    • depends what the fees are, typically nothing can be added once judgement is passed bar litigation costs. on document retention time limits etc at least 6yrs previous must be held though many hold complete info. as for acronyms and abbreviations ideally yes they should     
    • Still have to submit a statement either system....if they fail they can only give verbal because they failed to file and serve.
    • OP stated they had been arrested, but not charged (let alone convicted). They DON'T have a criminal record, but do have an entry on the PNC. That information stays on the PNC (Police National Computer) for life, but doesn't get released in a standard DBS. It only MIGHT get released for an Enhanced DBS (eDBS) check  ... but it would be incredibly unlikely. (The rational behind this is that eDBS's allow for 'information at Chief Officer of Police's discretion' ..... this covers the 2 'barring lists' and is also intended for the scenario where someone has multiple arrests or investigations, where safeguarding is a concern .... it was brought in after the Soham murders / Ian Huntley case, where the information known about the now-convicted child murderer may have prevented his employment in a school, had it been made available). So, for the sake of accuracy and completeness, arrests stay on the PNC for life, wont appear in a standard DBS, MIGHT appear in an eDBS, but in reality, would be the exception rather than the norm, and I can't see them being released  to a defense barrister. What then if the defence found out a different way, and brought it up in court?. Again, unlikely, but the important feature is that the judge would make sure they trod very carefully!. They MIGHT consider using it if there were other factors that allowed them to try to cast doubts as to the truthfulness of your evidence, but on its own : No way. Anyone MIGHT be arrested (if a seemingly plausible complaint been made against them)! The approach to take if it did come up is to be truthful. "Yes, I was arrested. It arose from a vexatious complaint. I wasn't charged, let alone convicted. That could happen to any one of us, if a vexatious complaint gets made" Far better that than lying, saying you'd never been arrested, and getting caught in a lie : that would ruin your credibility. I'm incredibly doubtful it will even come up, though.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Just thought i'd do a quick update on story so far and ask a question.

 

Halifax filed an Acknowledgement of Service on 3/8/06

 

The Defendant responded to the claim indicating an intention to defend all of the claim

 

The defendant has 28 days from the date of service of the claim form with particulars of claim, or of the particulars of claim to file a defence.

 

 

 

 

1. Is this the date from my original claim being filed ie. 25/7/06 or from the above date 3/8/06

 

 

If it is the former date then I should be able to obtain judgement by default first thing Tuesday

 

If it is the latter then 3/8/06 it is.

 

Bear in mind it is a holiday on Monday they will then have three days in which to comply or submit a defence. I have had no correspondence from Halifax since so now dont know what to expect.:confused:

Sorry to sound thick, they were deemed to have been served on 27/7/06 so the 28 days was 24/8/06 am i right?

Indeed you are - check with the court they they have not entered a defence, but more importantly with the Halifax, check the account - they have probably paid up already.

 

If not either, seek Judgment in Default - YOU are now in the WINNER'S ENCLOSURE!!!!

I've checked online account nothing paid in, so my plan of action was first thing Tuesday

 

1.Ring ICO for update on complaint filed with them

 

2.Ring County Court first to check if they have filed their defence

 

3.Wait for post 10.30ish just in case its full of statements:rolleyes:

 

4.Depending on results above off to Court to file

 

 

Really looking forward to Tuesday:D

Quick update, went to court today but because of Bank Holiday they have an extra day to file defense

 

Close of Business today is the deadline so will be ringing court at 10.05 to check, if not it will be automatically processed as i left the declaration slip signed as it is so far away from me.

 

 

So wait again till tomorrow to read the next exiting episode:D

Well surprise surprise no defense filed by them, so obtained Judgement by Default this morning, just wait again now,

 

I suppose they will apply to have it set aside no doubt unless of course one of their nice workers delivers the goods and pays up:D :D

Iv'e had a letter dated 30/8/06 from a Rachel Hinchcliffe saying that according to their records the S.A.R - (Subject Access Request) has been complied with and they will be sending me a cheque for £40. :rolleyes: so i emailed this back to [email protected]

Regarding your letter dated 30th August 2006 I have received today, I would like to clarify that I have not received any statements at all, that is why I instigated County Court proceedings, and until such time as they are in my possession I will proceed with County Court claim.

 

You have indicated in your letter that £10 fee will be refunded, however my County Court claim of £10 was for the extra costs of sending 2 x Registerd Delivery letters plus stationery trying to get you to comply with Data Subject Access Request, the initial fee was not requested to be refunded.

 

 

Extra costs incurred in addition to court costs, due to the Defendants failure to comply - this includes the cost of additional correspondence and time spent preparing documents, I estimate this cost to be......£10.00

Got my statements today at last:lol: all 110 pages

 

Also had Judgement for Claimant N30 from the Courts today, just the cheque for £40 needed and i'll cancel claim:rolleyes:

 

Did a total of charges and got £1757 so off with the prelim letter later, see how long this takes for a result only they should know i mean business now:grin:

Got my first reply to prelim usual,

 

"We are sorry you are not happy with your charges applied to your bank account"

Took ten days to get from Halifax head office to customer relations in Leeds:rolleyes:

Sent off the LBA seeing as though i've had no positive reply, also had a suprise in the post today, my credit card statements well before time this time, must have been that N1 that did the trick:D

 

Total £500 from c/c so prelim off to them tommorow

It's been a month... Morgan where are you? I'm so glad to have read your post. It's the only one I've seen with a real live county court judgement issued. It gives me hope, because it looks like I could be doing that soon.

It's been a month... Morgan where are you? I'm so glad to have read your post. It's the only one I've seen with a real live county court judgement issued. It gives me hope, because it looks like I could be doing that soon.

 

Hi Guapa,.... Sorry peeps been hectic with work which has made me neglect my claims a bit so just to update, Just finished preparing ANOTHER N1 for the Halifax with interest etc so that will go off on Friday, way over time i know, but... And to throw another spanner in the works the barstewards have sent me a default notice for my credit card, so looks like another fight coming on8-)

 

 

I cant believe there is only mine (fame at last lol) with county court for Data Protection Act but stranger things have happened, like the banks paying up with the first letter:lol:

 

The Information Commissioners Office has also sent me not 1 but 2 letters about my complaint, not that the banks give a t**s about them, but still nice of them to remember me.

You can complain, just dont expect any miracles and file for County Court instead. Or email the now infamous mailto:[email protected]

Great read your case morgan, fair play to ya, little behind you at the moment, the 40 days have passed on my request for statements and no reply, sent off wednesday 25/10/06 the non compliance letter, hoping the statements will show up. your case sounds like stress and hard work. lol, just printed off the court forms in advance. might need your help later mate if you dont mind. rgds Ave

Well time for another update, filled in the N1 on the 8th November, sent by courts on the 9th "deemed served on the 11th, the Defendant has until the 27th November to reply"

 

Guess what:lol: They have'nt!!!!!!!!!!!

 

Phoned the courts today and they say i can apply for judgement after i sign and return the bottom of N205 form (Notice of Issue) which is sent to you after you file at court.

 

Can't get there today so it will have to wait till tomorrow, another day wont matter, i've waited this long:rolleyes:

 

I dare say someone will see this from Halifax (Cos they're watching) and will be panicking to either get a set a side(with some excuse like they never received it lol) or even dare i say it PAY ME!!!!!!!!!!!!!

 

See what tomorrow brings
