I am in the process of selling my house. I have a buyer, and we have signed, but not exchanged, contracts.

 

The buyer's solicitor has said that the ownership of part of the frontage of the house is not clear. My solicitor agrees, and says that the solicitor who acted for me when I bought the property (6 years ago) should have identified and dealt with this at the time.

 

None of this has affected the sale, which is going ahead, but it has created a delay of almost two months, and has increased my costs by several hundred pounds to correct the situation.

 

Can I take any action against the solicitor who dealt with my purchase of the property - to recover my additional costs, for example?

Yes. Get your current solicitor to write to them as he knows exactly what the problem is as he has had to sort it out.
