    • Out of time statutory declaration is just stating reasons for wanting the clock to be wound back to when Transport for London first sent out letter demanding the PCN be paid.   Reason: vehicle Registration xxxxxxxxxx was a company vehicle registered to xxxxx ltd company and the vehicle was used by x number of employees of this company. The company was dissolved on xx date and the vehicle was sold on xx date. My name xxxxxxxx was noted as a contact name on the V5 registration document, but I have never received any correspondence from Transport for London and I was not aware of any PCN being issued at the time of any contravention. The first time I was made aware of the PCN was on xxxxx date, when an Enforcement Officer from Marstons visited my private address.   Not an expert in this and hopefully Bailiff Advice or others will be around at some point to confirm whether this would be correct or not.    
    • I recently upgraded my 3 Contract to a new phone which developed a problem. I contacted 3 and was initially told to speak to the manufacturer. They advised that as I was in the 30 day period of Consumer Rights Act 2015 to request a replacement that I go to the store to arrange this as it would offer a faster resolution. I agreed with this course of action and went to the store on day 29. Leaving it late admittedly due to health issues.   When I arrived at the store the Assistant Manager then gave just about every excuse under the sun about being able to help but because the policy was 28 days not 30 they could not help me. I countered this with CRA 2015 being 30 days and they refused to accept this so I asked for the policy in writing. We both looked on the 3 store website but embarrassingly enough for them it didn't state anything about faulty goods. The actual wording in the contract that I signed says "Refer to three.co.uk/returns" for the Full Policy which doesn't explain anything about replacement faulty goods. I know why... Because it's the legal requirement of 30 days... Store Manager being adamant the period for returns was 28 days refused to back down so I asked him to look up CRA 2015 which they declined saying "It's not my job to know the law" ... Of course if you're selling goods and services and are a manager you should be versed in CRA 2015.   Realising they weren't getting me to fold my argument they requested a colleague get a copy of the policy from the back room. When they returned it was very clear the document they were about to show me was the signed contract of another customer. Consequently I called this out and said "Don't show me that, that's someone else's personal data" which they seemed to take offence at and said I was just trying to give them a hard time. They went on to justify saying that what they were trying to show me had no personal data despite initials and a signature being clearly visible. I again instructed they take the document away from me. The wording was so small that the only way for me to read it would be to have actually taken the document to look at it. The ultimate irony is that policy in this other customers document would be irrelevant because that's not the document I signed.   Realising I was getting palmed off and probably being labeled as toxic I decided to leave, but not before writing his name down and sending off a blunt tweet to 3...   Needless to say I'm not too impressed, £16.55 out of pocket for a train ticket, probably going to need to return to the store again and having to put up with a broken phone either for 2 weeks (If manufacturer deal with this) or having to fight an outside 30 day period.   Tweet Sent... But not sure how I should approach that GDPR issue... So desperate to prove a point the manager didn't have he throws all regards to another customers data out the window?   When does my bad luck ever end...

    • ok I will fill in the out of time statutory declaration.  My understanding is that the clock gets reset to when the PCN was originally issued?  If so then what do I do then as the company lo longer exists, I don't know who was driving the van on the day of the PCN so not much help 
    • That is a definite possibility, that OOT is a good idea, if accepted it will reset the debt to the original sum to pay or dispute and remove the bailiff fees.

    • This is a bit of a lengthy one but I’ll summerise best as possible.
       
      THIS IS HOW THE PHONECALL WENT 
       
      I was contacted by future comms by phone, they stated that they could beat any phone contract I have , (I am a limited company but just myself that needs a business phone and I am the only worker) 
      I told future comms my deal, £110 per month with a phone and a virtual landline, they confirmed that they could beat that, £90 per month with a phone , virtual landline  they also confirmed they would pay Vodafone (previous provider) the termination fee. As I am in business, naturally I was open to making a deal. So we proceeded. 
      Future comms then revealed that the contract would be with PLAN.COM and the airtime would be provided by 02, I instantly told them that this would break the deal as I have poor 02 signal in the house where I live as my partner is on 02 and constantly complaining about bad signal
      the salesman assured me he would send a signal booster box out with the phone so I would have perfect signal.
      so far so good.....
      i then explained this is the only mobile phone I use for business and pleasure, so therefore I didn’t want any disconnection time in the slightest between the switchover from Vodafone to 02
      the salesman then confirmed that the existing phone would only be disconnected once the new phone was switched on.

