      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I'll try this and thank you so much.

The stress of all this will be over once the bundle is sent. It's been a real awful year to date. Husband diagnosed with Angina and is waiting for cardiac procedure, Father in law died in March. Can't go on hols in July as planned due to hubbies awaited procedure. The charges refund however will fund a small trip later in the year if we can get insurance. I have looked already into the best sites for this.

Well, like you said you will be glad when its all over, and thats what the Abbey play one, just remember one thing, its not if you get the money back its when:D

Hi anyone

I give up. :Cry: Does anyone know where I will find a copy of the statement of evidence please. I have trawled through so many posts and template areas. I have done mine but want to include a few examples of when 10 charges a day mounting up to £320 were taken but can't remember what section to put it under.

Only this to do and the bundle is ready for posting. :-D

Right the bundle is now ready. When do I need to mention about additional costs please. Latest schedule only has dates that original charges were claimed and interest. Reka said last night that by the court date I will have extra interest to claim but my spreadsheet wasn't done on this site. What about claiming for Court Claim costs and AQ fee even though I didn't need to complete one I still had to pay the fee. I'm not worried about the extra interest just be glad to get the costs so far refunded.

You will be able to claim for court costs and aq fee. With regards to the spreadsheet I used the one on this site as it continues to work out my accruing interest. Do you know what your daily rate is? if so times that amount by how many days have passed since your claim was issued, then add it to the balance you put on your claim form.

 

Example this is mine

 

£2170.50 in charges

£457.17 statutory interest

Court Cost £120.00

this is the amount I claimed on my form. Plus my daily rate is 41pence (was 48p but went down since they paid my gogw of £280.00)

 

So if i was to times 41p x the amount of days since I issued the claim and added it to the amount on my claim form, i have earnt around an extra £8.00 odd.

Your N1 should show the charges and interest acurate to that day, and also say that you are claiming 8% from the day you filed to the day they settle (or words to that effect)

 

I included in my bundle what the charges and interest would be on the date of my court case. Yhis is not necessary just i found it usefull.

Hi Di, the thread i told you of earlier is not on rekas website - he had so many requests for that year he typed them all out in full on this site - under Abbey t& cs 1997. Try clicking on rekas name and then view all threads started by reka , it was just a couple of days ago.(still dont know how to post a link?!-durr..)

Thank you for your posts. I do already have the T & C's and now need to add to the latest schedule of charges the 8% I am claiming extra if they don't settle.

I am then finally ready to seal the envelopes.

I think I saw someone else ask in a post as to whether the court copy is addressed to the judge whose name is on the court info received, but didn't see the reply. Any thoughts please.

Is it worth emailing Inga or her standin to see if they will settle as it's 3 weeks Mon to court case and we haven't chased them at all since we filed the claim. Saw another post in a thread where that was recommended by Jules1973 earlier today.

I have completed this more or less as you have done. Section 7 - Used a couple of examples when he had been charged 10 times in one day for 3 months. Explained that he was unemployed at the time and was in no position to clear the debt incurred by the charges and that Abbey were not sympathetic. In fact they were downright obnoxious. Didn't put that on the form though.!

Have tried to cut and paste the original charges into this site's interest calculator and managed to do it then cocked it up as I didn't save the original and by this time i'd deleted the original and the total formaulae is not there. Now when I go back into it all I can find is the copy I've messed up. Oh b****.

Think I'll just add a comment to the original charges statement stating that I'll be pursuing the addtional inerest if we end up in court on the 23rd or words to that effect.

It's Friday and I need a stiff drink. I'll sedn the email first though. :wink:

I've drafted an email to Ronan following posts on the site. My contacts with Abbey are James Arrandale/Vivian Roux who are named on the defence. Vivian Roux is a para-legal. Is it still Ok to send the email to Ronan Coyle or does he belong to a different team at Abbey.

Please respond as I want to send this asap before I post out my court bundle.
