    • If you are flying away tomorrow (or rather this) morning I'd just forget about complaining to the police now.  As BF said earlier it's probably just a waste of your time anyway so I wouldn't worry about it.  Forget it for now.  Have a safe flight and concentrate on your other thread against Aviva.
    • I'm afraid you won't get a complaint drafted before tomorrow morning - and I think most others here think it would be a waste of time anyway and that the police decision won't change.  I would ask for a review and make a complaint on principle, but I suspect you are better off concentrating your effort on your other thread and direct complaint against Aviva.   Unless you are out of the country for an extended period I'd wait until your return before considering futrther whwther to complain about the police.   [ By the way, just so that you don't mislead yourself as it's a mistake many people make, ALL agreements are "verbal" in that they are composed of words.  Some agreements are in writing and others are oral, spoken or vocal.  The law recognises oral or spoken agreements just as much as ones that are written down.  The only practical difference is that oral agreements can be difficult to prove in a dispute]
    • Just to add there is a scheme called the Victim's Right to Review.  It basically applies to decisions made by the CPS not to go ahead with a prosecution.  It doesn't apply to decisions made by local police forces, but it does say:   19.  Decisions that are not eligible for VRR include: ... iii where the police or other investigator exercises their independent discretion not to investigate or not to investigate a case further (whether in consultation with the CPS or not) and the CPS have not been requested / have been unable to make a final decision to charge. Requests for review of such decisions should instead be addressed to the relevant police force/other investigator; [My bold] Victims' Right to Review Scheme | The Crown Prosecution Service WWW.CPS.GOV.UK   I'm not familiar with the scheme so can't advise - but other posters here may know about it or have experience of it.  You need to read the above link but note that it talks about things that seem to fit your situation.   eg a victim is defined as ‘a person who has made an allegation that they have suffered harm, including physical, mental or emotional harm or economic loss which was directly caused by criminal conduct’.   If you have not already requested that the police review their decision not to pass the case onto the CPS, then I would do so.  If you are not happy with the outcome of that, complain.   I can't advise you definitely to go ahead and ask for a review or complain, but if I were in your situation that is what I would do.  But I tend to agree with BankFodder that you'll get nowhere and, if you are sick and tired of all this and just want it to go away, then just drop the police.  However, if you don't try...   [Apologies for the italic typeface/font - it's the above link causing it.  The italics should have stopped at the end of the third para above ending ' ... criminal conduct'.  I can't change it.  Very annoying]
    • @Manxman in exile I eloped to get with my husband si my husband and siblings never sat together in the same room .   Hes claiming a verbal agreement was made but a verbal agreement doesn't hold any water in the eyes of the law..no agreement was made I was in Leeds with my toddler.    He has made use of the policy , had the luxury of the insurance and reversed the money back and now Aviva are coming after me.   You've summed it up well is there anyone in the group that can help me draft the complaint to the police as I'm flying out first thing tomorrow and my head is all over the place.   My husband me Mr z , my late father and eldest brother were at this meeting supposedly when the verbal agreement was made but yet the officer took a statement off the eldest brother and didn't take it off the husband and based the final decision on the eldest brothers statement and Mr Z and all other evidence which is in written form has been completely dismissed    I'm fighting it all alone coming from an Asian background I am getting taunts and salt is bring rubbed on my wounds its not been a pleasant experience yo say the least trying to prove my innocence and having to listen to the b******* being spouted out by everyone whilst Mr Z is walking away not guilty 
    • I would complain to the police - even if I thought it would go nowhere.  I can't see that you have anything to lose.   I can't tell you the grounds of your complaint because I don't know the details of everything that has happened (you know better than I do)  and because I've found much of the story too difficult to follow.     But - based on everything you have told us - it seems to me that your brother has clearly committed fraud by obtaining the benefit of an insurance policy by falsely misrepresenting that he was opening the policy on your behalf and also by falsely misrepresenting himself - or a third party - as being your husband.  If your brother could not have taken out that policy without making those misrepresentations, then he has committed fraud.  It doesn't matter whether the victim was Aviva or you  and it doesn't matter if the victim realises they've been defrauded or not - the police should investigate it properly.  In this case you are the ultimate victim of the fraud because Aviva are saying that you owe them for the premiums on the policy your brother fraudulently took out, so whether Aviva consider they were the victims of fraud or not is irrelevant - they don't care because you end up as the fall guy.  Point out that this may have ended in a civil dispute over a debt between you and Aviva, but that that debt directly arises as a result of your brother's fraud in claiming to be acting on your behalf and by impersonating your brother.   One of the reasons the police seem to have dropped this case (and this needs to be one of your main grounds of complaint I think) is that they have accepted without question your brother's statement that your husband was somehow involved or in some way agreed to your brother taking this policy out in your name, and the police have simply and uncritically accepted your brother's word on that without ever speaking to your husband, who would vigourously deny it.    (I can't make any better suggestion than that because, to be honest, I don't follow what has happened.  If you never authorised your brother to open this insurance policy at all then I don't understand why the police would place any importance at all on your husband being present at a meeting with your brother.  What did your husband's presence have to do with the insurance policy?  Even if he had been at such meeting (which you say he denies) then how could he authorise anything on your behalf?  None of it makes any sense to me and I can't see why the police would think it did.)   Challenge the police to explain to you why they believe there is insufficient evidence to pass this on to the CPS   I would follow the published complaints procedure of the police force in question and I would also send a copy to your local Police and Crime Commissioner.   I think the main problem here is that (despite what the nice woman PC may have suggested to you) the police have never considered you to be the victim.  You need to demonstrate to them via your complaint that you are the victim here.   One other question: is your husband and are your family supporting you through this, or are you going it alone?

Ok thanks. But Im confused over taking Abbey to court over non compliance with DPA act, if I am to sue them what steps do I take for that and is there an amount Im sueing for? Or is that the amount Im estimating my claim to be?

Hi,

 

I sent off the DPA letter with my cheque for £10, they have cashed the cheque and the forty days were up yesterday, and nothing. Is it 40 days or 40 working days? If 40 days, dont know what to do now??

 

Its very reassuring to see other people actually getting their money back, but I feel like I have fallen at the first hurdle? Any suggestions greatly appriciated...

It's 40 days (including weekends). Move on to the next letter in the library. They have now failed the DPA. perfectly normal delaying tactics, but you must stick to YOUR timeframe. Do exaclty what you told them you would do, and on the days you said you would.

 

Also, report to Information Comissioner.

Abbey - 547.00 settled in full.

Second claim: £204 WON.

Barclaycard - 142.88 incl interest due WON BY DEFAULT as they didn't even bother entering a defence. Barclaycard paid up £184.88.

 

MBNA - Concluded £634.31

Capital One Concluded £148

Kinda disappointed I've no more banks to go after now...

I am about to give Abbey crap over historic bank charges they EDIT off me - I was with them from when National & Provincial were a building society - so my account ended up with ABBEY through that - please tell me it's a joke - I don't want to be with ABBEY Again as a Bank - it's bad enough having my mortgage with them!! might look to move mortgage.

Hi guys

 

I have been on holiday and am awaiting this morning my redundancy notice!!

 

Amidst the chaos in my life I have managhed to post my LBA to the Abbey giving 14 days notice and a 7 day notice on non compliance of the DPA request for my statements.

 

SO........................ what do I do next?

 

On the non compliance with the DPA do I have to sue them now?

On the LBA after 14 days I give another 7 day warning then file a claim?

Im not sure whether to use the N1 or the online Moneyclaim?

 

Sorry not been responding to mail on here for a while Im feeling a little like giving up at the moment my life is in tatters.

Just wanted to re-iterate what karnevil says... Don't give up... I was made redundant 4 years ago, and, although it feels desperate at the time, when I look back now, I can honestly say it was the BEST thing that ever happened to me!

 

I'm sure things will look a lot brighter in a few months time.

Just waved goodbye to my twin daughters and 3 friends who are going to school to collect their GCSE results! Talk about hyteria!! ha ha.

i was made redundant in 1999,i thought my world would collapse but some helpful words and advice from a good friend helped me to look forward and not back.it seems like the end of the world but i set myself up in business and went from strength to strength.it isn't the end,it's a new beginning.good luck

Well the 7 days is up on my Data Protection Act non compliance letter, heard nothing at all from the Abbey. What shall I do now? It was posted recorded delivery.

 

14 days is up on 05/09/06 on the Prelim letter asking for it back. I will then send the LBA and fill in the N1.

I didnt submit al my correspondence, only my schedule of charges.

 

I have heard of others submitting documents too, does it suggest sending copies of all documents with your N1 in the pack you have downloaded?

 

I didnt notice that in my book ill check when i get home.

thnaks for reply. did you hand deliver your N1 to court? did you have to make appointment? did you pay them on submission of your claim? do they then give you the claim number?

 

i have left this for a few weeks now and so I have totally lost the plot, I need to read agin all day to refresh myself on what I am doing. All I seem to be able to do today is look at my screen and panic!

Letter recieved from Antony Ricketts saying I should have recieved my 6 years statements by now and an offer of £300 as a gesture of goodwill!! Ha.

 

this was my reply

 

I am in receipt of your letter dated 27/09/06, outlining that you can not agree to refund all of my charges. However as a gesture of goodwill you will happily refund £300. On checking my account online I discovered that an amount of £280 had been refunded to my account. This appeared as 11 miscellaneous charge refunds dated 28/09/06.

