my Partners claim against halifax

 

 

upon reading the ex parte aaplication

 

District Judge Davies

 

IT IS ORDERED THAT

 

1 The claimant is garnted permission to amend the particulars of claim form in accordance with draft attached to her application

 

2 This order has been amde by the court under CPR23.9 as the court has disposed of an application without hearing and without service. Any party may apply to have thi sorder set aside or varied within 7 days of the date of service of this order on that party

 

3 The court is to effect service of the ammended claim form and particulars of claim

 

4 todays hearing is adjourned until Monday 30 July 2007 at 10.00 am

Hi Zootscoot,

 

yes i have. Essentially what hapened is halifax paid out the claim but did not pay out the interest, quoting a mistake on the moneyclaim form as the reason for them not having to do so. i had listed all the amounts and detail regarding the information in the POC but not in the summary boxes. I filed an N244 to amend this to northampton before they transferred it to Birmingham. Northampton approved it but never served it and transferred it to birmingham for service on the 2nd july which would have been after my last hearing. the judge re-approved it an ordered it to be served and subsequently adjourned the hearing until the 30th july

I went through this with the judge who agreed to serv it becasue at that point hailfax had still failed to settle the interest. They have since paid an additional £864 in iterest, but this is still £113 short as the interest keeps accruing daily
