Hi

 

We have received an order of possession from our lender SPML

 

An offer was received on the property on 9th June which we accepted and the sale is progressing. The leaving date from the property is 31st July.

 

What should I do? I have informed the lender by phone and letter that a sale is progressing.....HELP HELP PLEASE

Hi

 

Not sure I can help as not an expert but I thought a possession order must come from court. If so call the court and explain that you have a buyer and that you have informed the mortgage company but they seem to be ignoring you and insisting on 31st as leaving date.

 

I'm sure if you have proof of a sale this should halt things.

 

I'm sure someone else that knows better will be along soon.

Is this order from a court after a hearing ? . The lenders cant just order you out.. If its from a court, ask for a suspension on repo because of proposed sale.....That should get you at least another 28 days after repo date, but you will have to foot the bill..

Natwest Paid me again as GOGW £1,656. Yes they can have it back if they say please.

Barclays 1 Claimed £1,260. Won by default. Paid in full

Barclays 2 Claimed £2,378. Won by default. Paid in full

Birmingham Midshires. Claimed £2,122. Accepted £2,075.

No, we haven't exchanged contracts yet, the purchasers have just received there mortgage offer through,.

 

I rang SPML yesterday and they said they were unprepared to halt repossession unless exchange of contracts had taken place.

 

How would I request a suspension?
