Hi all,

 

First of all, a fanstastic site which has opened my eyes to the unlawful charges my bank has been charging me!

 

After receiving the requested bank statements for both accounts held with the Halifax I have calculated that on one I have been charged £2557.50 and on the other £491!!

 

Ready for my preliminary letter now but before i do,

 

Three questions;

 

1) Can I include charges that have occurred over the last couple of days?

2) Do I need to provide a breakdown of dates & reason for each of the charges with my preliminary approach letter?

3) Do I need to send two seperate letters for each account or can I combine the two requests into one letter?

Hi, and thanks for the advice.

 

Quick update, sent preliminary letters (two, as seperate accounts) now awaiting reply from Halifax.

 

Assume they will send standard letter/s as usual.

 

"You have 14 days to comply"

Hi all,

 

Update received a letter on Firday 23rd June from the Halifax offering "to refund £400 of charges in full and final settlementof your compliant".

 

Also stated that they reserve the right to close my account if I don't manage it correctly! Charming.

 

Well took me all of 1 second to laugh at their offer, considering the charges amount to over £2500.

 

However, I do have a question -

 

do I have to decline their offer verbally or in writing before I can proceed further and send the letter before action or does my non contact serve as a decline to accept their offer?

In writing ,but tell them you are prepared to accept it as a part payment and will pursue them for the rest.They will them probably withdraw it seen as its offered in full and final settlement.Add it in to your LBA

Hi, just a quick update to say that I have sent my Letter before action (LBA).

 

Included in it a brief section stating that I would accept thier offer of £400 as part payment but would be pursuing the remaining balance in full.

 

Also included a breakdown of the charges, date, amount and reason just in case.

Hi all, its nearly been 14 days since sending my LBA and I have heard nothing from the Halifax!? Not a call or letter?!?

 

Is this normal?

 

Should I be concerned that they haven't replied?

 

I will be filing my claim with the court on Monday as it will be past the 14 days deadline anyway.

Hi, right. The fourteen days is up from my LBA with no further offer or contact from Halifax.

 

I have begun completing the N1 form, want to hand it in, inperson on Monday,

 

But, I have a couple of questions for those who completed the N1 form;

 

1) under value, do I write only the charges amount applied to the account or include the interests and other costs such as the data pro £10?

In the "VALUE" section I would simply break down the parts of the claim,

 

i.e.

 

Bank Charges of £2,000.00

Interest of £550.00

Court costs of £120

Total of £2,670.00

plus daily interest at 8% equalling £0.XXp from the date of claim until settlement

 

 

In the boxes on the right, near the bottom of the front page, AMOUNT CLAIMED should be the total of Bank Charges and Interest (the first two lines above). The daily rate of interest is not added here, since you don't yet know what this will be - it depends upon the speed of settlement.

 

i.e.

 

Amount claimed: £2,550.00

Court Fees: £120

Solicitor's costs: £0

Total amount: £2,670.00

Today I handed in my N1 claim form into court and paid the £120 fee. The clerk stated that they were quite this week so would be dealing with the claim almost straight away!

 

Starting to feel slightly nervous now as I reach the final hurdle!

Hi,

 

Notice from court received today stating that my claim has been issued and will be deemed served on 21st July 2006....Gulp!

 

Court true to their word and issuing it quickly.

 

"The defendant has until 4th August 2006 to reply....."

 

I guess I sit back and wait now........

Got a call from the wife asking whether I had checked the bank account!

 

My first thought was that they had closed it or another charge but no!

 

Two payments totalling over £3000!!!!!!!!!!!

 

 

Yippee, I cannot believe it!

BTW check that they have paid you all the interest before you inform the court.

 

Its reported that they are being less than up front with due interest payments.
