I received an Allocation Questionnaire for the financial claim which is an N150 form.

Gonna fill it out tonight then hand it in tomorrow, i think.

My AQ has to be in by the 4th Sept. Have to wait til 1st Sept when i get paid or just withdraw money from my shABBEY overdraft (now thats cheeky) as its gonna cost £100. Ho-hum.

Thanks for the moral support Iknox, we all have to be extremely stubborn to follow this through, especially with shABBEY.

Correct me if I am wrong but doesnt WITHOUT PREJUDICE mean that your offer of settlement prior to court is now not admisable to the judge?

 

Apologies if this is incorrect but i would have thought you would want the Judge to see that you made an offer to settle out of court?

In the small claims pack it says that no correspondence can be shown to the District Judge if it is an offer to settle and is 'without prejudice'. It goes on to say that if you cannot reach a compramise, also put this in writing. This will show your good faith in attempting to settle rather than going to court. Some Judges appreciate this effort.

Hi, i am new to all this so a little confused!! I have started a claim with the Abbey to claim back my bank charges. I recieved a letter back from them with statements from the last two years and then the rest were on micromeche which i didn't really understand? What do i do now? I realise i need to write down all the charges but is there a template for me too take this one step further as i am crap at writing letters!! Not sure where to turn. PLEASE HELP

It would be best if you start your own thread, then we can follow your story and offer help when you need it. Otherwise you might find that your questions get buried.

What stage are you at? Have you sent your SAR letter ? With the £10 fee?

Don't worry about writing letters, you will find all the letters ready prepared in the library. Yes, you will need to fill in a spreadsheet (also available in the library), but make sure you are clear what you are doing before you start - and presumably, if you don't have all your statements yet you aren't quite at this stage.

So, begin a thread, post questions there and people will help. In the meantime, have a read through some threads and the faqs. It's all time well spent. Good luck! x

Found myself in similar situation, charges amount to over £9,000 and that is without interest! My plan is to go for the whole amount unless anyone can suggest a better route?

Its a good idea to start your own thread before we hijack this one, but at 9K plus interest you may find yourself in multi track.

 

do you remember the film ghost busters? If you do multi track is like crossing the photon streams, really really really bad!!

Small claims typically no or very limited costs

Fast track costs generally restricted to a max of 750

Multi track unlimited costs i believe

 

So if you end up in multi track and loose then everything is up for grabs, house, car whatever.

 

If you go multi track then you need to be very confident of winning or have some kind of insurance for covering the potential costs.

Fast track is claims 5 - 15K however, if you claim contractual interest on charges of 9K then its quite feasible to end up with more than 15K worth of claim.

 

Depends on the age of the charges and the interest claimed of course.
