      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I think I have made a mess of this. I did the usual 2 letters each 2 weeks apart as guided to.

 

Have been offered £800.00 from HSBC and I declined and had already logged a claim online by this point anyway. I worked out it is £1400 they owe me.

 

I have now been given a Prelim Court Hearing date for 25th July 2007 in Tunbridge wells.

 

I have 2 questions:

 

1. I have more bank charges, how do I change the amount of my claim? This is £1400 going up to £1520...

(I undestand I have to pay a fee but to Tunbridge Wells court).

 

2. What do I need for the prelim hearing?

I have searched the website and nothing explains to me exactly what I need and what happens after the prelim hearing.

 

 

Please help.

About the new charges you would need to complete N244 and a updated N1 or you could wait until this claim is settled and make a new claim for the charges

Hiya,

 

Thanks very much for your reply. I am a bit worried as the draft for directions to be handed in to the judge seems to be accompanied with an allocation questionaire. When I received a letter for the prelim hearing, there is no request for an allocation questionaire it has been crossed out.

 

I'm going to take these documents with me anyway, but would the order already have been made by the court?

Sorry this is with HSBC. I know I should start a thread there and will do so tomorrow.

 

I have sent 2 letters to D & G HSBC's solicitors for out of court settlement and they have not replied. This is after refusing their first offer.

 

The only problem I have is everyone on this site seems to have had to fill in an allocation questionaire but in my case I have not been asked to do so or been given any directions by the judge, basically just turn up.

 

There's no hope for an out of court settlement as they are not replying. Also I am unsure of how to submit my draft of orders because I have not allocation questionaire to do so.

 

The letter reads as follows:

 

To All PArties

 

A defence to this claim has been filed.

 

The claim has been transferred to court covering the area where the defendant lives or carries on business.

 

Please read the accompanying documents carefull and note that the allocation questionnaire should be returned to Tunbridge Wells County Court. (The underlined part has been crossed out and no allocation questionnaire provided).

 

The attached to this letter was as follows:

 

IT IS ORDERED THAT:

 

1. The filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise. **

 

However the part in the covering letter referring to an allocation questionnaire has been crossed out so I assume I do not need to send an allocation questionnaire.

 

But my main worry is, now what to do, how do I submit a draft of orders now?

 

I believe that the order regarding the bank show it's costs is now not going to be submitted which I thought was the main reasons banks settled because they cannot provide a break down of these costs.

 

Have I missed something?

 

I have the small claims guide book and it has nothing that can help me regarding this type of prelim hearing. I take it allocation to small claim track has already been decided.

 

Sorry for the hassle but I'm at a dead end of what to do...

Of course there is not much point in contacting Barclays litigation team as your claim is against HSBC, but do have a good read through the court link though, and if you are still unsure, you could allways ask your court for guidance.

Natwest Paid me again as GOGW £1,656. Yes they can have it back if they say please.

Barclays 1 Claimed £1,260. Won by default. Paid in full

Birmingham Midshires. Claimed £2,122. Accepted £2,075.
