    • Documents arrived today dated 27th March.  This is a cc taken out a long time ago (2008) and they don't seem to have been able to provide a copy of a CCA agreement, just reams of print outs of lines of texts from old bank statements, default notices etc.   
    • Documents finally arrived today from PRA group.  New day have sent me lots of paperwork, copies of default letters and statements, print out of what looks like a CCA that would have been completed on online, IP address as signature.  This debt is not too old, so possible this is the true copy of agreement ?  Not sure what my defence would be beyond irresponsible lending. 
    • pers i wouldn't.. all you need to know is in the posts of that thread....that being section 127(3) of the CCA refers. if under a CCA return, the 'creditor' claims its a recon, it must not contain any details like a sig, tickbox, or typed name (whether you signed physically or by online tickbox) 1. those are not necessary in a recon, so why inc them? (faked??) 2, it cant thus be a recon!!, it must be a copy of the 'original' from the original creditor, not from a debt buyers filing cabinet. they shouldn't not be 'mixing' some original docs from the OC with crap from their filing cabinet, claiming its ALL a recon! because some of it is faked. just remember there are far more docs like NOA and a DN that are as equally important to a court claim of 'this debt is enforceable'. never rely solely upon the dodgy agreement argument.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hiya Everyone,

 

Im in the process of claming £4000 from Lloyds, and iv got a feeling this is going to be a real stuggle as they seem to be on of the banks that fight all the way!

 

Iv sent my first letter and got a reply yesterday stating that they were investigating the matter which could take between 4 - 8 weeks. Their obviously trying to fob me and off and hope i get sick so stuff that for a laugh. Im going to send of my 2nd letter (LBA) unless any of uz advise me to wait???

 

Also, iv heard a few claims that they have been putting £750 in to people's banks without them agreeing to this and stating that this is their final offer! I would not be best pleased with this and wouldnt want this to happen.

 

Do you think i should add on to my LBA that i do not wish this to happen because i will not except this offer??? Anyone got any advise if this has happend to them??

Hi Amy

Give them the 2 weeks from your Prelim letter then send your LBA.

If they did offer you the £750, all you would do is send one of the rejection letters then carry on with your claim, it causes no problems at all with your claim.

Thanks for getting back to me. I didnt add any interest on when i did my first summary. Do i need to ass interest onto the total when i send this off or is this all done when you file the claim?

Thanks for all this. Ok the 8% interest i dont add on until i have to file a claim. Do i have to add on any other interest when doing my summary of charges? I didnt when i sent the first letter? Will this matter, have i totally messed this up. The way i thought of it was i requested the money and then when i had to file for the coursts blah blah i had to add the interest 8%! Is this correct?

Hello again everyone!

 

Im going to send off my LBA, and im thinking about setting up another bank account incase they cancel my acount or something. Should i change my bank details with work so from now on my pay goes in my new account? This would mean that i am leaving my account with no money in meaning that i would be constantly over drawn. Is this the way i should do this, or should i just keep the spare acount there until i can clear my ovedraft with the money i shall hopefully claim?

It's up to you, you should open another account just in case they decide to close your Lloyds one.

Hiya everyone,

 

I have just received a letter for Lloyds after sending my letter before action claiming their apologies, and how they are open about there charges and i could contact them if i was having problems etc, and the following passage - ''The office of fair tradings has publisjed new guidelines on credit card default charges. We're stil talking it through with them, but the inportant point is that the guidlines are about default charges that people pay when they break an agreement with us. This desnt apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you havent broken your agreement. They are our prices for the service we provide in these situation''

 

This cant be right, they must be trying to fob be off. Im getting these charges for exceeding my overdraft limit which they should never have let me do in the first place etc, which is what this is all about.

 

So iv got to start my court claim and im really scared and unsure about what to do with all this. Can someone help and give me some advice of what i had to do first, and back me up with the fact that they are fobbing me off?

How much is your claim for and how much interest, are you claiming contractual interest or charges pre 6 years?

Hey Amy,

 

I take it you've sent your prelim and your LBA already and either had no response or some silly standard letter.

If this is the case you need to proceed with court action either by filling in an N1 or a MCOL, which ever you are more comfortable with.

Then just more waiting i'm afraid LOL its a game of patience but it pays off in the end

Yeah you'll get a letter from the court that you file with, telling you the date that the papers were deemed served, and then lloyds will have 14 days to acknowledge and a further 14 days to file a defence.

They were pretty quick in my case :)but be prepared to wait the full 28 days if not more as others have :mad:

 

Once lloyds have filed defence you will get AQ to fill in, then more waiting.

Hiya,Im really stuck filling in this N1 form. At the top in a box it has IN THE and then it goes on to the claimant bit etc, what do i put on the IN THE bit? Also if i dont have to pay due my partner getting family alowance etc, do i need to write that somewhere or will the court pick up on that since i wont be sending a payment??/Thanks everyone, your all so useful!!Amy

Total (ok with this)

 

Then it says...

 

Plus interest pursuant to S.39 Country courts act 1984 from date of issue to date of judgement/settlement at £xx.xx per day (enter daily rate here - (charges + OD interest)x0.00022 = pence per day) or at sich rate and for such periods as the court deems just.

 

Havent got a clue what to do there.

 

Please please help, im so confused by all this!!

Plus interest pursuant to S.39 Country courts act 1984 from date of issue to date of judgement/settlement at £xx.xx per day (enter daily rate here - (charges + OD interest)x0.00022 = pence per day) or at sich rate and for such periods as the court deems just. - Your daily rate of interest, worked out by calculating your total charges by 0.00022 eg, If your total bank charges were £2369 you would multiply this by 0.00022 giving a daily interest rate of £0.52 (52p) a day.

This is the interest that the bank charged you and can be quite complicated to work out since you can only claim back that portion of the interest that relates to the charge. It quite often doenst amount to much so lots of people dont/didnt bother with it. If you havent included it in any of your previous letters to Lloyds then you shouldnt really claim it now without first sending an amended LBA to lloyds. Can i ask how much is your claim for?as this will help in determining whether it is worth the bother in going after this type of interest

Hiya Everyone! Hope your all doing well with your claims.

 

I filed my N1 form on the 20th April, and i havent heard anything back about whats happening yet? What do i do next? Im so confused, do i leave it til 14 working days and then send a letter to the court, if so saying what, or is this normal?
