      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all,

 

Thanks for the posts hopeful1 and pecky1.

 

Just a little update. We had another call from Moroncrap this afternoon, around about 4. It was their area code so we let the answer machine kick in, they used another number to ring us from.

 

Some ding dong called Andy, said something like "This is a message for N.P. This is Andy from MDR, could I ring him as soon as possible on number 01614752802".

 

Of course I don`t intend to do anything at all.

 

I`m wondering should I just sit tight or fire off another letter of some sort.

 

My SAR to Argos was sent Special Delivery but it still hasn`t got there and it was GUARENTEED next day, that was 3 days ago.

 

We asked at the Post Office about the Postal Order and they said they couldn`t tell us if the Postal Order has been cashed or not. We asked if there was a number to ring and they said we can`t we can only send a letter requesting if it`s been cashed.

 

Anyway, I`ll check back later as I have just landed in from work and need a good cleanup.

Hi Pecky,

 

Thanks for that. I definately won`t be ringing them ever.

 

It`s just the problems with the Recorded and Special Delivery (Not!) letters not showing on the Royal Mail site. I`m not sure what to do to be honest.

 

But, saying that, their original letter gave me 7 days to respond, yet all they have done is phoned me.

 

I`m just going to hang about untill the next letter comes through, then reply with a suitable letter and also a FAX. I`m with Tiscali and they have a FAX facility on their home page for members. It`s only 10p a sheet and supports MS Word Files.

 

Does anyone know how many phone lines these annoying walter`s have? I think I can only bar 10 with BT Choose To Refuse. heh heh.

 

I might just answer the next call and fart and blech down the line then leave it off the hook untill they ring someone else to hassle.

Hi folks,

 

Just a little update, nothing exciting I`m afraid.

 

Yesterday my girlfriend rang Royal Mail regarding my missing letters, while I was at work.

 

She mentioned that EVERY TIME we send a letter by Recorded Delivery, they NEVER get signed.

 

This has happened with all our letters to the bank, and has now also happened to the letter to Morecrap.

 

The SAR to Argos, which was sent a couple of days laters was sent Special Delivery which cost us £4.30. This letter was supposed to be guarenteed NEXT DAY before 1. It was sent last week, and there is still NO signing on the Royal Mail Tracking Site.

 

The woman at Royal Mail never seemed to say much, only last week they were actually on strike for 3 days and that she was really sorry and will send a complaints / missing mail form out. They should get there by next Tuesday.

 

My girlfriend explained to them that people are paying for a service which Royal Mail is not supplying and if they are unable to give this service then they should not be charging more for it.

 

We have received a complaints form before but to be honest, it was 4 pages long and I just couldn`t be arsed to fill it in. If we did, we probably have to email or fax it to make sure it got there.

 

Anyway, that`s all for now.

Have had the same with Royal Mail but dont give up on your letters I sent Recorded to NCO another one like Moorcroft, tried to track the letter didnt show up on the system, but recieved a reply from them today thanking me for the letter I sent them which was the Recorded one I couldnt track.

So it still could get to them.

Hi NP. What a nightmare you are having with Royal Mail. I have made a complaint through their contact info on their website which they replied to within a day or 2. Strike or no strike, special delivery should definitely be signed for at the price it costs.

 

As Pecky1 says, the DCA/ARGOS may acknowledge the letter. At worst, if there's a PO inside it's more than likely they'll deduct it from your balance. I never had statements from Moorcroft, but the balance was always on the letter, so i could see it decrease.

Hi guys,

 

Thanks for feedback. Another update:

 

I received my statements from Argos this morning, they have obviously responded well inside the 40 days allowed, and obviously they DID receive the letter which was sent Special Delivery, so I will assume MoreCrap received their CCA Request which was sent Recorded Delivery.

 

The thing is, I can`t make any sense from the Argos Statements (screen prints). They`re nothing like what I was expecting, I was expecting something similar to a bank statement format.

 

There are listings on named: PURCHASE, PAYMENTS, FIN CHGS, OTHER DB, OTHER CR, RETURNS, DISPUTES, DISPU REL, PAST DUE, TOTAL DUE, BALANCE, ACTION H/C/P

 

I`m obviusly looking for charges of any sort which can be reclaimed/deducted should they show up with the CCA and I have to pay.

 

Should I scan a statement or two up for you guys?

 

I would appreciate any help anyone can give on this.

Hi NP,

Glad you have recived something back, The other DB on the sheets means any charges for late payments and letters sent to you I know this as I looked on a statement that I have. They were charging me £35.00 some months, FIN CHGS is the Interest charged that month.

I worked it out myself if you are not sure maybe write and ask them to make it clearer.

Have you recieved your CCA from Argos only mine came the day after I recieved my Statements,

I expect Moorcroft got you letter as well, waiting with Interest!!:p

No, I haven`t received a response of any kind from my CCA request, just a call from the Moroncroft in the week which we ignored and let the answer machine answer.

