Could you explain your problem with Barclays a little more if you are seeking help from CAG ? Why are you ringing the Litigation Dept ? Please do not be worried to ask any questions however silly they seem. My claim is for £2137. odd

 

I have gone through the process of writing to the bank asking for penalty charges to be refunded - they refused - I have taken them to the court (local one) The Court has sent me a notice of allocation to the small claims track and the judge has set a date for hearing - 30th August. I don't remember filing an AQ, however the judge has read my statement and AQ's filed.

Judge ORDERS that:

 

1. the parties are referred to Part 27 of the Civil Procedure Rules & Practice Direction of that Part for guidence on how the hearing of the claim will be conducted.

Question where do i find this and will it be written in understandable english?

4. the parties are encouraged always to try to settle the case by negotiation, or to narrow the issues. On BankBuster someone called the litigation dept and spoke to someone and got some further info, so I have tried this, and got the answer i posted earlier.

 
Question  1.  was I right or wrong to do this,  
2.  shall i contact them on tuesday or leave it to them to call me?

 

The directions say:

 

6. each party must deliver to every other party (presumably they just mean Barclay's) and the court office copies of all documents.

 
Questions: 
1.  does that mean i send copies of statements with penalty charges highlighted? and the calculated charges + interest, and all letters sent and recieved to and from Barclays?

 
2.  Is this what is called a "court bundle"?

Question:  Will I know whether they have done this and when?

The order was sent to me on the 07/06/07 they had 7 days to apply for a stay, varied or set aside, I have not heard that this has been done.

 

Part of the banks defence was to say that i was claiming for more than six years worth of penalty charges, :oops: that is true, in the letter i wrote to the Bank, however, I realised my mistake and when i put my claim into the courts i had adjusted the amount and the dates to the allowable date - 14 - May 2001.

 

I actually started this process in January of this year.

 

The Bank have never offered me any monies whatsoever - unlike all the other claims i have heard about,

I wondered whether this is because I had changed banks about two years ago?

 

if you can answer some of my questions I would be gratefull for all advice, but won't sue if I don't get anywhere!!!

 

Question: If I or barclays make contact what should i say to them, I would be willing to accept a sum quite close to my claim ie a round figure like £2000 say.

 

I could really do with this ASAP as like everybody else making a claim, I need it badly to pay some long overdue bills.

There is nothing stopping you claiming more than six years back, just one of their scare tactics.

Have you read through the link i posted earlier, it gives details of the litigation team at Barclays and what to expect

Bottom left under your name, between the greeen dot and red warning triangle.

 

You have nothing to lose by ringing them, just make sure you have up to date figures in front of you including interest to date as well as all your court fees etc

that looks like a snowflake on my screen had to zoom to 200% to view it!

 

Where can i find the CAG calculator - as an excel doc it would be better than my calculator as i have to paste it into excel and adjust it to read correctly.

Hi PKea,

 

Spoke to tom hickey today, snowed under with cliams, but pleased because he has a job because of it, nice to know we are creating employment!!;)

 

Any way He has asked me to send in my SOC via e-mail, should i also send a long note explaining my need for urgancy + Sympathy Vote to speed things up or keep it business like and just hope for a quick conclusion with me getting 95% of my claim?

Barclays will not be interested in settlingunless your court date is looming or you are prepared to offer to settle for less

than 100% and also agree to conditions.

Its up to you what you choose to do but Cags position is quite clear on this.Keep everything in writing,stay in the driving seat,and accept nothing less than that which you are entitled to.

Thanks for sound advice, will only accept full amount of claim.

 

Just pray its sorted before I go into hospital!

 

What happens to my claim now that the DFT are in court with the Banks? do i send my court bundle to the courts and barclays or do I wait. If i wait, it will probably be way past the deadline for the court bundle and evidence, and ultimately the court date which is the 30th August.

 

Can you advise please?

My hearing is set for 30th August

 

I have gone through the 'Guide to later stages' and printed three copies of every page, the guide has suggested - This would not have been possible without this site - Thanks :D needed for the 'court bundle'.

 

my question is should I send this in to Barclays and the courts now? I will be going into hospital in July - no date yet- so when the Barclays litigation team get round to me I may not be fit enough -or even here - to carry on, Could I ask someone else to help me continue in the physical, not from CAG don't expect that.

 

If this is improper my apoligies, I am nervous of upsetting everyone else.:Cry:

You havent upset anyone . it just makes it hard for people who wish to help you get the whole picture if your posts are spread all over the place :)

I would think that with a date at the end of August B's wont think of settling until the begining of August at the earliest :)
