      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hell Folks

I already have two threads going for Cap One and Nat West, so I thought I would have a go at Debenhams, who I wrote to in April and never even bothered to acknowledge let alone reply to my letter.

 

I have added up the account cover (PPI?) payments and need a spread sheet to put them on before I go ahead with a claim.

The only spreadsheet I can find on the site is the one for credit cards, and debenhams is a store card.

Can anyone tell me of there is another spreadhseet that I could use or is the credit card the one to use.??

Hi Maggie,

 

Are you just claiming for the amount added for payment protection ? This is different to claiming for charges and may not infact be recoverable unless you consider you were mis-sold. Can you clarify please.

I actually think I was mis-sold, or never informed that after retirement I would not be able to claim off the insurance. I don't remember signing anything either. I have had my debenhams account for over 20 years. The account cover appeared a few years ago.

 

I have written to debenhams in April , but they did even acknowledge the letter which is why I am p***** off with them now. I am up to date with my payments, so no problem there, and I only have two or three late payment charges since 2003. It's just that I asked them in the letter in April to cancel all account cover payments as I could not claim insurance due to unemployment, and they have completely ignored me. I think I should ask them for a CCA agreement which should show whether or not I agreed to PPI. However before I do that I want to know how much I can claim for since 2003. At the moment it come to about £500 which is half the debt anyway.

This is why I need a spreadsheet to work out the interest etc.

 

I am pretty sure I never signed up for PPI all those years ago.

Don't forget we are talking about GE Money here and we all know how slippery they are. :p

 

Any advice would be useful. I just want my unwarranted payments to 'Account Cover'

back.

Right spreadsheets, I don't think it matters whether its a credit card or a store card. You just need to enter in the date the ppi was taken and it will automatically calculate the interest from that date.

Have a look at these

 

England - Advanced - Excel

England - Advanced - Works

 

 

Choose the one that is compatable with your computor software.

 

Click on it The first page enter the details it ask. Look down the the left bottom and you will see the tabs, charges, click on that and then enter your date, ppi amount taken, click on the colomns and it will automatically add them up. Then go down again to the bottom lt and click on the tab interest. It will have automatically worked out the interest at 8%. If you wish to charge the interest rate, you can do this by clicking on the interest box on the rt hand top I will only work out interest to the nearest round figure so if you put in 18.9 it will work it out at 19, you will see what I mean.

 

Once you have had a play around it does become simple. honest. My face really was like this:o when I first tried to use it.:lol:

I think the site is so big now that not everyone sees other threads. They tend to look at ones that are relevant to their problem. I know I do (unless I am bored and then I read everything in sight :D)

I am still undecided as to whether or not to CCA Debenhams. I think I will just because they ignored my letter in April.

 

I need to claim my PPI back from them and that will half my payments.

 

I shall try the Credit Card spreadsheet and let yopu know what happens. I am off for my shower now as we are out to a Cockney Night tonight.

For you Mancunians that means Pie and Mash (lovely) beer and 'Maybe its because I'm a Londoner songs'.

 

Its always a good night and every one wants tickets. trouble is me and hubby have to set the tables and clear up afterwards etc,

I have been with Debenhams for over 20 years and although I remember some sort of a form, I haven't got it now. I have moved two or three times since then so it has probably got lost along the way.

 

I may send them the request just to see what they come up with

I have today sent off a letter to dDbenhams (GE Money OOHEERR) asking for my CCA and PPI agreement.

As I took out my Debenhams account almost 25 years ago, I shall be interested to see what they come up with.

 

That will teach them to ignore my letter.

I got a letter from Debenhams yesterday stating that my complaint will be dealt with within 4 weeks. :o

 

I haven't complained. All I have asked for is my CCA agreement from 20/25 years ago. :)

 

I can feel a non-compliance letter coming on. Perhaps I should print it in big letters so the idiots can understand what I am asking for. They obviously didn't read the other letter properly. Or are they trying to get round the 12 day rule??

Go Maggie Go:D You keep at them. M&S tried this on with me, Yea treat it like a complaint and they will get back to you in the year blah. You know your deadlines that is all that matters. 12+30days. You know after the 12day working days they are in default. he he

GE Money..argghhh .. you will have fun with them, Trust me I know how they operate..lol

Got my monthly statement from Debenhams yesterday

 

I am flabbergasted. I sent a CCA request last month with my pound cheque and they have promptly put it on my statement as an extra £1 payment. :eek:

 

Do they employ monkeys down there?

 

Now I have to write another letter asking for my CCA, declaring them in default for being 2 weeks over the 12 + 2 days, and telling them to educate their staff as to what happens with CCA requests.

 

I could stop paying but I won't. I just want a copy of my CCA agreement if they have one. They certainly won't be getting another cheque from me. :mad:

GE Money phoned me this morning about my request for a CCA on my Debenhams account.

 

She was very apologetic and said that my CCA will be with me in the next few days. :D

She did say that they definitely had my CCA. I am not sure, I took the account out 25 years ago when I lived in Exeter, and I would like to know what they are going to produce.

I won't hold my breath.
