    • Hi, yes this is the same sort of response I keep getting about this. Yes so it asked for the registration number of the car, and this was inputted correctly. It’s then “found” the brand and type of car “Kia carens 1.6” etc and then came up with the “Recommended” list we then selected the tyres from. I have checked it since we bought them and the same tyre still comes up. In response to the lady above where we “assumed” we did assume the tyres would be correct in the list so didn’t see any need to ring to confirm if you see what I mean. We did try ringing the company but they were unwilling to provide information of supervisor. It seems like the company isn’t going to do anything about this.. 😕
    • They are all actually your interpretations, and nothing more than incorrect assumptions and extreme misrepresentations (at best) of mine (and thats being kind)  
    • pop up on the MCOL website detailed on the claimform. [if mcol is not working return after the w/end or the next day if week time] .  register as an individual  note the long gateway number given  then log in .  select respond to a claim and select the start AOS box. .  then using the details required from the claimform .  defend all  leave jurisdiction unticked  you DO NOT file a defence at this time  click thru to the end  confirm and exit MCOL. . .  get a CCA Request running to the claimant https://www.consumeractiongroup.co.uk/topic/332502-cca-request-consumer-credit-act-1974-updated-january-2015/  leave the £1PO blank and uncrossed . .  get a CPR 31:14 request running to the solicitors [if one is not listed send to the claimant] . . https://www.consumeractiongroup.co.uk/topic/332546-legal-cpr-3114-request-request-for-information-when-a-claim-has-been-issued/ . . type your name ONLY no need to sign anything . you DO NOT await the return of paperwork. you MUST file a defence regardless by day 33 from the date on the claimform [1 in the count]

    • stick to letters.   look in the debt collection section of our library there is a pro rata letter   send that to everyone.   if they don't agree then we'll deal as and when those that do or do not reply. pay what you say when you said it to show good faith. use BACS transfer via online internerweb portal of your bank ...not DD>   dx

Have just rang court as have not had reply to letter/press release i sent early jan to be told that the judge has said 'no action need to be taken' as all bank charge cases are waiting for the outcome of 'big London case' ????

Pov, have a look at the OFT test case here. This relates to overdrafts only, not loans / credit cards etc.

This is why the Courts are putting a 'Stay' on claims (at the request of the Defendant. The case was brought by the OFT to place clarity on the law with respect to charges.

Hattie sent a letter, to Barclays this time, but we've heard no more from her since.

If Barclays are willing to agree to the Stay removal in other cases, you need to be ready to move on as well - Court Bundle, etc.

I think you know business claims are in some difficulty.

 

Do you know if you are allocated to the small claims or fast track. I see that you made reference to N150 earlier which may lead to you being on the fast track.

 

How much was your claim for?

thanks for replying GuidoT but i was just jokin really trying to make light of the situation ...

 

i think it was form n149 i filled in . i have 2 claims in this thread one is personal thru money claim on line and a business account trying to claim just over 2 grand at my local court .

Okay, I was concerned about your exposure to the other sides legal costs.

 

You should keep the two claims in separate threads otherwise it gets very confusing when reading back.

one thing really gets me with the bank charges

and thats customers who do not learn from their mistakes

]

see youre all expecting to get money back for being charged but you need to look at why you got charged in the first place. and the bottom line is you cant manage your finances but in some chases its understandable for the charge to be refunded eg standing order/direct debit went out when it shouldnt have.(out of your control)

 

but back on to learning, if the bank charge was set at 10 pound everyone will be going overdrawn and wont give a dam but being set at 30 pounds youre meant to be learning from a mistake. its like getting a speeding ticket or parking on double yellas when you get that fine you wont do it again will ya and anyway i cant see the banks losing but if they do youll all have to start paying for your accounts which will upset many people and more than likely cost alot more than one or two charges
