Hi All

 

Quick technical question - in the guidelines and templates, it is stated that for the initial DSAR, you should ask the lender/bank/institution for information on any manual intervention they might have had to make on an account.

 

This seems to be there mainly to introduce a possible argument later on in a case that the defendant's charging mechanisms are purely automated and therefore there can be little or no justification for their outrageous penalty fee structures.

 

It seems that a lot of people (myself included with the Halifax) are receiving letters referring to the fact that they cannot provide you with this information because they are not obliged to keep records of it.

 

Does this diminish our argument in any way, or is it just usual bankers' flubber, designed to try and put us off the scent?

COMPLAIN about the ANTI-CONSUMER way in which the OFT Test Case is being handled!

I have sent a SAR to the Halifax for a fraud issue on my account, not only have they not complied, but I did get a pathetic letter saying that manual intervention does not form part of their filing system..

 

I would also like to know if they have to give you this information....

Don't worry too much about manual intervention. It is not as important to your claims as was once thought.

Just continue your claims, it won't cause you any problems.
