Can someone please clarify something for me please. If going through the FOS when claiming credit card charges back do they go for the full amount or the difference between what you've been charged and the £12 threshold set by the OFT?

Hope someone can answer this for you. In the meantime, just to let you know that I filed a claim on MCOL against Capital One and was refunded ALL my charges plus interest and court fees, even though they'd said in the initial correspondance that they would only refund the difference you mentioned, and suggested I went to the FO.

 

They settled up in full about 21 days after my claim was served on them.

 

I suspect the FO would be going for the full amount, but again, hopefully someone more experienced can advise.

I'm going through the FOS for charges against Cap one. I understand that once the FOS contact Cap One and a complaint escalates Cap One will be fined £400.00. I would think that it would be in their interest to settle quickly. I am not accepting less than I have asked for in my initial request. You can turn down the offers should you get any. If you are not happy with the end result you can always go to Court afterwards. I understand though that the FOS are swamped.
