HSBC recently settled with me in full and final. As they waited till The case was transferred to my local court I decided to issue a wasted costs order. I have today received a letter from Dartford County Court stating that as the case has been full and finally settled there is no basis for a wasted costs order. Is this right ??

Had a similar response, saying either the case has been settled or not. How do you respond to this?

HSBC £320 with contract interest, prelim sent 12/11/06

 

Natwest Visa £825 with contract interest, prelim sent 15/11/06

 

Barclaycard S.A.R - (Subject Access Request) 7/11/06

 

MBNA S.A.R - (Subject Access Request) 7/11/06

 

Shell Visa S.A.R - (Subject Access Request) 15/11/06

 

Amex S.A.R - (Subject Access Request) 7/11/06

I guess you could argue that the case would have been settled out of court anyways. And doing so saved court time.

Hi, i'm doing the same with MBNA, the Judge basically told me to withdraw my statement that the claim had been settled and negotiate with MBNA for further payment on the basis that they didn't admit liability as they said it was a good will gesture. Hope this helps.
