Hi Guys

 

Haven't posted a thread for absolutely ages, but have now got to the stage where i think i'm gonna need a bit of support.

 

I've written to abbey and am at the stage where i've threatend court action but the day before, received a letter from them asking for an extra 4 weeks to 'look into it' Hmm.

 

I take it I just go ahead with the court thing? Do I need to let Abbey know first?

Hi Ellie,

 

have you followed the steps and sent them a letter before action? If so and they are past the 14 day mark proceed to the next step. Dont let them dictate to you a timetable, get the N1 form in asap with the list of charges.

 

The courts are busy and I started my claim on February 23rd I still have no court date.

 

So best to push them you cab do it!:D

Yes, I sent a letter advising I would be taking legal action if i had no reply within 2 weeks and got their response the day before the 2 weeks were up... I will get a move on with the N1 form......

 

Was also thinking about Financial Ombudsman.... any comments either way??

 

I can't believe you don't have a court date yet? There must be 1000's of us doing this!

I have no experince of the financial ombusman personally.

 

By now you should have done the below if you are ready for the N1 Form:

 

27/02/07 Sent Data Protection Letter

28/02/07 Data Protection Letter Receievd by Abbey National

14/03/07 1 Years Worth of Statements Recieved from Abbey National

22/03/07 Abbey National cashed my cheque for the Micro-fiche data

03/04/07 Sent Letter Before Action (Chasing Micro-fiche data)

04/04/07 Letter Before Action Recieved by Abbey National

10/04/07 40 Day Limit has now expired only 1 years of data sent.

19/04/07 Recieved full list of Charges from Abbey and withdrew my complaint to the Information Commissioners Office

24/04/07 Prelim letter sent to Abbey with a list of my charges without 8% Interest. 14 Day Limit.

26/04/07 Abbey respond by telling it will take four weeks to investigate what ever!

08/05/07 LBA Has been sent special delivery to Abbey 14 Day Limit then N1 will be submitted, with list 8% interest.

 

Hopefully you have done all the above.
