Ok thanks. But Im confused over taking Abbey to court over non compliance with DPA act, if I am to sue them what steps do I take for that and is there an amount Im sueing for? Or is that the amount Im estimating my claim to be?

Hi,

 

I sent off the DPA letter with my cheque for £10, they have cashed the cheque and the forty days were up yesterday, and nothing. Is it 40 days or 40 working days? If 40 days, dont know what to do now??

 

Its very reassuring to see other people actually getting their money back, but I feel like I have fallen at the first hurdle? Any suggestions greatly appriciated...

It's 40 days (including weekends). Move on to the next letter in the library. They have now failed the DPA. perfectly normal delaying tactics, but you must stick to YOUR timeframe. Do exaclty what you told them you would do, and on the days you said you would.

 

Also, report to Information Comissioner.

Abbey - 547.00 settled in full.

Second claim: £204 WON.

Barclaycard - 142.88 incl interest due WON BY DEFAULT as they didn't even bother entering a defence. Barclaycard paid up £184.88.

 

MBNA - Concluded £634.31

Capital One Concluded £148

Kinda disappointed I've no more banks to go after now...

IS THAT TRUE ?? A&L About to be taken over by ABBEY??

 

I am about to give Abbey crap over historic bank charges they EDIT off me - I was with them from when National & Provincial were a building society - so my account ended up with ABBEY through that - please tell me it's a joke - I don't want to be with ABBEY Again as a Bank - it's bad enough having my mortgage with them!! might look to move mortgage.

I am a bit worried now cause I am about to chase ABBEY - I'd moved my account to A&L when ABBEY were messing me around in 2004 - now it looks like I am gonna have same crap again? I was only with ABBEY cause of the N&P thing when they were bought out years back - now it's gonna happen to me again?

 

I will go stamp my feet in a corner somewhere - this isn't great news for me if it's true!! Need to find another account I reckon!! Anyone recommend a good bank? LOL :D

Hi guys

 

I have been on holiday and am awaiting this morning my redundancy notice!!

 

Amidst the chaos in my life I have managhed to post my LBA to the Abbey giving 14 days notice and a 7 day notice on non compliance of the DPA request for my statements.

 

SO........................ what do I do next?

 

On the non compliance with the DPA do I have to sue them now?

On the LBA after 14 days I give another 7 day warning then file a claim?

Im not sure whether to use the N1 or the online Moneyclaim?

 

Sorry not been responding to mail on here for a while Im feeling a little like giving up at the moment my life is in tatters.

Just wanted to re-iterate what karnevil says... Don't give up... I was made redundant 4 years ago, and, although it feels desperate at the time, when I look back now, I can honestly say it was the BEST thing that ever happened to me!

 

I'm sure things will look a lot brighter in a few months time.

Just waved goodbye to my twin daughters and 3 friends who are going to school to collect their GCSE results! Talk about hyteria!! ha ha.

 

I will look at filling in the N1 later today and have that prepared to post when my 14 days are up.

i was made redundant in 1999,i thought my world would collapse but some helpful words and advice from a good friend helped me to look forward and not back.it seems like the end of the world but i set myself up in business and went from strength to strength.it isn't the end,it's a new beginning.good luck

Well the 7 days is up on my Data Protection Act non compliance letter, heard nothing at all from the Abbey. What shall I do now? It was posted recorded delivery.

 

14 days is up on 05/09/06 on the Prelim letter asking for it back. I will then send the LBA and fill in the N1.

I didnt submit al my correspondence, only my schedule of charges.

 

I have heard of others submitting documents too, does it suggest sending copies of all documents with your N1 in the pack you have downloaded?

 

I didnt notice that in my book ill check when i get home.

thnaks for reply. did you hand deliver your N1 to court? did you have to make appointment? did you pay them on submission of your claim? do they then give you the claim number?

 

i have left this for a few weeks now and so I have totally lost the plot, I need to read agin all day to refresh myself on what I am doing. All I seem to be able to do today is look at my screen and panic!

Letter recieved from Antony Ricketts saying I should have recieved my 6 years statements by now and an offer of £300 as a gesture of goodwill!! Ha.

