    • If you visited Qatar you could be detained at the border, if the debt has been notified.  If you are only in transit and do not seek to cross border into Qatar you might be ok, but you may want to seek formal advice about this.
    • Howdy, I had a short lived credit card with Vanquis that I did not need. I paid it off in full and called them and closed it with the person at the other end. 2 months later they started sending me messages about late payments, I called them and to find out that the card had not been closed in error and 6 weeks after it should have been closed they paid a google debit of £560. I hit the roof and made a formal complaint that took them well over a month to respond to. They agreed they were at fault, refunded all late payments fees and offered me £100 in compensation. However they said the debit amount stood as 'I had benefit from it' and I should get a refund from google. I hit the roof again but they have stuck to their guns. The debit from google is a genuine one but I wanted to dispute it with google so closed the card so they would have to engage with me. But surely that's neither here nor there surely? What is the next step? Ombudsman takes forever doesn't it?  thanks in advance
    • Yes, it struck me this morning that I'd got it wrong    - no involvement of UKPPO in any previous Tesco thread    - there would have been an entrance sign to a Tesco car park    - CCTV isn't something associated with Tesco car parks. Presumably whoever runs the car park has put CCTV at the electric, and probably BB, areas, done absolutely nothing to stop abuse, and then rubs their hands in glee every time the CCTV catches a motorist out. You can pay £60 and this will go away. Or you can defy UKPPO and rely on their non-respect of POFA, consideration period, etc., should they be daft enough to do court later down the line.  We would support you all the way.
    • Good evening folks, i have my hearing tomorrow at 3pm. I have never been to court for a civil matter, what is likely to happen  and what do i need to do?  I plan on going straight from work, i finish at 2pm, it will take about half an hour to get there, does that sound ok? I called the court late this afternoon, sadly i was too late in the day and the office was closed.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Give it half an hour then phone Cobblers. Tell them this is their final chance to settle for the full amount. Tell them you will not apply for wasted costs if they pay the full amount. If they dont say see you in court. :D

Just received call from Cobbetts. They are still disputing service charge but are going to phone the bank and get back to me. They say cant agree wasted costs and they have Counsel on stand by to attend court to defend tomorrow! Can someone confirm the interest as cobbetts havnt mention this jhamb ie if my full claim £2700 do I add 8% interest on this?

This is another bluff. I am sure they will come back to you with an offer for the full amount. If they were not why are they contacting the bank again. They can just send the solicitor they have on standby.

 

Do the charges differ from one month to the next? Its hard to be diffinative without seeing the schedule.

They are definitely using scare tactics at the moment. The charges range from £20 to £60 per month and they are all stated as "charges" nothing mentioned about service charge. Can you confirm anything about the interest. Is this now "compound" interest ie 8% on total claimed? Much appreciate your help Jhamb

Have you added the Advantage Gold Fees to your claim

This may be what they are calling service charges

 

They quoted this - I think thats what it is - just waiting for call back from them!

Just one other thing. If they make acceptable offer - do I just phone to court to tell them settled. I think court closes at 4pm so if havnt heard from Cobetts until after then - would court accept phone call first thing in the morning?

 

My advice would be to attend and get the court to issue an order settingo ut the terms in full including when they must pay you by.

 

At such short notice its likley that the court wont actually act on your call and the court will go ahead with the hearing.

 

If you turn up it allows you to get experience and the order you really want. In the future should you end up before the court you will be much the better prepared for it.

 

Incidentally the court wont stop proceedings unless you have cleared funds in your account and neither should you.

 

You could ask for a stay but IMHO id attend.

You can claim your charges

interest you paid on those charges (usually calcualted at the purchase ot unathorised rate dependant on account type)

plus interest on top Sec 69 or 8% simple interest on the lot.

 

If all those are mentioned in your particualrs of claim then you dont need to agree any settlement unless you get the lot or are happy to settle for less.

Right folks - what happens now!!!???

 

Cobbetts eventually agreed settlement of full claim with interest with the hearing set for tomorrow!!!! I rang the court to tell them and they have advised that I still attend the hearing as the banks "have been known not to pay out". I was told the judge would simply "adjourn the hearing until funds cleared". I have no problem in still attending however, need some advice on wasted costs order. Do I simply type this up and take it with me tomorrow and what details do I need to include - has anyone done a wasted costs orders that I could take some advice from ie what did you charge for photocopying - time spent sorting this mess out and day off work etc. Are these the type of things I can put in wasted costs order.

 

HUGE thanks to everyone on this site for all the help and support - couldnt have done this without you - I will post my winning on success site but would appreciate any help on the wasted costs order so I can prepare for tomorrow's hearing. CHEERS again you wonderful people. I will be startine the whole process off again as since starting claim a further £200 have gone onto account and they werent prepared to discuss this - told Cobbetts no doubt their client would be in touch with them again!!!

 

To everyone out there still fighting - chin up and keep going - my hearing was tomorrow and they settled this afternoon and when they called me they kept saying we have a barrister waiting to attend court tomorrow to defend - b..........cks I say!!! Dont let them frighten you. When they first rang me this morning with an offer I refused - three phone calls later - had the full amount. Keep going YOU WILL WIN IN THE END!!!!!!! Jhamb

THANKS SO MUCH HEDGEY - CANT BELIEVE THEY PAID OUT RIGHT AT THE LAST MINUTE! STILL ATTENDING COURT TOMORROW - THE COURT ACTUALLY ADVISED I DID THIS UNTIL MONEY CLEARED IN BANK - THE JUDGE WILL APPARENTLY JUST "ADJOURN" THE HEARING UNTIL HE HEARS THE MONEY HAS CLEARED. ALSO GOING TO TAKE WASTED COSTS ORDER TO SEE IF THE DJ WILL STAMP IT. CANT SIT BACK TOO LONG - THOSE B............S AT NAT WEST HAVE PUT ANOTHER £200 OF CHARGES ON ACCOUNT SINCE STARTED CLAIM SO GOING THROUGH THE WHOLE THING AGAIN NOW FOR THAT!!!! MUCH MORE CONFIDENT THIS TIME THOUGH!! THANKS AGAIN FOR ALL THE HELP AND ADVICE - WILL LET YOU KNOW HOW IT GOES WITH WASTED COSTS ORDER JHAMB:)

Very well. Not long back - didnt take that long but went shopping afterwards to celebrate. Judge had received a fax from solicitors saying settled. He said he would adjourn the hearing for 28 days to ensure cheque received and cleared. Arrived home to find cheque delivered for £2600!!!! Judge wouldnt entertain wasted costs order. He said he didnt believe bank behaved unreasonably however he did say some judges disagree with his view so its definitely worth trying your own court. Thanks for your help. Will be on this site for a while yet - Nastywest have put more charges on my account since claim started. Going to close account tomorrow and then start fresh claim for further charges - AND THE FIGHT GOES ON!!!!!!!!!!

Yep, definitely a lesson to all those with hearing dates and not heard anything from Cobbetts. HANG IN THERE - they are likely to settle even the day before the hearing - and dont let them bully you into taking lesser offer - they did all the calling on the phone the day before hearing to try and get sorted - AND CERTAINLY dont take any notice of them when they mention their Barrister on stand by - if they thought they had one ioata of a chance of winning, they would be sending in their barrister without calling 5-6 times the day before to try and settle. Stick out for the whole lot. Just one other thing. The cheque I received could only be paid into my NatWest Account - crafty b............s!!!!!!
