    • Correct but wont stop them chasing you though even if no payment for  6 years (statute Barred) Some DCA s buy debts (the debt is assigned to them) and some do issue court claims ...just so you are aware.   Andy
    • Thats because this claim has not been allocated as yet hence the above hearing *Case Management " to determine the directions (N157 Notice of allocation) which will follow after this hearing. You are not requested to submit a statement but have all the details with you (claim form defence CPR CCA etc etc)   Andy
    • Our price is the same all day, but varies day to day. Yes there's a risk of high prices but it has never gone above SVR any time since I signed up. Last 30 days average 17.67p/kWh, max 20.67 and lowest was 11.83.  It saved just under £300 during 2023.  
    • It you had E7 in the past but have converted to single rate then the meter will still hold the last recorded Night readings. This introduces scope for error when manually reading. If the meter has only ever been used on single rate then there's only one figure that can be taken. For example ours shows "Rate 1" reading and a "Total import" reading, but they both give the sme figure. If it has ever been on E7 the total will be higher, including the retained night reading.
    • okay, perfect and thank you so much for the help once again. so firstly i am going to initiate the breathing space, during this time it's likely ill receive a default. when i receive the default are you aware of how long it will take for me to know whether the OC have sold it off to DCAs? Once it's with the DCAs i do not need to worry as they cannot issue a CCJ only the OCs can Even if i decide to come an arrangement with the DCAs no point as the default will remain for 6 years paid or not paid I should only consider repayment if the OC still won the debt and then issue a CCJ? Just to confirm the default will not be seen after 6 years? No one can tell I had one then after 6 years ill be all good?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I recently received a letter from Lloyds TSB solicitors saying that they would settle the claim by depositing the money in to my account within five working days. However that letter was dated 20th June 2007 and I am still waiting for the money to go in to my account. I have telephoned the solicitors several times and keep getting told we'll get back to you, which they never do. What should I do now??

Write to the Courts informing them as to what is happening. Send a copy to Lloyds TSB solicitors. It depends on the judgement though how long they were given to pay.

If it was for more than £750 I would be tempted to send them a statutory demand. But I'm just evil.

Thanks for the advice I've been in touch with the bank and they said the money will be paid in to my account in the next few days. The amount was 1,850 so I'm pretty keen to get my hands on it. Isn't it funny though if they wanted money off you they would take it straight away. Oh well my account should look a lot better soon.

They've messed me around since 1st June - I am going for warrant of execution and a writ of FF. They are not at all helpful and don't do anything they say they are going to do, especially on time.

Perhaps if you informed them that you were entitled to charge compound interest at the rate of 8% that would speed them up. It may only be a few pence but it would upset them

Just to let anyone know who is still chasing after charges I WON!!! LloydsTSB payed 1850 in to my account. Good luck to everyone who is still trying to retrieve these unfair charges.

We're in the same situation - won in court but Lloyds haven't paid up, despite promising the money would be in our account yesterday. They've even dared us to send in the bailiffs, and us customers for 30 years!

 

They should've paid by 12th July - but they've tried all manner of dirty tricks.

 

They asked for a set aside because they didn't have the original claim form (even though we used MCOL and they defended!). Then we had to get an amended judgement order because of a typing mistake on the original.

 

Even the judge's office and our local branch manager have had no luck with [problem], so we would be very grateful to know how you managed to get your money!

Hi,

 

Yes [problem] said go ahead with bailiffs/press - which alarmed our bank manager - but then agreed to pay electronically last Friday (no such luck!). The judge has told them to withdraw their set aside application - (explained in last post) and pay £2000+.

 

I have started my own thread WHAT CAN WE DO NOW? as you suggest. Sorry you had the same treatment -- what did you do?

I eventually recieved my money by sending a letter of complaint to LloydsTsb, one to the ombudsman, one to the court and also a copy to the banks solicitors. The letters all included a copy of the letter that I received off their solicitors promising to pay the money in to my account. Within a few days of sending the letters off, the money appeared in my account. (coincidence maybe?). Received a nasty letter back off their solicitors claiming that i never got in touch with them, even though I sent two letters and had five telephone conversations in which the staff were rude and unhelpful to me. Anyway who's laughing now ! Hope you get your money back I think LloydsTsb use all the delaying techniques they can but in the end they know they'll have to pay up.

Thanks for your explanation and glad you got your money in the end -what a sorry state of affairs when the legal profession sinks so low!

 

A manager at [problem] told me it was their aim to get people paid out asap -

I told him it was obviously quite the opposite, to drag it out as long as possible using every trick in the book. All he said was that I was I entitled to my opinion. They've denied receiving the claim (MCOL!), the judgement order, my letters and phone calls. They applied for a bogus set aside, and made a lesser offer of settlement when we had already won in court! But he refused to answer any questions or explain their behaviour and said we would have to see them back in court to make them talk to us!

 

I'm sure we'll get paid eventually - what upsets me most is that [problem] can get away with treating people like this - they are apparently sweetness and light when talking to the courts! Perhaps we should get together and complain? I wonder if anyone's been recording their side of phone calls with them!!

The last time I phoned [problem] I was on my mobile and ended up arguing with the imbecile who answered the phone. All I ever got when I phoned up was "we'll get back to you when we search out your case" (they never did). They definitley need to teach their staff some manners, or maybe they are told to speak like that to people like us who are trying to retrieve money that was taken from us illegally!!

I started my claim in Feb and it was a long stressful time but worth it in the end. I really hope you get the money you are owed and show these bullies who's boss.

Last time I rang [problem] I asked the guy to get my (paper) file.

He said it would take 10 minutes so he'd call me back - as he was worried about my phone bill. How thoughtful!!!

I didn't trust him, so I told him I'd hold on while he got the file (only took 3 mins!).

I was right not to trust him - he promised money by last Friday, huh!
