Where do the companies stand legally? I'm thinking of the sort of deal where they say sign up and if you don't cancel in x amoutn of time we will charge you x.

 

If you challenged them what could they rely upon to say you had in fact signed up? If there a contract?

So what you're saying is if you pop to the local internet cafe and order stuff they would have a hard time proving it was you... Just curios...

 

I know contracts don't have to be written BUT oral contracts can be difficult to prove. The same might apply here.

IMO if they have taken credit/debit details you would have to claim via the bank for fraud, rather then against the company for taking money for a service you signed up to.

 

If you did indeed not sign up, the company would show that they have the relevant information (name/address/card number/security code) to process your payment. This would be enough to show you signed up, or someone else did.

 

If someone else did, it wouldn't be the company's responsibility, but your own and/or card company's. Would therefore be on you to prove that your card had been used unlawfully.

Ex-Retail Manager who is happy to offer helpful advise in many consumer problems based on my retail experience. Any advise I do offer is my opinion and how I understand the law.
