    • The Notice to Hirer does not comply with the protection of Freedoms Act 2012 Schedule  4 . This is before I ask if Europarks have sent you a copy of the PCN they sent to Arval along with a copy of the hire agreement et. if they haven't done that either you are totally in the clear and have nothing to worry about and nothing to pay. The PCN they have sent you is supposed to be paid by you according to the Act within 21 days. The chucklebuts have stated 28 days which is the time that motorists have to pay. Such a basic and simple thing . The Act came out in 2012 and still they cannot get it right which is very good news for you. Sadly there is no point in telling them- they won't accept it because they lose their chance to make any money out of you. they are hoping that by writing to you demanding money plus sending in their  unregulated debt collectors and sixth rate solicitors that you might be so frightened as to pay them money so that you can sleep at night. Don't be surprised if some of their letters are done in coloured crayons-that's the sort of  level of people you will be dealing with. Makes great bedding for the rabbits though. Euro tend not to be that litigious but while you can safely ignore the debt collectors just keep an eye out for a possible Letter of Claim. They are pretty rare but musn't be ignored. Let us know so that you can send a suitably snotty letter to them showing that you are not afraid of them and are happy to go to Court as you like winning.

    • My defence was standard no paperwork:   1.The Defendant contends that the particulars of claim are generic in nature. The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made. 2. Paragraph 1 is noted. The Defendant has had a contractual relationship with MBNA Limited in the past. The Defendant does not recognise the reference number provided by the claimant within its particulars and has sought verification from the claimant who is yet to comply with requests for further information. 3. Paragraph 2 is denied. The Defendant maintains that a default notice was never received. The Claimant is put to strict proof to that a default notice was issued by MBNA Limited and received by the Defendant. 4. Paragraph 3 is denied. It is therefore denied with regards to the Defendant owing any monies to the Claimant, the Claimant has failed to provide any evidence of proof of assignment being sent/ agreement/ balance/ breach or termination requested by CPR 31.14, therefore the Claimant is put to strict proof to: (a) show how the Defendant entered into an agreement; and (b) show and evidence the nature of breach and service of a default notice pursuant to Section 87(1) CCA1974 (c) show how the claimant has reached the amount claimed for; and (d) show how the Claimant has the legal right, either under statute or equity to issue a claim; 7. As per Civil Procedure Rule 16.5(4), it is expected that the Claimant prove the allegation that the money is owed. 8. On the alternative, as the Claimant is an assignee of a debt, it is denied that the Claimant has the right to lay a claim due to contraventions of Section 136 of the Law of Property Act and Section 82A of the consumer credit Act 1974. 9. By reasons of the facts and matters set out above, it is denied that the Claimant is entitled to the relief claimed or any relief.
    • Monika the first four pages of the Private parking section have at least 12 of our members who have also been caught out on this scam site. That's around one quarter of all our current complaints. Usually we might expect two current complaints for the same park within 4 pages.  So you are in good company and have done well in appealing to McDonalds in an effort to resolve the matter without having  paid such a bunch of rogues. Most people blindly pay up. Met . Starbucks and McDonalds  are well aware of the situation and seem unwilling to make it easier for motorists to avoid getting caught. For instance, instead of photographing you, if they were honest and wanted you  to continue using their services again, they would have said "Excuse me but if you are going to go to Mc donalds from here, it will cost you £100." But no they kett quiet and are now pursuing you for probably a lot more than £100 now. They also know thst  they cannot charge anything over the amount stated on the car park signs. Their claims for £160 or £170 are unlawful yet so many pay that to avoid going to Court. When the truth is that Met are unlikely to take them to Court since they know they will lose. The PCNs are issued on airport land which is covered by Byelaws so only the driver can be pursued, not the keeper. But they keep writing to you as they do not know who was driving unless you gave it away when you appealed. Even if they know you were driving they should still lose in Court for several reasons. The reason we ask you to fill out our questionnaire is to help you if MET do decide to take you to Court in the end. Each member who visited the park may well have different experiences while there which can help when filling out a Witness statement [we will help you with that if it comes to it.] if you have thrown away the original PCN  and other paperwork you obviously haven't got a jerbil or a guinea pig as their paper makes great litter boxes for them.🙂 You can send an SAR to them to get all the information Met have on you to date. Though if you have been to several sites already, you may have done that by now. In the meantime, you will be being bombarded by illiterate debt collectors and sixth rate solicitors all threatening you with ever increasing amounts as well as being hung drawn and quartered. Their letters can all be safely ignored. On the odd chance that you may get a Letter of Claim from them just come back to us and we will get you to send a snotty letter back to them so that they know you are not happy, don't care a fig for their threats and will see them off in Court if they finally have the guts to carry on. If you do have the original PCN could you please post it up, carefully removing your name. address and car registration number but including dates and times. If not just click on the SAR to take you to the form to send to Met.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

sorry to hear you've had a hard day.