 

this was my reply

 

I am in receipt of your letter dated 27/09/06, outlining that you can not agree to refund all of my charges. However as a gesture of goodwill you will happily refund £300. On checking my account online I discovered that an amount of £280 had been refunded to my account. This appeared as 11 miscellaneous charge refunds dated 28/09/06.

I telephoned (the number 0845 600 6014 from your letter) at 9.50am Monday 02/10/06 and spoke to Kay.

I asked him to look at my account and explain what the refunds were. He advised me that this was the £300 refund offer made by yourself but it was £20 short. He then made a further refund of £20 to my account. This appears as a miscellaneous charge refund, dated 02/10/06. For this I am grateful but I advised him that I was unable to accept the £300 as a final offer and would be continuing with my N1 claim to reclaim the charges to my account over the last 6 years. I will therefore deduct the refund of £300 from my claim form.

I also advised Kay that I have not received my requested list of transactions and charges relating to my account since 01/01/00 – in short, a list of charges with dates and amounts – alternatively, a complete set of account statements for that period.This request was sent to you on 29/06/06 under the Data Protection Act with a cheque for £10, which was taken from my account 3 months ago.

Kay informed me that he was unable to give me the direct number for the department dealing with my request, but that he would investigate this for me and took my telephone number to return my call and inform me upon the date these statements will be sent to me.

I am aware that you have been willing and able to provide other customers with a print-out of transaction information covering this period – and am ready to bring this to the attention of the Information Commissioner should it prove necessary. I would also draw your attention to Smith v Lloyds TSB Bank plc (2005) EWHC 246 (Ch).

 

This letter has been sent by first class recorded track and trace, delivery, and therefore should have reached you by 04/10/06. Should there be any further attempts to delay compliance, I will be left with no alternative but to escalate this matter into an official complaint to the Information Commissioner and the FSA.

 

On and on this claim seems to be taking an eternity. :sad:

I have to do my N1 now I have been holding out for the statements but alas they have not appeared. I hope this reply looks Ok please advise me someone.

Hi All

 

well I finally got the claim to court.

It was deemed to be served on 29/10/06 which was my birthday, funny that!!

Anyway Abbey have until the 13th November to reply.

Another wait begins.

I still have not recieved my statements.

I was sent an 8 month period for 2003/2004 but nothing else!!

 

In the meantime I had this letter regarding my overdraft.

I did open a parachute account a couple of months ago,

so I do not need this Abbey account.

What advice would you give me here.

I really can not have anything affecting our credit history,

my husband will slaughter me.

I have no way of paying back this overdraft at the moment.

Hello All

 

HELP NEEDED again!!:mad:

Well the Abbey are really giving me the runaround.

 

My claim is in and and acknowledged by the Abbey, but they say I have provided NO DETAILS as to how my sum has been calculated!!:confused:

I have sent them and the courts my spreadsheet with all my charges listed and a separate estimated amount.

Amount is £1307.11 this includes estimate of £390.

I have still not received my statements although the Abbey say their records show I have been provided with them all!!:-x

 

I have an overdraft of £1500, I opened a parachute account and as from Sept 2006 my salary and all DD etc were transferred to my new account.

 

What is really upsetting me is that the Abbey are now saying I have an unauthorised overdraft and are continuing to charge me each month.

If it is not cleared within 3 months it will be handed over to debt collection agency.

 

I have sent emails and letters to explain this account is in dispute, BUT they say that I have already affected my credit rating. They say debt management works independantly from the customer complaints department therefore it does not matter to them that this account is in dispute.

 

I have been made redundant and have offered to pay back my overdraft in full at the end of December, they said fine but it is still on my credit history, I presume this is a default action. My husband has just gone crazy and Im getting to the point of defeat.

 

What advice can you give me?

On 22 Novemeber they are charging me a further £99.41 and a further £19.65 7 days after that. How can I get this back? will I have to do another claim?

 

Can they default me when my claim is in dispute and claim acknowledged?

DO I have to contact the court to get the default removed now or later?

Is there anything I should do immediately?

 

I have had a quick read of Johnny2bads and will read further today.

 

Any advice appreciated, I now write another 3 letters to Abbey.

Well I never thought they would get so damn dirty guts. But I refuse to give up. Its just that we will struggle if our credit rating is affected and surely its not right that they can do this at this stage.
