      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hello all

 

I'm new to this forum and presently pursuing a claim against Lloyds Bank for just over £4,000. The information here has been very helpful, thanks.

 

On another, unrelated matter!

Does the CAG have a merchandise section? I know that running a forum requires money and often relying on donations alone is difficult,

 

Maybe this is where I can help. My partner & I run a small embroidery/T-shirt/Mug/xxxx business and we've produced item for many forums - mainly car forums

IF no one is already producing merchandise for this forum, would there be any mileage in allowing us to produce some for sale through the site?

You are however touching on one of my pet hates, the fact that we are expecting to pay MORE for items that advertise the goods, from Coke to Chanel. :mad:

Methinks a tad hypocritical there Bookworm!

 

It is a question of simple economics...

 

Manufacturer sells T-shirts to CAG @ Wholesale price.

Manufacturer makes a profit.

Manufacturer gains.

 

CAG sells T-shirts to Members @ say, half the difference between Wholesale + Retail price.

CAG makes a small profit on T-shirt sales to Members.

 

Members are 'incentivised' to purchase said T-shirts, cos are priced @ below Market price.

Alternative niche Brand name T-shirts become less attractive to purchase, based on cost/value for money.

Members gain.

 

CAG recovers 'lost' profit on sale of T-shirts by increased advertisement...

More potential Claimants choose CAG to use + donate to.

More potential Claimants view other CAG commercial links + make purchases.

 

A CAG T-shirt becomes one of the great 'must have' iconic accessories that any potential 'rebel revolutionary' of the 'naughties' could possess.

...i.e. Similar to the Che Guevera posters?!

 

In order to achieve that status, it would have to appeal to the masses + make an obvious statement against conventional Consumerism, n'est ce pas??!...;)

 

Alternatively...

 

CAG sells T-shirts to Members @ FULL Retail price.

CAG enters into a very competitive niche Brand market, without the HUGE advertising buget of the multi-nationals.

CAG T-shirt sales are moderate-to-break even. etc etc.

 

Or...

 

Manufacturer sells direct to Members @ FULL Retail price.

Manufacturer gives CAG a small % of the difference between the Wholesale price + the Retail price in order to comply with any licencing agreement.

CAG T-shirt sales are moderate-to-break even etc etc.

 

 

P.S....Why are U advocating giving Class A drugs (coke) to Chanelle in BB8??

Do U NOT think that poor ol' Ziggy would go ballistic at the mere thought of it??...lol...:-D

Methinks you misunderstood my post, MTM. ;-) And of all the things I have been accused of, (and you have NO idea of how many there are! :lol:) hypocritical has never been one of them! Quite the reverse, in fact. :-D

 

Anyway, what I was referring to the fact that one is expected to pay more for a branded product (even when the brand is not relevant to the product, let's say a pencil case with the Coca-Cola logo plastered all over it) when they used to be given away as means to propagate the brand. Therefore, we, the consumers are, in a way, sponsoring the brand we are expected to buy? That is one tour de force (like the tour de France, but with less bikes :-D), marketing wise, that never ceases to amaze me. I am sure advertising departments worldwide must be rubbing their hands in glee at our collective gullibility.

 

As for the CAG argument itself, although I admire the reasoning, I can spot the fatal flaw: The only people only ever likely to be interested in CAG t-shirts would be the most dedicated CAGgers themselves.

 

And I am pretty sure El Che wasn't benefiting from the sale of those posters, btw. :-D

 

Oh, and your PS? WHOOOSH over my head. I assume it refers to some of the moronic non-entities in desperate need of something to give direction to their amoebic flapping which appear in some voyeuristic self-loving piece of claptrap apparently polluting our TV screens on a far too regular basis, but that's merely because you gave me the BB8 clue, which even with the best will in the world, I have not been able to ignore the term crawling across my consciousness and slightly tarnishing it with its dubious slime. :razz:

The very reason why I refuse to follow "fashion" - I would puke at the thought of advertising myself as some sort of corporate whore...whatever happened to good old fashioned t-shirts with no logos on them...caps...jackets...bags...:mad:

I would wear a CAG tee but not to advertise it; I would wear it as a sign of loyalty, proud membership of an honourable league, to show off my membership of the club of spectacular underdogs who took on Goliaths and won!

Please, don't puke, lol, I do not often talk like that.....:D

But this time I a serious!

Besides, can you imagine how nice it would be to walk in a CAG tee and be stopped by someone; hey, I am A CAGer too! Mwah Mwah darling, such a small world....

We could have a CAG t - shirt for the successful claims saying 'I've won back my Bank Charges from (insert name of bank)' then make sure you wear it next time you're in the branch - preferably in a long queue. What a way to spread the word!!

Bank of Scotland account 1 - £2,666 WON

GE Capital charges -£30 won (hey, every little helps!)

Barclays Partner Finance £425 charges - £225 offer accepted.

 

Finally debt free after 4.5 years, thanks to my Debt Management Plan through Payplan. There is no better feeling :D
