    • I can only speak from personal experience. But a similar thing happened to me. Seriously dented door.  I made the other insurance pay. They regarded it as a write off. Took the money, replaced the door. Never heard anything more about it.    Except clearly someone sold my details to claims company, because I got loads of calls in bad English for a few month's 
    • The incident was 03rd March 2024 - and that was the only letter that I have received from MET 15th April 2024 The charge I paid was at the Stansted Airport exit gate (No real relevance now - I thought this charge was for that!!).   Here is the content of email to them (Yes I know I said I was the driver !!!!) as said above -  I thought this charge was for that!! "Stansted Airport" Dear “To whom it may concern” My name is ??  PCN:  ?? Veh Reg: Date of Incident: 03rd March 2024 I have just received a parking charge final reminder letter, dated 10th April 2024 - for an overstay.  This is the first to my knowledge of any overstay. I am aware that I am out of the 28 days, I don’t mean to be rude, this feels like it is a scam My movements on this day in question are, I pulled into what looked like a service station on my way to pick my daughter and family up from Stansted airport. The reason for me pulling into this area was to use a toilet, so I found Starbucks, and when into there, after the above, I then purchased a coffee. After which I then continued with my journey to pick my daughter up. (however after I sent this email I remember that Starbucks was closed so I then I walked over to Macdonalds) There was no signs about parking or any tickets machines to explains about the parking rules. Once at Stansted, I entered and then paid on exit.  So Im not show where I overstayed my welcome.. With gratitude    
    • Just to enlarge on Dave's great rundown of your case under Penalty. In the oft quoted case often seen on PCNs,  viz PE v Beavis while to Judges said there was a case for claiming that £100 was a penalty, this was overruled in this case because PE had a legitimate interest in keeping the car park free for other motorists which outweighed the penalty. Here there is no legitimate interest since the premises were closed. Therefore the charge is a penalty and the case should be thrown out for that reason alone.   The Appeals dept need informing about what and what isn't a valid PCN. Dummies. You should also mention that you were unable to pay by Iphone as there was no internet connection and there was a long  queue to pay on a very busy day . There was no facility for us to pay from the time of our arrival only the time from when we paid at the machine so we felt that was a bit of a scam since we were not parked until we paid. On top of that we had two children to load and unload in the car which should be taken into account since Consideration periods and Grace periods are minimum time. If you weren't the driver and PoFA isn't compliant you are off scot free since only the driver is liable and they are saying it was you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi,

 

I'm at the final phase of entering my MCOL and am entering credit card details. BUT, I can't recall having added my schedule of charges. Although I did send this with the original Letter of Claim, I have noow updated it to include s69 interest at 8%. Should I re-send HSBC the new schedule which forms part of the claim or should I be attaching it electronically with the MCOL?

you will send a schedule of charges once you have filed your mcol. there is no provision to include them on the form. we usually say after you have filed, send a couple of copies to the court and a copy to dg once you have had your claim acknowledged.

sorry to be a pain - my claim has now gone through, and I've been allocated a claim no. Do I now wait for my claim to be acknowledged and then send the schedule or do I send it now? If so, how do I know which Court it has been allocated to. Thanks

Steerpike - for now you are still dealing with Money Claim online address at Northampton - they need the charges statement to attach to your claim. Make sure you put your claim number on the sheet.

Wait until you receive the Notice of Acknowledgement (not the Notice of Issue) from the court and then send a copy to the bank’s solicitors, since they are the ones who will now be dealing with your claim

If it is that in your view the interest is not claimable, I am prepared to discuss this with yourseves and the judge in court.

Hi,

 

Used the simple spreadsheet to calculate s69 8% interest. Saved it on my hard drive and then entered my MCOL. However, I now need to send a schedule of charges x2 to MCOL but when I go back into the spreadsheet it has calculated more interest cos the formula goes on days since offence to TODAY's date - not the date I issued the claim. Sorry to be thick - how do I change to formula so it goes from the day of offence to the day I issued the claim (01.05.07)???

It depends what you want to do, but the easiest way is this:

 

In the "days since offence" column, the formula currently reads something like "=TODAY()-B2"

 

You need to enter a date at the top of your spreadsheet (such as Date Claim Raised) - and then in the "days since offence" column make the formula:

 

=$B$1-B2 (where $B$1 is the cell that you placed the date in...then copy/drag the formula all the way down...

Another way is to change the date on your PC.

 

Just double click on the time (bottom right hand corner of screen) and alter the date to when you first calculated the interes.

 

Don't forget to change it back though;)

thanks very much folks,

 

Ive re-calculated and now have (nearly!) the figure I entered as the total claim plus s69 on MCOL. However, a couple points.

 

1. I calculated the claim plus interest on 30/04/07 - but the date of issue is 02/05/07 - do I recalculate the 'days since offence' and therefore also the interest - in line with the new date?

 

2. Despite all the formula, figures and dates being identical, Excel is rounding fractionally differently from Works (where I first saved it) and therefore my schedule now reads £1713.01 instead of £1712.95 which was the originally claimed amount on MCOL - will this matter??

the answer to your question No 1. is no, you take the date of when you did the claim ie 30.04.07.

 

Question 2. I would adjust 6 interest figure, the early ones, and reduce them by 1p per transaction. This will then give you the same figure as your MCOL.

Help!!! sorry, now not only have I inexplicably lost 2p on my original claim, I realised I cocked on a date so the interest is less. I have already submitted my MCOL at £1713.29 plus 222.29 but it should have been £1712.91 and £221.91 interest. What should I do??

I would not worry about my calc's were out DG pointed them out and based there offer on thier Calcs just ammend and ensure you figures are correct for any nudge letters you seny

Hi,

 

I've now had my claim acknowledged by HSBC (via MCOL). The guide states I should send a schedule of charges to DG sols now. Is this right? Surely I should wait for them to make contact with me?

We suggest in our own guide that once you start a claim, you should send a copy to the court and the other side.

 

One of the benefits of using the N1 claim for at your local county court - but don't get me started on that one! :D

in watching this forum for about eleven months now - we noticed that dg never makes an offer but what they don't first ask for a breakdown - it's a one week delay gimme - so we beat them to it and send one

Hi,

 

My MCOL dates from 06/05/06. 28 Days expired and I'd heard nothing - not even a reply from DG sols. I went online today expecting the best and it says simply "Defence" with a date of 01/05/07. It also says my claim will be transferred to a local Court. How can this be when I havent even received the Defence in the post????

You will receive the defence with the notice of transfer from MCOL. This usually states that the AQ has been dispensed with, but it is up to your local court. Once your claim has been transfered, start doing some polite nudges to DG. Also if you haven't heard from your loacl court in a week or so, give them a ring and ask:-

 

1. what is happening with your claim

2. Will an AQ be required

3. If no AQ, will the fee still be payable.

Sterepike, i am in the same position as you! Called the court yday as hadnt heard a thing either and they had heard off DG just on the cut-off day but hadn't bothered to let me know they were taking me to court. I am also being transfered to the local court..apparently!??! Hmm, fantastic communication hey:roll:
