can anyone help a little confused,a defence has been filed/ sent to my local court by sechiari clark and mitchell and i have received same. 10 point defence which in a nutshell says lloyds are entitleld to inflict these charges as they are not penalties and not a breach of contract, so need a bit of advice on what to do next ( have not received a court date as yet) also very confused on point 9 of their defence which states: further insofar as part of the claimants claim is based on charges levied on their account prior to six years from the date of issue of claim, that is 08/05/2001, this part of the claim is statute barred by section 5 of the limitation act 1980 . the defendant is unable tio verify the ammount claimed prior to the 08/05/2001as the particulars of claim does not show how the amount claimed is arrived at . i have claimed from 01/10/01 not before this date as this was the first date of charges on the statement entries that lloyds sent me so i do not know how they have come up with this is it just an error on their part
