hello

can someone help me?

halifax have paid £2,193 in to my account when they owe me 5,000.

i did not recieve an offer letter and when ive rang them they said that what i was getting and now my claim is allagedly void, as i have accepted this amount (i did not) they said that they cannot take the money back as my charges have came out of it! what do i do next?

You need to send the rejection letter, chose the one which suits your claim.

30-12-2006--Requested statements from Local Halifax.

02-02-2007--Statements Recieved.

18-04-2007--Prelim sent.

20-04-2007--Reply , Thanks , give us 8wks letter.

02-0502007--Sent L.B.A. & Schedule of Charges

11-05-2007--Recieved reply ,still investigating.

17-05-2007--Sent Amended L.B.A. for Contractual Interest this time.

14-06-2007--Received standard Bog Off letter.

13-06-2007--Took N1 to Local Courts.

26-06-2007--Copy of N1 from Court, issued 21-06-2007. to Halifax, Deemed Served 25-06-2007

Have till 09-07-2007 to file Defence.

05-07-2007--Note that Acknowledgment of Service been Filed on 29-06-2007.

Have 28 days from date of Service to File Defence.

07-07-2007--Offer from Halifax.

09-07-2007--Rejection letter sent to Halifax. Next day delivery.

10-07-2007--Money put in Account:mad:

No. I was sent this offer before the date I said I would instigate court proceedings.

Take SSL's advice and send them rejection letter then.

Have you sent a LBA off yet then or did you just send the prelim requesting the charges back.

 

They put money in mine today but Ive filed in Court ,got letter off them offeing me money first . Sent rejection letter off yesterday , then they go and put money in without my consent.

Im not touchin it but b****y temptin.

Im just gonna go ahead with the case if they file defence.

 

Are you doing plenty of readin round other threads, I found them really helpful. I thought that nothing was sinkin in but somethin must be case its gettin easier now when the family ask me questions about this site.

 

Keep goin, keep to your timescale and above all DONT let them get to you .

I was really scared when I first started this thought I wouldnt be able to go through with it but hopefully the light at the end of the tunnel is in sight now so dont give up at all costs.

I'm in the same boat LBA just over 2 weeks ago and they've put £4500 for 2 claims in my account tonight.

Not even got a letter yet and it feels weird that I'm about to refuse £4500.

You don't need to, simply call customer service and tell them you have an offer but no letter, they should be able to put you through to the person dealing with your claim. Tell that person you are not willing to accept the offer and you want the full amount, they should agree.

 

Interestingly the girl I was speaking to asked me why our customer was entitled to all their money back when they had repeatedly 'breached their contract with the bank'. I said if she was prepared to provide us with evidence of their costs we would happily accept the difference :-)

Guys!

 

Don't forget this VERY important point:

 

Even thought the money is in your account(s) - you can accept it as a PARTIAL settlement!

 

And press on regardless down whichever route you decide to take!

Discovered 2 further a/cs, and 3 Loan accounts. "Goodwill offer" of £7,424.23 06/07/07. Accepted (partial repayment). 20/07/07 Top-up payments of £2,558.10 & £1,154.00

£11,136.33 paid back thus far.

New claim issued: 9/07/2007 for 3rd account: £500+ PRESSING ON!

The banks are using every more desprate tactics to keep hold of the money they have taken illegally.

 

 

The Waiver is an FSA Conspiracy with the banks against the consumer - Complain to your MP and the FSA about their shameful act!