    • The FSA has announced large fines against DB UK Bank Limited (trading as DB Mortgages) - DeutscheBank and also against Redstone for their unfair treatment of their customers.
      Please see the links below for summaries and full details from the FSA website.
      It is now completely clear that any arrears charges which exceed actual administrative costs are unfair and therefore unlawful.
      Furthemore, irresponsible lending practices are also unfair and unlawful.
      Additionally there are other unfair practices including unarranged counsellor visits - even if they have been attempted.
      You are entitled to refuse counsellor visits and not incur any charges.
      Any charges for counsellor visits must not seek to make profits. The cost of the visits must be passed on to you at cost price.
      We are hearing stories of people being charged for counsellor visits for which there is no evidence that they were even attempted.
      It is clear that some mortgage lenders are trying to cheat you out of your money.
      You should ascertain how much has been taken from you and claim it back. The chances of winning are better than 90%. It is highly likely that the lender will attempt to avoid court action and offer you back your money.
      However, you should ensure that you receive a proper rate of interest and this means that you should be seeking at least restitutionary damages - which would be much higher than the statutory 8%.
      Furthermore, you should assess whether the paying of demands for unlawful excessive charges has also out you further into arrears and if this has caused you further penalties in terms of extra interest or any other prejudice. This should be claimed as well.
      If excessive unlawful charges have resulted in your credit file being affected, then you should take this into account also when working out exactly what you want by way of remedy from the lender.
      You should consult others on these forums when considering any offer.
      You must not make any complaint through the Ombudsman. your time will be wasted, you will wait up to 2 yrs and there will be a minimal 8% award of interest and no account will be taken of any other damage you have suffered.
      You must make your complaint through the County Court for a rapid and effective remedy.

Me and my husband are in a bit of a pickle. I'm really really embarresed to admit this but i need to stop burying my head in the sand and i need some advise on where to turn. Over the last few years me and my husband have spiralled into bad debt. Its not that we dont want to pay off our debts its just there never seems to be enough money to go around. It started where we would miss a payment on one thing to pay another and then the next month we would miss another couple of payments to pay the bill we missed the month before.

Then my husband was made redundant it got to the point were we couldn't make any payments at all. We have two small children which take up more money than we earn between us. People (my mum) keep trying to give us advice but it doesn't help all the say i sbudget better etc etc. Admittedly we are useless with money and our debts are now at about £17 - 18000. Its getting to the point where i wont answer my phone I dont want to face the post and at times i just dont want to carry on. I never new having fun in my teens would leave me in this much of a mess.

We did go to the citezens advice beureu who advised us to make tokan payments of a pound a month. for various creditors half of them declined our offer we payed like we should of done for the first few months then all contact stopped.

So now where back at square one, If we do an IVA we are going to struggle to make ends meet but maybe it will be worth it. and someone suggested bankruptcy, We rent our home and dont have a car and our possesions probably wouldn't add up to much. We have looked at the consequences at both but we dont know anyone thats been through either and dont know what the effects are later on.

 

I'm getting to the point were i've just had enough. One day i would like a mortgage but would never have another loan or credit card or anything everagain. Its made the last 3 years hell.

 

 

Anyone got any advice. I just feel so stupid and niave for getting into this mess and at the moment i just cant see an end to it. Has anyone got any advice??

Thank you so much! I am at work at the moment but will go to my parents tonight and make a start. Worried because we havent heard from some of the people who we owe money too for an awful long time so I dont know what situation we are in with them. Will i need a list of all the people and the amounts i owe when i fill in the online forms tonight?Plus do me and my husband need to do this seperatley or can we do it as a couple?

First of all, you should understand that the feelings you describe are both understandable and normal. I could probably add a few more to the list: hopelessness, helplessness and perhaps some anger, too. They're all part of a normal emotional response to the situation you are in.

 

From what you say, it's clear that you are a 'can't pay' rather than a 'won't pay'; there's no need to feel embarrassed about it. There's no shame in asking for help, and in doing so you've probably already jumped the hardest hurdle.

 

What you need to do now is take back control, and you may need some help with this. Get in touch with one of the free debt advice services such as Consumer Credit Counselling Services or Payplan. If you go to the Citizen's Advice Bureau make sure you speak to one of their specialist Debt Advisors. Avoid fee-paying debt management companies like the plague.

 

CCCS and PP will both go through an income and expenditure form with you, and work out what you can realistically afford to repay your creditors, even if it's a tiny amount. They will then negotiate with the creditors on your behalf (creditors and debt collectors are obliged to deal with them), and help with any problems on the way. This is known as Debt Management Plan (DMP). Both organisations are very busy, so it may take a while to start things off. In the meantime, you can write to your creditors telling them that you are taking advice, and making a token payment.

 

DMPs aren't legally binding, so a determined creditor could still go to court, for example, but it's unlikely, since the court will look favourably upon your efforts to resolve matters, and in any case won't order you to pay more than you can afford.

 

IVAs are only suitable for a very few people. Bankruptcy is also sometimes an option, but you would need to find the court fees!