I telephoned (the number 0845 600 6014 from your letter) at 9.50am Monday 02/10/06 and spoke to Kay.

I asked him to look at my account and explain what the refunds were. He advised me that this was the £300 refund offer made by yourself but it was £20 short. He then made a further refund of £20 to my account. This appears as a miscellaneous charge refund, dated 02/10/06. For this I am grateful but I advised him that I was unable to accept the £300 as a final offer and would be continuing with my N1 claim to reclaim the charges to my account over the last 6 years. I will therefore deduct the refund of £300 from my claim form.

I also advised Kay that I have not received my requested list of transactions and charges relating to my account since 01/01/00 – in short, a list of charges with dates and amounts – alternatively, a complete set of account statements for that period.This request was sent to you on 29/06/06 under the Data Protection Act with a cheque for £10, which was taken from my account 3 months ago.

Kay informed me that he was unable to give me the direct number for the department dealing with my request, but that he would investigate this for me and took my telephone number to return my call and inform me upon the date these statements will be sent to me.

I am aware that you have been willing and able to provide other customers with a print-out of transaction information covering this period – and am ready to bring this to the attention of the Information Commissioner should it prove necessary. I would also draw your attention to Smith v Lloyds TSB Bank plc (2005) EWHC 246 (Ch).

 

This letter has been sent by first class recorded track and trace, delivery, and therefore should have reached you by 04/10/06. Should there be any further attempts to delay compliance, I will be left with no alternative but to escalate this matter into an official complaint to the Information Commissioner and the FSA.

 

On and on this claim seems to be taking an eternity. :sad:

I have to do my N1 now I have been holding out for the statements but alas they have not appeared. I hope this reply looks Ok please advise me someone.

Hi All

 

well I finally got the claim to court.

It was deemed to be served on 29/10/06 which was my birthday, funny that!!

Anyway Abbey have until the 13th November to reply.

Another wait begins.

I still have not recieved my statements.

I was sent an 8 month period for 2003/2004 but nothing else!!

 

In the meantime I had this letter regarding my overdraft.

I did open a parachute account a couple of months ago,

so I do not need this Abbey account.

What advice would you give me here.

I really can not have anything affecting our credit history,

my husband will slaughter me.

I have no way of paying back this overdraft at the moment.

( I have telephoned them, a letter explaining my account was in dispute,

was posted to them on the 23/10/06 but they say its not been recieved!!.

I have emailed them a copy today and will post another tomorrow)

and the cheque-books off at your local abbey branch, or cutting

the cards in half and sending them back in the prepaid envelope

provided. If you know longer have them, fill out and send back

the form I’ve sent you.

 

It’s important that you call us today to discuss payment of the

outstanding amount. If we do not hear from you, we will write

to notify you of our intention to register default information and

pass on the account to a collections agency for full recovery of

the debt.

Hello All

 

HELP NEEDED again!!:mad:

Well the Abbey are really giving me the runaround.

 

My claim is in and and acknowledged by the Abbey, but they say I have provided NO DETAILS as to how my sum has been calculated!!:confused:

I have sent them and the courts my spreadsheet with all my charges listed and a separate estimated amount.

Amount is £1307.11 this includes estimate of £390.

I have still not received my statements although the Abbey say their records show I have been provided with them all!!:-x

 

I have an overdraft of £1500, I opened a parachute account and as from Sept 2006 my salary and all DD etc were transferred to my new account.

 

What is really upsetting me is that the Abbey are now saying I have an unauthorised overdraft and are continuing to charge me each month.

If it is not cleared within 3 months it will be handed over to debt collection agency.

 

I have sent emails and letters to explain this account is in dispute, BUT they say that I have already affected my credit rating. They say debt management works independantly from the customer complaints department therefore it does not matter to them that this account is in dispute.

 

I have been made redundant and have offered to pay back my overdraft in full at the end of December, they said fine but it is still on my credit history, I presume this is a default action. My husband has just gone crazy and Im getting to the point of defeat.

 

What advice can you give me?

On 22 Novemeber they are charging me a further £99.41 and a further £19.65 7 days after that. How can I get this back? will I have to do another claim?

 

Can they default me when my claim is in dispute and claim acknowledged?

DO I have to contact the court to get the default removed now or later?

Is there anything I should do immediately?

 

I have had a quick read of Johnny2bads and will read further today.

 

Any advice appreciated, I now write another 3 letters to Abbey.

Well I never thought they would get so damn dirty guts. But I refuse to give up. Its just that we will struggle if our credit rating is affected and surely its not right that they can do this at this stage.
