hello again mrs newbody here newbody just phoned any1 who hasnt left yet bring copy of statements and list of charges ie spreadsheet as abbey solicitor claiming not recieved paperwork and if u want proof u sent it

Thats interesting, because as well as us sending them the schedule, i am sure the courts will also have sent, how can they say they havent received anything from anyone, and they say they are not abusing the system.....

Just returned from Southend and to reiterate what newbody said, abbey appeared to have 'not recieved' anything Judge seemed a tad miffed with abbey solicitor who was clearly underprepared.

 

The fight continues and just a bit more hair lost.

If they try and say that they have never received the schedule ask the judge how it is possible when the court sends it, we send it and more often than not they ask for it again, produce your proof of posting and suggest that this is another example of Abbey abusing the court process, all very respectfully of course

Morning all, have just returned from Southend Court for the Allocation Hearing....was in at 10:00am this morning...Abbey Solicitor made it with 2 minutes to spare in a bit of a fluster. I can confirm that they are claiming that a schedule of statements had not been received (all 60 attending today??????!!!!!!!); they even had no record of my case number or name!!!! Judge seems unimpressed with the banks and definitely seems eager to get a test case or batch of test cases....good luck to the rest of you in today; don't panic too much, just have your schedule of charges (copy for judge and ANOTHER!!! for Abbey); it now seems as though Abbey have until September to settle or they face the final Court Hearing.