 

Of course, all of this supposes that your creditors have all the proper paperwork, and haven't added unlawful charges and so - CAG can help with this.

 

Remember, there are lots of people her on CAG who can answer questions and support you. Things may seem dark at the moment, but they will improve, and you needn't face them alone.

If you've got up to date figures of the creditors you owe it will ensure that the advise is best based on your circumstances. You always have the ability to change any information at a later date if needs be. Obviously if you have a couple of creditors which you've not spoke to for a while you can just put in the last amount you were aware of owing.

 

It's completly up to you whether you would prefer to complete as an individual or as a couple, and it's a really easy system to use. If you have any problems whilst doing it there is a number you can call and one of our counsellors can answer any of your questions.

Hi Hannahsmygirl. I have only been part of this site for a couple of months, but it has helped so much. Nearly everyone you come across will have a similiar story and have gone through or are still going through all the emotions you have described.

 

Don't be ashamed, we all make mistakes, the important thing is that we learn from them. Keep updating your post and take time to read the other threads - it's amazing how much you learn. Using this site will make you feel supported and even empowered, as you realise no matter how much debt you have, you still have rights.

Still feeling a little embarresed and worried about speaking to someone. Its hard admiting I have made a mess of things. Looks like we may be heading the right direction though!!! Hopefull this is the start of better things. I can't believe i have buried my head in the sand for so long. I hate the fact that our money problems are putting astrain on our marriage and making life so miserable. Its nice to have it out in the open thoughand its nice to talk to people who aren't Judging and have been werewe are now!

Also, when (if) you do have to speak to a creditor you can quote them your CCCS reference number, it does make it a little easier, though it's best generally to insist on communication in writing only.

Well I have spoken to cccs and its official we are skint!!!! Ok now i need some more advice. They say we arepaying out 948pounds a month more than we have coming in. This doesn't include most of our debts. Inever realised things were this bad!!! Its difficult to see it all written down. Only problem isthey have said come back to us when you have sorted out our priorty debts. This is all well and good but even when they are all payed we still have no money to pay what we owe. So whats the next step??? Does this mean bankruptcy?I have taken a small look into bankruptcy and to me it seems like "the end" whats life like after bankruptcy now i feel more lost than ever? CCCS were great though most of thier advise was good sort of feel a little lost though now!!!

The reason we suggest we suggest you need to look at sorting priority debts is because they are likely to have the biggest affect on your life. Once your in a situation where you have enough money to cover your living costs, then we can certainly look at your long term options with the creditors. Bankruptcy could be one of the options at a later date but is not possible until you have enough money to cover living costs as a judge would consider yourself to be in a situation where you need credit to survive and would advise you to be able to cover these before going bankrupt

 

I cannot give you specific advise regarding your appointment as is it would be breaking Data Protection Act, but you can always call us as many times as needed to ask questions or discuss the advice.

Hi Matthew.

 

Your a star for helping. We are getting there with our priorty debts it has taken a while. we have managed to clear over a thousan on council taxbills in thelast 6 months. To be fair i dont know how things have got sobad or even howwe get through the month. But we haven't actuall used any credit in the last year we dont have an overdraft well on any bank accounts we are using. We dont use our credit cards. I guess we just spend less on shopping clothes etc than we used to!

Hi Hannah,

I know exactly where you're coming from it feels so hopeless that sometimes you don't want to go on. I can't even be bothered working out how much I allegedly owe! I think it's well over £20K although several of that are illegal charges added by the companies - one debt inflated from £2500 to over £4000 by charges etc. even whilst in dispute!

 

Hang on in there. As rightly stated - priority debts are known as that for a reason, they are your priority and are usually connected with living costs - home, utilities etc.

 

Everything else is not as important.

 

Obviously without knowing the extent of your circumstances I can't give very specific advice but sort out the priority debts, try to make arrangements or do whatever you can to stabilise the situation with them.

 

Then look at secondary debts - list them and see what you think. Remember they can't put you in jail for civil debts, they can't hurt you no matter how pathetic their letters are - you should see some of the rubbish I've been sent in the past. If you and your husband are strong you will get through this. Remember what is important is that you are together and you fight it together.

 

Anyway, secondary debts. First step is look at some of the other posts - re: credit cards, loans etc and cca requests.

 

If you have debts of this type, send one of the cca request letters to them and make them sweat for a change. In short if they don't have an enforceable agreement with you then they can sing for the money. If you do this post a thread on here so that people can help you because it's not always easy / straightforward.

 

I personally intend fighting every last one of mine to the bitter end because from the first point they have all acted in the most disrespectful ways both to me and the law and therefore they deserve no quarter.

