Old Trafford, but in my defence it was to watch the Silk Cut Cup Challenge Cup Final Cup Final Cup match!!

Int' it funny when people are actually so close to you in 'real life'?! Sometimes feels like people on the 'net are a million miles away, but it's a small world really! My OH is a massive Man City fan BC - he runs a message board for fans which is very popular, don't know if you've ever heard of it - its bluevibe.co.uk. (Don't know if I'm allowed to say that on here, might be considered advertising??!)
