This Has Been Ongoing For 2 Years After I Closed My Accounts Due To The Ineficiency Of The Manager In Completing A Simple Request For A Cash Sum Withdrawal /cancelled Accounts With Imediate Effect Received Bankers Drafts Cheques For The Outstanding Amounts With Acrued Interest.after A Short Period Of Time Received An Unautherised Overdraft For A Sum Of £6,257.86 Which Was A Shock As We Cancelled All Accounts Apparently A Cheque That We Paid In Bounced! But When The Cheque Was Paid In We Specially Requested Clearance As This Was What I Call An Unknown Source As I Needed To Draw From This Amount.i Refused To Pay As I Stated That My Account Was Closed /it Is Now In The Hands Of A Colection Agency The Agencies Seem To Change After A Period Of Time.

 

I Have Written To The Agency Claiming That This Supposed Debt Is Unlawfull And I Do Not Accept There Claim/and Furthrmore Are They Acting On Behalf Of Someone Or Have They Purchased The So Called Debt.

 

Further Advice Would Be Appreciated

We had a similar problem. We wrote to the original company (in your case Halifax?) and said we wouldn't deal with any DCA's and copied them in on the letter.

 

Have a look at the General Knowledge board and the General Consumer Issues board, they've got loads of threads over there that will be helpful to you.

thanks for the advice but i do not seem to be getting any further its been in the hands of three different collection agencies.

 

I am just applying for details of their so called claim the difference is this time i have got their money(well they cleared the cheque and stated it was all correct and nothing outstanding when i cancelled the accounts I got the full amount I believe i have got a case under the unfair contracts and the requirement of good faith(i.e cheque clearance)

 

but i could do with some further advice

I have today received a returned letter together with p/o for £1. stating from the collection agency that they have returned my letter as they have passed my letter back to the creditor I wrote back together with a copy letter stating that they had an obligation under section (3) of the Credit consumer act 1974

to fullfill my request or i would enforce the non complience of this act to the relevent authorities.(lets see what happens now)