 

My problems also started in a similar way to yours, miss one payment and the charges affected the next months payments, which in turn affected other payments because our budgets were so tight. Requests for help were met with complete disdain, in fact it seemed to spur some of them on to greater acts of depravity - one even increased their interest rate as well as adding charges to my account.

 

Since I sent out the cca requests most have become a little bit more discussive apart from one who is trying to bluff it out (there's always one).

 

Anyway, I wish you well and if you keep viewing these boards you'll see all my debts appearing over the next few weeks and progress against them. You are not alone and we will all try to help. My motto is 'free of debt by christmas'

Yes 1st thing you should do is send out the cca requests under section 78 for a true copy of your executed agreement to all creditcard, home shopping companies etc. It should provide you with some breathing space because if they default on you request after 12 working days you can legally stop paying them and they can;t add interest or enforce the debt. If you look at a lot of the threads on here i;e Consumer Credit Act Agreements you will see a lot of these companies don't comply within the time scales and quite often don't have enforceable agreements.

Hi Diskman

I believe that because the debt was officially in dispute the charges were applied illegally. If the account had not been in dispute you could argue that the charges were unlawful although that would be one interpretation of the way that the particular law is written. Let's face it, all of the companies I've approached asking for refunds of charges have claimed that they are lawfully applied and fair and thought that I was wasting my time even bringing the request up. Strangely enough "although, as a gesture of goodwill we will...." came up regularly!

 

However:

The important point here that I was trying to make is that there are others in similar situations and the general gist was that if hannah looks at some of the threads that relate to some of her debts then there is plenty of information to go at.

 

Like Josie says, the cca requests give you at least a little breathing space whilst you take stock of the situation and improves your bargaining position if that is the route you want to take. Again, every situation is different.

 

Also if hannah were to post individual scenarios then there are more than enough people here who have the technical knowhow / specialist knowledge to help her.

 

Finally, there are also plenty of people here to offer moral support or a shoulder to cry on etc. if the need arises. Thankfully, I am way past the suicidal thoughts (I ended up off work with stress because of the constant calls, threatening letters etc and general stress of the situation) and will not let them get me down again.

 

One important piece of advice is when you write to them make sure you state that you will only communicate in writing. If they ignore this make a note of all the calls, get your phone number changed and use this as evidence against them. I changed my number and it was like heaven here!

You guys are great! Wish i had heard about this site sooner. Friends and family haven't been much help cos none of them have been in this situation and often although they think there advise is helpful it usuall isn't. Im still finding my way around here and have found the support so far overwhelming its lovely to get advise from people who care and have some experience of what we are going through. There have been times when i felt like i didn't want to carry on but i am now beginning to see some light at the end of the tunnel although i will probably need lots of help over the next few weeks. Over the weekend i am going to get all of my paper work in order and hopefully some of you will be there to guide me through fighting off the bad guys. To be fair though alot of this has been our fault due to our bad money management but the oan and credit card companies are happy to throw money at you to get you out of a sticky situation BUT they are not happy to help when you start struggling.!! Has anyone had any dealings with a debt agency called RMA? This is where my barclay card debt has been passed to. They ring numerous times of day/ When ever they send me a letter they send two copies for some bizarre reason. Is this just in case i didnt understand there first threat to take me to court. To be honest i try not to answer the phone to them anymore. I agreed to pay them £40 a month which i really cant afford. I originally offered £10 (its a tiny amount i know but things have been really tight lately) But they badgered and badgered saying it would cost £40 a month at least to keep it out of court?

 

Anyway thats my rant of the morning out of the way!!

 

Hopefully once i've gone through all the relevant paperwork i may need you all to guide me through what seems like a scary old process.

OK, can i ask a few basic questions...

 

Is your current income greater or less than your expenditure before ANY debts are paid?

 

Are you on bebefits? Have you checked out what your are entitledto in terms of benefits?

 

If you were not to pay your secondary debts, would you be able to pay your priority debts?

 

Are you a mortgage holder?

 

Do these debts have any unlawful charges applied to them?

 

OK, I would suggest that you go to moneysavingexpert.com and have a look on the forums there. They have some very helpful advice in terms of cutting expenditure and increasing income.

 

If you have recently paid or acknowledged the debts in writing I would suggest that you write to each non-priority creditor with this letter http://www.nationaldebtline.co.uk/england_wales/temp/8831_49701.pdf after you've done the Statement of Affairs.

Been there and done that, and now finally beginning to come out the other side, so it does happen.

Best bit of advice I ever had, apart from all the stuff on here which has already probably halved how much I owe, was to make out a very careful budget, even allowing for the cost of toothpaste, and stick to it. It's hard to start with, especially when the kids ask for things, but it gets easier and one day you'll suddenly realise that you've actually ended the month with money in the bank! After all the years of misery, that moment makes all your effort worthwhile.