 

Did you say you got your actually CCA back or was it the Application Form and a seperate T`s & C`s booklet? I can`t remember which you said on your thread.

 

I have also subscribed to your NCO thread, so I will have a read through that later.

 

At first when the original letter from Morecrap arrived, my girlfriend panicked like hell but I had previously been reading quite a few threads on here, so I knew it was just standard crap. Now I`m quite excited at the challenge of dealing with these idiots, I just wish they`d get back to me with something so I can fire off the next letter.

 

Right, we`re off out now. I`m going to sign up for some driving lessons before I have to start and pay Argos back. I had 26 lessons with a friend, but he split up with his wife a couple of weeks ago and has vanished, so I don`t know what`s going on there.

Got Applicaton and booklet with T&Cs. Taking your advice and sitting tight at the moment. As far as I can make out Moorcroft will now have to pass it back to Argos as they are the original creditors for this account.

Finally got a response from Morecrap this morning. So it looks like both my Special Delivery and Recorded Delivery letters eventually got there, even though they still haven`t been signed for I paid extra for the service. What a pile of crap!

 

Anyway, from what I`ve seen on the CAG site, it appears to be their latest standard reply.

 

I think the plan is just to still sit tight and do nothing and wait for them to send back the CCA, is this right?

 

Also, I`m not sure when to start the 12 days + month from, due to the dodgy Royal Mail service. Has anyone any idea`s on this.

At least you got a reply Im still waiting from them well over the time limit now, Looks like the standard reply, Just let them dig a hole by not producing your CCA ,Looks to me like Argos still own the debt if they have to go back to them.

:) They sent me the exact same letter, recieved it yesterday, see mcnab v moorcroft thread! I read elswhere on here that they are trying to get you to enter into a dialogue which you have no legal obligation to oblige and this is just more intimidation for those wavering about following the CCA course of action. I smiled and filed, it's not a personal response, they must have posted 100s of these out in the last couple of days.

 

I see it as a box ticked at my end, standard letter recieved as predicted:-D

Oh, that's exactly the same letter i had. There was me thinking i was special!!

 

You can ignore it. Because that feeling of control was starting to wash over me, i decided to push things a little. I sent this:

Thanks for the posts pecky1, mcnab and Hopeful1.

 

I`m glad to hear I`m not the only one to receive this particular letter. I suspected it was just a standard letter, as it`s not very personal as mcnab states.

 

I think I`ll wait a day or two then fire off a copy of Hopeful1`s letter (above), just to lift the pace a little.

 

In the meantime I`m going to list all the charges from my Argos statements, just incase they come up with something legal.

 

I beleive that the reclaimable charges are under the `Other DB` headings in the Argos statement screen prints, as explained previously by pecky1. Can anyone confirm this.

Thanks for the post. No, I haven`t had anything since the last letter I scanned up. No calls, no letters, nothing!

 

I never fired off your letter, in order to speed things up. I was going to, but my printer decided it was out of ink when I turned it on. It was then a few days before my new ink carts arrived, so I never bothered.

 

As soon as I anything happens I`ll let you all know.

Nope, I haven`t heard a sausage, no more letters or calls since my last posts, cool eh? Perhaps if you correspond with them you get letters back, but maybe they just give up if you totaly blank them, I don`t know.

 

Have you had any more calls or letters from anyone?

 

I`m using the money for driving lessons at the moment, heh heh. I just hope I can pass before someone comes up with a CCA. I have a test booked for 8th January, so wish me luck, ha ha.

We write further to your recent letter. We can confirm that on this occasion we are unable to provide a copy of the signed Credit Agreement as we are no longer dealing with the above account. We have therefore returned the postal order submitted in that connection.

Now then, I`m quite puzzled as to their wording on this, `as we are no longer dealing on the above account`.

 

Does anyone know exactly what this means? I`m thinking someone else might have taken over or is it just their way of say they give in?

 

I`m all puzzled as to why they haven`t even sent me an application form back, nothing, just this letter.

 

Any comments on this please?

Just a thought.

 

Argos left a Default on my Credit Reference before setting Morecrap onto me.

 

Now, I was wondering. If there is no CCA (so far), then shouldn`t I be able to apply to the Credit Reference Agency`s to remove the Default? If their is no CCA, then I couldn`t have agreed for them to give my details to a third party.

 

If this is so, then who do I contact?

 

I`d appreciate any feedback on this please?

Once again another standard letter. I had this re Littlewoods acc. They sent it back to L'woods who sent it to another DCA!

 

Never heard from Moorcroft again tho :p

 

With regards to the default i think the thinking is that the lack of CCA means the debt is unenforceable not that it doesn't exist. Some people are embarking on these battles though. If i come across a thread i'll post the link.
