    • No, but all you'd do is blindly run the statute barred date for another 18 months. Just sit on your hands until you get a letter of claim, then send a CCA request.

    • Just an update, finance company rejected my complaint saying they've found damage but can't tell when it's from even though I've shown them how the front end is misaligned in the advert photos compared to another identical model car they're selling.  Dealership now want to charge me to get the car brought back to me but will only discuss over the phone which seems off. They're also saying no damaged was picked up by JLR main dealership before I purchased it but my local JLR dealerships till this day haven't mentioned the damage to me because they don't go into stuff like that for some reason lol  Ombudsman case is still open, not sure if I should leave the car with them or just pay to have it brought back.
    • Hi all, I get esa and pip,  I have £1200 in arrears that I owed my ex partner, I have been paying £100 per month to clear this debt that was setup by standing order, as I have complex needs I forgot about this standing order and have overpaid mainternance by around £4000, I told CSA I am happy for my ex partner to keep overpayment I do not wish to seek anything back, however they have declined to take of the sum of £1200 and are still saying I owe this to my ex partner.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all

 

This is the first time ive posted on here, ive read alot of the threads on here and im ready to get my money back!!

I sent of my prelim letter and recieved a standard fob off letter, ive got my Lba letter ready but im not sure about my spread sheet? on the spreadsheet i sent with prelim letter i did not add overdraft interest should i have?

 

any answers would be very helpful

no you cannot claim any interest listings they charged you

however, there is nothing to say you cannot add interest to the total your are claiming

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

I havent added it onto my spread sheet but when i wrote my LBA letter it said

I calculate that you have taken £xxxxx plus £xxxx which you have charged me in overdraft interest for the sum which you have taken. total £xxxx.

 

i added the overdraft interest on from my bank statements was this wrong?

 

please say it was ok because ive already sent it recorded delivery1:confused:

You can add the overdraft interest that lloyds have taken from your account ONLY if that interest has accumulated as a direct result of charges.

 

I put most of my overdraft interest onto my claim but it was a touch easier for me as my overdraft limit was interest free and so after the first charge all overdraft interest came as a result of the charges. There is a spreadsheet to work out what part of the overdraft interest taken was as a result of charges and so reclaimable

15/05/07 Lloyds do not attend. Judgement ordered for £192 approx, £3 travel costs and removal of default notice

29/05/07 4pm Lloyds deadline for payment of CCJ expires. Warrant of execution ready to go

19/06/07 Letter from court stating Lloyds have made a cheque payment to court

thanks dave

I posted the lba today so i cant change it now but what shall i do at my next stage take it off or leave it on?

the amount of interest ranges from 0.19p to £41.67p im not sure if my o/d was interest free

 

any help would be great ;)

To accumulate interest of £41.67 your overdraft would be about £2900 if paying at lloyds TSBs standard classic account rate. If this sounds right then as this is interest for an agreed overdraft (I assume) it is not claimable.

 

However depending on what your charges come to chances are at least some of the interest would be claimable though how much depends on what lloyds charged you an when.

 

The advanced spreadsheet from the library should work it out for you though you will need to go through your statements with a very fine toothcomb and know exactly what was happening with your account at each charge.

 

End of day your LBA is more than likely wrong so I would send a revised LBA. Up to you if you want to work out the exact interest they owe you or just leave it off. You will have a better idea of if its worthwhile to leave it on or not.

This is their standard goodwill gesture, can you post details of how much your claim is. Inform them that you will acceot ythe cash as a part settlement and you will continue to seek the balance.

ive looked at the letter and im still not sure which one to use?

lloyds has put 750 quid into my bank as a full and final settlement they said "please treat this letter as our final response.this means if you are still unhappy you can ask the financial ombudsman service to investigate your complaint !

i dont know what letter or who to write to?

if u can help that would be great?:confused:

It depends on your circumstances which one of the letters you send (that livelylad linked you to).

You need to read through it carefully to see which one applies to you.

 

The advice here is usually to send one of those letters and then continue with your claim but i'm not sure if you can do this. You said that you sent the LBA off about 5 months ago. Did you continue with your claim after that or has this £750 come out of the blue after 5 months?

i sent my LBA off to lloyds they sent me a standard letter back saying they would look at my detail and get back to me within 4 weeks!!then i got another letter saying they still hadnt decided and they said they would be back to me within another 4 weeks ? this didnt happen so i rang them at andover to leave my ref no on the answer phone but that was so full there was no space left to leave my detail! in the end i rang head office and the said they would email them my details then 10 days ag they put 750 in my bank and i recieved a letter from them!

now im not sure who to write to??