 

Every day is like this in our House

We live in the house that Jack Built

or thats what it feels like

 

We never seem to have the money to bring in the professionals.

so consequently we have always

suffered from BOTCHULISM

After god knows how many years of teetering

we can finally use a toilet

that doesn't walk across the floor

when we're sitting on it.

 

the last one didn't have any screws in to tie it down to the floor.

they had rotted, rusted, and broken off

with the constant use of bleach.

 

So we're thrilled with ourselves now

as we're not in any more danger of being rushed to hospital

in a most uncomprising position with our pants down

 

How embarrassing would that be ? :p

 

BUT, and its a BIG BUT

we plumbed it in ourselves

so theres always time for a catastrophe

which come to think of it there was on the night

we actually plumbed it in. Forgot about that !

I'd newly decorated it all

plastered up the hole in the ceiling

and it looked great - just left enough room to reach the stop-cock.

EXCEPT -

just hours after plumbing the loo in

the stop cock started dripping slowly,

then Badly, and then completely flooded out the Loo

My new wallpaper came unstuck about 6" around the wall

and we had to knock a bloody hole back in the ceiling

to get to the pipes leading to the stop-cock.

Fortunately it was the washer that needed tightening up

but the hole is still in the ceiling, and will remain there for

the next ten years.

I have just restuck the paper, only yesterday, and thought

about tackling the ceiling..... but thought - another day....

 

theres a million jobs to be tackled here

we live in a tumbling down rickety old georgian cottage.

but oddly enough

I like it that way.....

I love the irregularity and imperfections.

Must be mad !!!

 

and I haven't done a thing today,

I've been like a limp old lettuce,

 

Well I've done one thing,

I've tried to freshen up my favourite curtains that the

dog widdled on, last week.

 

When I hoovered the soot off the curtains

sadly I managed to hoover off half my flowers on the bottom

They are Indian Crewel Work Curtains

where the flowers are actually embroidered on to the fabric.

 

I've had them out on the line today to freshen them up

Mmmmmmmmmm Love the smell of sunshine on fabric.

 

 

Wonder if the Court will accept Credit Cards

for my AQ Fee

this postal strike has thrown me.

doesn't help that its been random areas.

will ring and ask tomorrow

would save me a drive in if they will.

Could not resist a quick reply, you sound like me with a skirt on, it is a complement honest, you and me can't keep our hands to ourselves. In the past ****** years, I have virtually rebuilt 4 houses and countless others for other people. If any one is in a jam, they all knock on my door, it's only since this Wraggy thing has started that I just don't find the time to do anything. But tomorrow I will definitely find time to lay a path for the unmarried mothers home, Wragges can wait!.

 

Soot, like plaster dust, no matter what you do to keep it in one place, it gets everywhere, and takes ages to get rid of, and tastes orrible. Your toilet reminds me of this house, everytime you sat down, the toilet moved. So came the day of doing the bathroom, up came the carpet, it was everywhere, up the side of the bath and halfway up the walls. Anyway when the carpet came up there ws a hole at the back of the pan, closer inspection revealed no floorboards and the toilet just resting on the stink pipe, seems the glued carpet was holding it upright! The living room was just as bad, the previous owner left a couch behind, very generous I thought, until I came to move it and found half the floor missing. So Alice, we have both had some fun along the way. Wondered where all the jackdaws went, have not seen one here for ages, they must have all gone down your way. And on that note, I must get ready for tomorrow, I think I'll wear the string vest and skimpy shorts topped off with a pair of 'red boots'.

just rang my local court

 

they still haven't received my £100. AQ Fee Cheque :eek:

 

which was posted 1st Class Recorded Delivery on Wednesday afternoon.

 

now Friday morning.

Confirmed Postal Strike -

although we received post here for the first time in 3 days ??

 

So Going to have a nice sunny trip out

over to my local court with another cheque

to ensure it arrives within their deadline.

