Please can someone help, i initially claimed for £6050 and eventually recieved a full and final settlement for £3189 half of what i claimed for therefore i sent the next letter (LBA) giving them 7 days to respond, which they didn't i've contacted them today and asked to speak to Mark Douthwaite who surprise surprise wasn't available. I informed them of the letter and that i had not recieved a response. The woman stated that the bank will not regotiate nor will they respond to further letters and told me to go through a county court claim...which i will do however is this normal???


so if the next step is a county court claim who, where and how do i go about it and how much will it cost...there is so much to look at on the internet i'm all confused!:???:

Don't cash that cheque until you have sent them them a "REGISTERED" letter stating that you accept that sum in partial settlement of your claim and that you will pursue the rest through the Courts.


If you cash it before you send this letter and know they have received it, that is your acceptance of the offer without signing an acceptance note, any further claim for the rest would be thrown out by a judge, in my view.


others may disagree, but in my dealings with the RBOS cover your back every step of the way.

The RBoS didn't send me a cheque they sent me a letter letting me know that they are offering a good will gesture of £3189 along with a form that i must sign and send back saying that i accept their offer, i havent sent this back i sent them the LBA letter which they didn't acknowledge and today when i phoned the woman said they wouldn't respond nor regotiate and to go to a county court to claim. i stated in my letter that i accept as a part settlement and will be persuing the rest through a court if they did not respond which they didn't. So the next step is court, and i'm not sure how long or how much this will take. any advice is welcome:(
