Hi there,

 

If you have a look at my thread, on the last few pages, it gives a link to a Judgement Form posted by GaryH (if you aren't in possession of one already). Also, there's info. on Wasted Costs, which you probably ought to start thinking about.

In terms of my own case, I don't know whether I should submit a non-compliance letter first...

Isn't sticking in an N255 Judgement form a little pushy?

I don't want to upset the judge whilst they are deciding on whether to stay my case.

Hi there,

 

It certainly wouldn't do any harm to send a non-compliance letter but it wouldn't do any good either in my opinion as far as A&L are concerned ... they're just not submitting documents at all because there's no way they can justify how they reach their charges and have obviously been instructed by A&L not to submit anything to the courts. I think sending this letter would only serve to delay things further for you. The court will just put it on file and wait to see what happens. It's also inviting the court to "make a further" order and give Wragge more time, but they won't be submitting anything anyway:rolleyes:

 

Personally, I'd submit a Judgement Form to the court with a letter requesting the judge gives it consideration. He can either action your request, which will speed up the whole process, or say "no" and apply a stay for now.

Gutted... I've been stayed just one month from my hearing date.

I am not a happy bunny, I had the application for judgement ready to submit on Monday before heading off on my hols.

What is the rationale for trying to get the stay lifted?

Will that fact that W&Co have not submitted their defence help?

Grrrrrrrrrrrrrrrr
