(not the response page or AOS): I did this but was removed by Admin     Name of the Claimant: Highview Parking Limited   Claimants Solicitors: DCB Legal LTD, Direct House, Greenwood Drive, Runcorn, WA71UG   Date of issue – 25th November 2021   Date for AOS – Please advise on next best steps?   Date to submit Defence – N/A   What is the claim for – Defendant indebted to the Claimant for Parking Charges PCN was issued on private land owned or managed by claimant.   The vehicle was parked in breach of the terms on C, thus incurring a PCN.   The driver agreed to pay within 28 days but did not   D is liable as driver or keeper   Despite the requests, the PCN is still outstanding   The contract entitles C to damages   £165 being the total PCN charge and damages   Additional Rate of 8% per annum   Cost and court fees   What is the value of the claim? Total £311     Amount Claimed 226 court fees: 35  legal rep fees: 50  Total Amount  311
    • She has a tenant in the property, she has requested a copy of the tenants agreement which the tenant signed but this has not been provided.   I will get her to request a copy of the agreement she/may daughter personally signed with the letting agency.   The tenancy is now periodic month by month so tenant is not fixed into a long term contract.   The house is now severely damaged by damp and will cost 1000's to fix money my daughter does not have! The damp has been allowed to destroy the house over the last 2 years when no property inspections have been carried out.   Where does my daughter stand with the costs to repair the house damp damage which has destroyed the walls/plastering and it looks like it will need a rebuild of the plaster boards timber etc to get fixed especially the kitchen, bathroom and rear of the house wall from the guttering all the way down into the garden that entire extrior is now damaged by water seeping into the house causing the damp inside.....   The tenant is at fault too for not mentioning it  to the letting agency   The tenants bond money is not enough to fix the damage due to damp.   If my daugher gets a surveyor report from a damp specialist, can she then get the letting agency to pay for the repairs to the house? The letting agency is part of the ombusdman for letting agents. My daughter has spoke to them , been advised to make a formal complaint to the manager and wait 14 days, if no resolution to fix the severe damp, then it will escalate   Can my daughter request refund of the management fees over the last 2 years as clearly no property inspections/maintenance/nothing has been carried out by the letting agency?  
    • Thanks for the documents. I have to say that I'm trying to understand it all. Some of the documents run dated and also it's never really clear who is writing to who unless one looks very carefully. He has set out some kind of letter of claim. I have to say that his correspondence is very poorly written and pretty pompous and I'm going to say now that I think it's a shame you even bothered to respond to it.   I think you are just feeding the troll. I don't think he has any intention of suing you for anything – but simply wants you to back down on the entire bill and get away Scott free. On the other hand, if you sue him for your money then I'm certain that he will respond with a counterclaim for at least some of the things that he is referring to. As far as I can gather, his last communication to you was on 27 October and you responded very recently. Is that correct? It will be very nice to get a bullet pointed outline of all the issues – who is saying what to who. He has managed to muddy the waters so much that it is really quite difficult to discern.  
    • Hi, thanks for letting me know. Just one more thing -  what was the reason for your falling into arrears ?  the judge will want to know the background and how you came to recover the situation.
    • So how is Johnson going to get out of the No 10 party debacle now? Surely he can't keep denying it now the Allegra Stratton video that was leaked to ITV News is all over Twitter.   Someone has said that the 2019 intake who were already annoyed about trying to dig Owen Paterson out of his mess, on government orders, are much more angry this time about being sent out to lie.   A lot of other people are very angry that they abided by the rules las Christmas, didn't see family and weren't able to be with their loved ones in their last moments. Most people think the government are just laughing at us, everyone else followed the rules and we didn't.

Hi all, i did post in my existing thread but not much success, so will politely ask here.

 

Im getting together the court bundle, in court 03rd Sept. Re: the template spreadsheet that people are adding their charges to.... There is an 8% interest column which i understand should be removed before sending in bundle (as this 8% interest can be claimed for subsequently if im successful) have i got that right??

Secondly, in the template spreadsheet, it doesnt say anything on there about the interest ive been charged after (for example) going into unauthorised overdraft. Just suggests "cleared direct debit" charges etc. etc. So can i just add in the interest ive been charged each month?

 

Does this make sense?

So my query is...... on my statements it has "Interest" listed each month where i have been in unauthorised overdraft. I assume that i can put this in the court bundle spreadsheet, as its the 8% accrued interest that i cant claim for until im succesful? Is that correct??

 

and does the court bundle spreadsheet now need to include the 8% interest column?

Just wanting to ask what interest columns should go in my court bundle spreadsheet? Just the monthly interest they have charged me for being in unauthorised overdraft, or the 8% cumulative interest, or both??

If you used the spreadsheet from this site, then the 8% is automatically calculated. You can reclaim your charges plus any intertest charged because you went overdrawn. if you have an authorised overdraft you must work out what percentage of the interest you were charged is for exceeding your overdraft and then reclaim this amount.

 

The 8% should have been included on the schedule of charges sent with the N1 or after filing with the MCOL you should have sent a schedule of charges to Northampton to be forwarded to the court which the case will be transferred. You claim this 8% on both the charges and any interest you are charged (worked out as above).

 

These columns should be in your schedule of charges from the moment you filed in court and it is this spreadsheet, accurate up to the day you file it, which is included in your bundle as the 8% is added daily until settlement or judgement.
