      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Fine as it goes. If you are claiming s69 8% interest you need to include this at the end:

 

Claimant claims interest under Sec.69 of the County Courts Act 1984 at a rate of 8% a year from(Date of 1st charge) to (Date of filing claim) of (£0.00 =The interest in the 8% spreadsheet calculation) and also interest at same rate up to the date of judgment or earlier payment at a daily rate of (£0.00p = Amount of charges claimed x 0.00022).

Its off to Court for me tomorrow to hand my claims in. omg I getting a bit scared again, but this is the bit I've been waiting for, I can just see that New TV in that corner of my room, might have enough left to buy myself a box of chocolates lol.

Hi fellow bank charge grabbers,

 

I have received my statements going back to jan 1999, the damage is £1150 and I want it back. 2nd letter is in tomorrows post and I'll wait and see what the result will be

 

The funny thing is I requested my statements and forgot to include a chq for £10 but the statements still arrived in one big bundle, it must have cost £10 in postage.

 

My wife's step father is a retired area bank manager and is very sceptical. I hope I canprove him wrong.

Hi there Angi, how is your weekend going?? Try not to worry about court because Halifax WILL NOT allow it to go to court. They know they will lose. The money is in the bank my dear (pardon the pun) I cant wait to hear in the next week to 10 days that they have settled in full.

Hiya

Not sure what's going on, I went to the Court on 18/08/06 to hand in all my claims forms, I was told I would hear something back within a week, Its a week now, & I've heard nothing back, I've checked my bank accounts & nothing happening there either, so if anyone knows how long it takes the Courts to issue my claims to the Halifax, would you be so kind as to let me know,

I also have to say, that I think I could be the first person suing my banks with this Court (Consett), so weather that makes a difference I don't know, But if you know different, please let me know, & if I am the first to use this Court at least others will learn how long it takes them to make their claims.

Hi there Angi. How are you doing?Hope you are not working too hard? Remember a little of what you enjoy does you no harm!! A lot of what you enjoy is damm right greedy but so much FUN!!!

Anyway getting back to matters in hand. As you know I live in Scotland so I handed my papers into the Sherrif Court and was told to get back in touch by a set date which was 1 month (roughly) from the date which I filed my claim. The reason for getting back in touch with the court was basicaly to see if halifax were gonig to defend or not.

About a week to ten days after handing my court papers in,the halifax settled in full!!

Courts in England could be different I just dont know. Sorry I cant be of more help.

Hiya

Just a little update -

Rang the courts to see why I had not heard about my claims, The lady told me they are running 5 days behind, due to staff holidays & bank holidays, But the best news is, my claims are all issued today, & they will send me a letter to confirm this should have in by Thursday, they also gave me Claims Numbers, so once I have the letter that confirms everything.

Am I right in letting a Moderator when I have my letter to give them details?

Received a letter from the Halifax with yet another offer

05/07/2006 - offer was £152.00

30/08/2006 - offer is £455.00

only thing is, the court has issued my claims on Tuesday 29th, this letter is dated 30th so must have crossed in the post. Never mind, Im not accepting, (its not enough for my new tele that will look great in the corner of my sitting room)
