    • if i remember rightly, long ago in one of the first drafts of the old proposed gov't overhauls, there was a listing of recommended 'charges' that inc wrong reg = £20. some PPC's implemented such changes in advance. then later as it looked increasing likely the new code was never going to be implemented after it's 1st review and another set of codes was to be debated they all quietly revert back .......... dx

Sorry what is the different between a default notice and a default cal marker? yes, i may try and work arrangements out with the OCs after the breathing space but I'll see my circumstances then thank you again for all your help and patience, I really appreciate it and apologies If i am too fast or repeating myself.
    • receiving a default NOTICE (forget simple default cal markers) does not mean it will get sold on... OC's very very rarely do court themselves.  if it does you would receive a Notice of Assignment from the debt buyer/DCA.  as for reduced payment if it remains with the OC and they issue a DN, no harm in trying but lets get all your ducks inline first. dx  
    • okay thanks do you know how long it will take for it to get to the DCA or could the OC try and issue a CCJ? even though it's unlikely also for example would the OC agree to a reduction and a small payment over a super lengthy period of time if agreed? Rather than go through chasing apologies again for all the questions, just trying to understand all the possible scenarios.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

banished to the bear garden for misbehaving simon your fault.Right kia is a woman i just checked for anyone who wants to know :Di have to be rescued form deepest scotland as this castle is cold on the extremties but beware simon there is another suiter after the key and he has a white charger to carry me away from cf and to safety so you might have to have a dual for my honour and to the victor the spoils but i hear your challenger has recovered the chopper from maria who has returned so prepare to fight simon and await with interst the outcome ;)good to see u back on form simon xkia

The wanderer returns!

 

Fresh from Comet with a shiny new laptop..........other one went, POP, Cough, fart, sod this for a lark and off it went to the computer shop in the sky...............................or something like that!!!!!!!

 

Good job my mummy has credit card, she had to pay! She said I can pay her when I get my charges back, no pressure then!:D

 

So anyway off I went on my tellytubbie scooter up the A1, oxygen and sandwiches in the trailer......................after being stopped once for speeding and once for flashing:eek: !!!!....................well thats what the judge called it.........I told the bloody nun I was only relieving myself as she tripped over it...................................the tellytubby scooter that is!! I finally arrived in bonnie.........err...........London!!!!!!!!!!!!!!

 

So here I am.......oxygen depleted.....sandwiches gone a strange greeny blue and got a fur coat.........and to top it all no sat nav............jumped on it when it took me wrong way..........stupid bloody thing!!!!!!!!.....Oh and no money left........ Abbey took it! Nowt new there then!

 

Can't see any castles but there is big house at the end of this long road with big gates.......says someone lives there called HRH.........must be loaded cos have got own flag on the roof! Maybe I can get a bed for the night????? but not pay, maybe even some hot scotch broth or haggis n neeps followed by a wee.............(hope there's no nuns this time)..dram.

 

Hmmmmm, wonder where Kia is.........might ask in a shop later.......big place this Scotland.......didn't know it had a place called London though and where are them wooly bullocks and big.........................................

having decieded that scotland was too cold i decieded to move to london where the weather is more clemant (but where was my lear jet when i needed it lexy )and what happens i end up paddling up the Thames in a dingy passing by a woman with a crown on wonder who she is then anyone know trust me to pick a castle that floods lol and as for cf well last i saw hed cut himself on his chopper so dont think ill see him again in a hurry but lexy does a good range in meat i hear so im heading in devon direction now any one got a map then and wheres this promised lear jet then xxkia

Finally caught up with cf last night.............confronted him with my Superman thong on:eek: ! and a blow up hammer I got from a seafront shop before setting off. Not exactly a pretty sight but was hoping for good weather and a suntan on my travels:lol: Anyway he has retired from kidnapping for a living apparently.......................he stuck a pin my hammer and said I was 3 weeks to late!!!!................thought it was a bit mean myself...............but there we go.

 

My contact in the tower reckons the woman with the crown is actualy Mrs Abbey National............must be on the way to pawn her jewellery to pay everyone off:grin: He also tells me it's sunny in Devon but tt scooter failed it's MOT!!!!.....................found a helicopter shop by chance....so hurredly wrote out 4,374 cheques for £100 all guaranteed grabbed the keys and run off.....................bloody thing turned out to be pedal powered!!!!!!!!!! Off we pedal towards the Devon Cream Tea Shop then using a map I found in the boot with a big X on it.............also a set of keys, a shovel and a false leg.................bit strange but if it helps with the pedalling who cares:lol:

hiya simon cf past history as his bubble burst a while ago me spies in the underworld reckon its bucketing again in devon so i reckon the canoes are out again but im running away form alot of flesh eating zombies im on the back of a bmx chopper and ill tell you what they arent made for two ouucchh pedal faster otherwise were done for i see in the distance a big metal thing is the arc de triumph no i aslo see lots of kiss me quick hats and candy floss where on earth am i france maybe ill have to hide out for a bit under this donkey hope it doesnt move as its a tight squeeze in here for two of us im sending this message by dixlexic pigeon so ill not hold breath for reply lol xxkia ps think ive lost the zombies now
