Hi All, after reading this forum for the last few months I finally decided to bite the bullet and sent off a £20 cheque to the Halifax for bank statements relating to 2 accounts for the last 6 years. On the same day I also sent off a £10 note for my friend who has an account with the Halifax. We both received the same letter on the 12/03/07 stating that our bank statements would be with us in 14 days. Although I appreciate the 14 days aren't up until 26/03/07 my friend received hers some 2 days after and I haven't got anything. As my claim is going to be alot higher then my friend do you think the bank are purposefully making me wait? I believe the next stage is for us to highlight all charges from the bank and request the full amount back. Does anyone have a quicklink to the next template we will require for this. This would be mostly appreciated. Watch this space for the next stage. (I dont know if it makes any difference but both my accounts are still active with the Halifax) ooh and overdrawn!!!

Thanks for that Change It. I have just had a thought. When I get my statements I am due some charges at the end of this month as well. Should I wait for my March statements before totalling up whats owed to me or should I just go off the letters that will soon be arriving prewarning me I will be charged at the end of the month? My friend totalled hers up to £1667 so I am getting quite excited to how much mine will be. Whats the chance of them settling in full without going to court or offering a lot less?

Get started on your spread sheets. And get the prelim sent off.

 

You can add on charges up until you file at court.

A lot of people have been phoning after they sent their lba and haggle to get full settlement.

So it might be worth a try.

 

But what ever happens, you will get your money back.

Well the Halifax 40 days is up on Monday 26th. As of yet I have still not received my statements yet they cashed my cheque approx a month ago. Do you think when I ring on Monday I will be questioned as to why I want my statements from the bank? How long should I give them from Monday to send me my statements when they already have not stuck to their side of the bargain by promising me the statements by Monday 26th. Will I ever get them because without them I cant claim for anything!!!:o Any comments would be gratefully appreciated.

When the 40 days are up and you still havnt recieved them you send this letter.

Well today is the Halifax 40th day and not a thing throught the post. I went onto the telephone contact numbers from one of the threads and after been given a 3rd number to ring feel like I am obviously being passed from pillar to post. I am now writing my DPA non compliance letter which will be getting sent off tomorrow. I am so determined now its unreal!!! Watch this space and see if I ever get my statements.:(

Please help anyone. I am so peed of it is unreal. I first wrote to the Halifax on 30th January with SAR. After more then the given 40 days I received letter on 12th March saying my statements were ready and giving me a contact number if I had not received them within 21 days. Surprise surprise I have not received the letters and since the 3rd April I have been ring the suppled number to continually get the same answer phone message saying my statements will be with me in a couple of days. The thing is until I get my statements I have no idea how mch to claim therefore I am absolutely stuck. No statements, no total, no claim. Can anyone help me. The Halifax are just not responding to anything :-(

:confused: I sent my Pre Lim request off claiming £5354 from the Halifax last week. Today I have received a letter from them saying they have investigated my complaint and are sorry to say the charges were all justified. My claims are for charges relating to unpaid DD's, cheques and charges for going overdrawn (over overdraft due to them taking charges!!!). Can anyone tell me if this is just another tactic to put me off or do I not have a leg to stand on? I am willing to go all the way with this if I am in the right to. Thank you in advance for your help :)

Please can anyone help me. Halifax have now had their final 14 days after I sent them a letter stating I had not had a satisfactory response and required £5354 (£489 + £4865 for two accounts). I have just come off the phone with them and they state they still believe the charges to be lawful and standby their decision. I am now at the stage I need to be filing at court. Do I just go to Hull County Court and request a small claims form? How much is it going to be? Any help or advice from people who have been through this stage would be greatly appreciated. I am not gonna let this go and the B&st*rds can pay up!!!! Thank you all in advance

I started with DPA requesting statements, then sent failure to comply to DPA letter as it took them from Jan to May before I got them! After finally receiving list of charges I then sent letter requesting total £5354 on 07th June which the reply was charges lawful, sorry cant help. I then sent on 19th June letter stating response not satisfactory giving them another 14 days to pay up. Not heard anything since and their 14 days up so rang them today. They still state charges lawful and would take them 8 weeks to investigate which is where I am now. Thinking claiming at court is next?

With my total claim being for £5354 do I have to file twice as separate cases? If so do I have to wait for pay out on 1 first before starting next one?

There are N1 forms in the templates section for you to download, complete and print off to either hand in or send to your local court.

 

Alternatively you can go through Money Claim On-line (mcol).

Thank you so much. I have just had a look at the N1 form. Only other thing confusing me is the 8% interest. Some people I have spoken to have said its 8% of your full claim and others have said its 8% based on daily rates. I have no idea how to work it out if this is the case.

What you need is a spreadsheet!

 

Try in the templates library again. Follow instructions, ie download and fill in your charges, dates etc, and the spreadsheet will calculate your interest for you.

 

Any difficulties, give a shout, or check out the spreadsheets thread in the general section.
