Not that they've done anything about Menzies yet but he sounds like a blackmail risk. The MP, who is one of Rishi Sunak’s trade envoys, is also said to have called his 78-year-old former campaign manager at 3.15am one day in December, claiming he was locked in a flat and needed £5,000 as a matter of “life and death”.   Hes supposed to use funding from Taxpayers and doners for a life of service, not funding a life of drink and debauchery Hope his parliamentary expenses are also investigated.   In fact, perhaps Mr Bates next role in life should be as an independent investigator of Parliamentary expenses?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I've been reading this with interest as I've just has my Argos 'statements' sent & I'm having a little trouble making head or tail of them. I'm glad to see that you are progressing well.

 

Do you have any idea what Other D.B or Fin Chgs might be? I'm assuming they are both varieties of charge as they have the usual £17.00 & £7.00 type amounts, but they both also contain a couple of really high numbers (over £100) so I'm a little confused. As much as I'd dearly love to claim all of this back I thought I'd better double check first :)

 

Also since I repayed my account through infamous Moorcroft I am wondering where I stand on claiming interest. Would like to claim the 27+% that I see others claiming but I don't want to make a mistake.

 

About to post my own thread (before any mod states the obvious) but there seemed to be knowledgable folk here so I thought it was worth a shot in the meantime:razz:

i write in response to your recent dispute in relation to the above account and can confirm we have been in contact with argos card who have advised us that they have dealt with your letters accordingly and are not in breach of contract.

 

i trust the above response has now resolved your dispute. i can confirm i have placed your account on hold untill 25 sept 07 and request you make immediate contact with our call centre on the above number to discuss a repayment proposal you can afford and maintain.

 

however if you are unhappy with the information provided please contact us by return (or in any event prior to the above date)

so a couple of questions to all, the date that argos must reply to my court case for non compliance of SAR is 25 sept 07 - could this have anything to do with it? and are moorcroft allowed to handle this if my creditor is argos? surely its a data protection breach? possibly?

Looking at Moorcrofts reply, they seem to know that 25 sep Argos must reply to your court case, so would seem they are waiting for the outcome on that date, As this is now in dispute they are just trying to get you to make payments with the good old standard letter to contact them.

Just ignore it they know they cant collect while there is a court case pending.

help please, argos have not responded to my court case and they have to of submitted a reply by this monday 25th. i am taking them over non compliance of my SAR? what happens next? i file for judgement in default then what happens regarding getting the answers to my SAR?

 

i hope someone can help me on this, please.

i filed an N1 with the county court for non compliance plus damages. they filed that they were going to defend but couple days after i got a letter saying that they would sent me every statement on my account and pay my damages in full if i drop the case with no liability to any party.

 

i agreed and now have all of my statements.