 

the first one to spot the court gets a sixpence ! ! !

 

and I was going to instal the woodburner this afternoon.....

another day another dollar

Well - I'll go to the foot of our stairs.....

 

Drove over to local court to hand deliver my AQ Fee

this afternoon.

 

gets into the main reception,

handed in my cheque with covering letter, explaining postal strike, etc.,

 

and the nice lady said

"Oh we received your cheque this morning !"

 

"have you cancelled the first cheque now"

advised I hadn't....

 

so everything is F.A.B. for now

 

wasn't a wasted trip as our

teenage daughter got to

look round (and buy) in the River Island Sales.

 

came home a few pounds lighter (the monetary kind !)

 

but all pleased all round :p

and they advised me at the counter when i got there -

they'd received the first cheque posted on wednesday this morning.

but it cost me much more than £10 in the end,

On a more serious note can anyone ask this question:confused:

 

I have recently been told I have various food intolerances which mean for 6 weeks I have given up dairy, yeast ,eggs ,so no bread ,milk, cheese gravy yorkshire puds ,ice cream , beer,wine,cider etc.etc.etc.(the list is too long)

 

SO WHY HAVE I NOT LOST ANY WEIGHT!!!!!:eek: :eek: :eek:

could it be the bacardis?

I know a bit about this as my partner suffers from intolerances ... mainly gluten, also types of fish, nuts, fruit, etc., etc.

 

Where were you tested? I only ask because so many tests do not actually work:rolleyes: The best food intolerance test I believe is by York Bio Labs and it's a blood test you can do by post (not cheap:rolleyes:). Their testing is used by some of the top nutritionists in the country. Did you go through your doctor and was it a blood test?

 

My partner lost 12lbs in a month when he gave up these foods, though some he can have on a "rotate" basic. Gluten is the biggest problem and he lost 12lbs in a month when he gave this up. He's since put it back on though compensating by eating more chocolate, etc.! He's been tested for gluten twice and remains intolerant, so has been advised to try and keep off it for life:shock:

 

This probably doesn't answer your question at all, just thought I'd share as it's a big part of our lives ...

actually mine was york testing -and I am happy with the results -as i had suspected one of the foods that came up. Its just that it has been hard work and although I do feel better I thought a bit of compensation might have been losing a bit of weight. Actually the yeast is the hardest bit at it is all salad dressings all breads etc.and even things you wouldnt imagine (a certain brand of organic beefburgers why?)

 

But as I say most days I have felt better in myself so I think it was worth it.:grin:

Yes, we have the same problem with gluten, it's in EVERYTHINGicon12.gif (or seems to be). The one saving grace is that he can have oats, it's the other kind of gluten he can't have (gliadin?), so basically anything with flour/rye/barley in he can't have (including beer:rolleyes:).

Unfortunately sb my other half cannot have any fish in the cod/haddock family, or certain vegetables and fruit. Seem to spend half my life trying to find recipes that don't exist:rolleyes:

 

There's no way I'm being tested ... chocolate makes me sneeze like mad, so I strongly suspect it's one food I'm intolerant/allergic to, but I have no wish to know whatsoever, I couldn't survive without iticon12.gif I'd rather be chubby, bloated and happy thank you!

 

It's seems to almost always be the case that we're intolerant to the foods we like/eat the mosticon9.gif

Good morning ladees,

 

Decided to drop the 'Good Persona' and go and join brother Tom for a night on the tiles. Where does that cat get his energy from? He was 'Hopping and Bopping' all over the place, and as for female felines, there were too many to count, how Tom remembers all their names is a mystery. Met a nice feline from Cheshire who kept on smiling all night, another feline came from Persia and spent most of the evening in the powder room, while another feline was from Burma, quite pleasant, didn't say much, just kept on nodding when asked a question. Anyway was glad when the sun came up and it was time to go home, no sign of Tom though. Walked home with a nice feline from Paris, over here visiting relatives, so I'll be popping round later to take here for a stroll around the park.

I've just had a glass of Sanatogen and popped a few liver pills, I've had to put on my 'Surgical Stockings' as my legs are starting to ache. Busy day today, got to go and see the Mother Superior about Tom and his antics, not looking forward to that, but looking forward to seeing, Oh what was her name? Mimi? Fifi? Michelle? Aleece?? Oh well, I'll find out later, maybe the grey cells are not working becauseos I don't eat enough Fish!
