hi again

 

due to start mcol on monday, i have already declined nat west 1st offer, is there any chance that they ever send out another offer or do you just get then one then off to court.

Hi loltel, try not to worry. You will get your money back - and if you file at court you'll get your court fees plus 8% interest back as well.

 

However, I'd strongly urge you to file using N1 at your local county court. A lot of the MCOL claimants are being issued with CPR 18 requests for further information because there isn't enough room to adequately particularise the claim using MCOL. Seriously, if you're filing at court, use these links here N1 Claims form in .PDF format with form filling 4. Particulars of claim - N1 - hard copy version and post back further if you need any help ;)

Hi loltel

 

IMHO, if you can, you should use the N1 form to your local court and not MCOL. Pretty well all the cases on here that have got into grief, that grief is in some part due to having used MCOL. It is a good system - there is just not enough room on the form to put in everything you need for a bank charges case.

thanks all

 

i will go down the n1 line i think, i have tried to get my head round it all online but i get so easily blinded by science that i would give up as soon as anything said " we are right your wrong because"

 

but i will give it a go, monday 16th is the d day.

 

is the n1 route the one that takes a few months to process and sort out ?

Both routes have the same timescales attached to them - the main difference between them is that there's more room to properly particularise your claim using N1 hard copy at your local court.

As hedgey says. And becaue of the potentila extra messing about and the fact that the case gets moved to your local court anyway, the MCOL route can actually take longer

hi all

 

i have successfully negotiated the spreadsheet and for that i deserve a medal :p

 

now then do i just copy the template you linked for me onto this n1 form with all my relevant details in place and take it to the court on monday with the spreadsheets (3 copies of all) or do i have to add anything else.

 

my head is spinning round in circles

 

sorry i am a pain :-D

Hi loltel - and well done you!!!

 

In answer to your question - yes!! Copy and paste it onto the N1 form and make sure you add all of your own details. And don't forget your bank account number............ you'd be surprised how many do!! ;)

 

And yes to everything else! Sounds like you've completely got your head around it................ get a glass of wine, you've earned it! ;) xx

hi all

 

ok have been to the county court and filed the N1, paid the fee and gave them all papers etc,

 

what do i do now, i.e how do i know when its served and they defend?

can i check it online ?

 

can feel another bottle coming on :wink::wink:

Hi loltel,

 

Basically, the court will serve your claim on cobbetts in a couple of days and you'll receive a 'Notice of Issue' form (N205A) along with a copy of the N1/schedule of charges.

 

Cobbetts will now acknowledge the claim in 2 weeks - and they'll then have 28 days from the date the N1 was deemed as served on them to submit their defence. However, you know how late they are - so give the poor dears a few days grace! ;)

 

Start having a read up on the next stage (e.g., allocation questionnaires, draft order for directions, etc.) just to be prepared.

 

Unfortunately though................. you've got a 4 week wait until you receive the defence. You poor liver'll be pickled!! x ;):D

Are you on your 3rd then? You must be on holiday. There's always one (and it's me, sorry) but it might take longer that a few days for it to be issued. Here it is taking approx 2 weeks 'cos they have 60 cases a day to issue which is not pleasing the staff as approximately 48/60 are settled with a fortnight. This does however give you time to read up on the next stage - hope London is quicker for you.

Are we talking about wine here? 60 cases a day seems a bit excessive, even for all of CAG!

:grin: can you imagine all the county court staff round the country picking out the CAG people by the waft of wine thats following them, probably issue them all with a red or white sticker to verify the claims !!!!!!!!!!!!

 

i was quite surprised when i got to the court, i was expecting to queue for a while but there was no one else in there and only one counter out of 4 open, hopefully its a good sign that they are not inundated.

hi all

 

can you give me any idea when i should hear from the court, i filed my N1 on the 17th july but have not received any notice - or am i looking for something that does not exist :razz:

 

still ploughing my way through the 60 cases ( all red ) as in previous posts, i know you all give great advice but this one should go down in history, i am doing my utmost to follow your directions to the bottle ( sorry the letter) :D

I'm going to have a greah (hic) summer!!! Just rejoined the Sunday Times Wine Club (this is me chaps - nothing fancy at all) and I have ordered one case of rose at approx £72 and they are sending me a mixed case for free. Quality is good and I can't see the point of spending large amounts on wine I really wouldn't appreciate.

 

Being cautious I would allow 2 weeks to hear from the courts. If it does take that long it is only because they are busy. Here in Brum they are filing 60 cases per day. Really good idea that you are using this time to read up on past cases. There will be no surprises in store for you then. It is unlikely you will hear anything from Natwest now and will just have to deal with Cobbitts. All the best, but you appear to be okay.

 

(Just stick to the good stuff, huh?)

oh my god, what has happened :eek:

 

there i have been away on my jollies to sunny malaga, arrives home and the postie has been busy :confused:

 

letter 1 : the courts notice of issue, issued 20th july, deemed served 27th july.

 

letter 2 : dated 26th july from mr higley, telling me he is sad i did not accept his offer but should i change my mind he will happily pay me it forthwith.

 

letter 3: acknowledgment of service has been filed on 2nd august

 

letters 4,5,6 & 9 gas, sky, bt,electric

 

letters 7 & 8 makro mail, tottenham hotspur season ticket

 

 

so here i am reading the latest gossip and thinking where do i go now, do i carry on regardless or accept his offer or will that be cancelled now i have gone through the court.

 

please advise as now on last case of red

 

still catching up on threads but i believe congrats are in order hedgey :grin:

Sounds as though you're not far off from receiving Cobbetts' defence! Now may be a good time to replenish the case of red dear!

hi all

 

postie has just been and i am more confused than ever now!!!!!!!!!

 

have received another full set of statements from nat west ? (first set arrived back in june)

 

another duplicate letter from mr quigley, how sorry he is but if i want to accept his offer, please return slip. ? ( same wording and date as first)

 

and a letter from cobbetts enclosing their acknowlegement of service.

 

secondly decided to ring local court and ask about cases, the lady answered quite directly and to the point - "no cases have been stayed" and put the phone down on me. lovely people at Edmonton County Court it sounds.

 

any advice on what to do with statements, or is there a reason for them that i am totally missing, is ther duplicate mr higley letter just a standard thing that happens.
