    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share. 
    • To re-iterate and highlight my urgent question on this one: The N24 from the court did not include any instructions to submit paperwork 28 days before the date, unlike the N157 received for other smaller claims. Do I have to submit a WS for this court date? Link has!...
    • No, reading the guidance online it says to wait for a letter from the court. Should I wait or submit the directions? BTW, I assume that the directions are a longer version of the particular of claim accompanied by evidence, correct?
    • Thanks for opening, it's been another rough year for my family and I've procastinated a little.. Due to the age of my defaults on this and other accounts (circa 2021), I really need to avoid a CCJ as that will be another 6 years of credit issues. Mediation failed as I played the 'not enough info to make a decision' however during the call for some reason they did offer settlement at 80%, I refused. this has been allocated to small claims track, court date is June 3 and I've received their WS. I'm starting on my WS. They do appear to have provided everything required of them (even if docs could be reconstructions). Not really sure what my argument is anymore but I do want to attend court and see this through. Should a judgement be made against me then I will clear the balance within 30 days and have the CCJ removed - this is still possible isn't it? I'm going to be reading up today and tomorrow and hope you can provide me some guidance in the meantime. Wonder what your advice would be given the documents they have provided? I am now in a position to clear the debt either by lump sum or a few large installments - Is this something i should look into at this late stage? Thanks as always in advance
    • I have now received my SAR. It includes a great deal of information! Is there a time limit on how long account information is kept and/or can be provided to debtors? I have received many account statements which were not previously sent to me. I remember that the creditor should provide explanations of any acronyms and abbreviations that maybe used in the documents. Is this still the case? Also what, if any, are the regulations in regard to adding fees to a debt? Can fees be added to a debt after the court has approved a charge on a property. Perhaps due to the numerous owners of the debt, many payments I made were not properly recorded on the account, some were entered over a year after the payment was made! Following the Legal Charge, I paid every month until my payments were refused. I am trying to compute the over payments, but the addition of fees etc. is confusing me. Any comments and/or help would be appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Have been writing to Littlewoods about my cat. account with them and the charges. In their reply they state the old rubbish about their charges being fair etc etc, but the also state something strange I quote "As you complaint is in relation to a credit agreement that was sold prior to 06/04/07 you are unable to refer you complaint to the FOS as we were not a member of a dispute resolution service until this date".

Is this correct, does it mean that the FOS can't look at complaints about a company who don't sign up with them!!! What kind of regulator is that?

Had already decided to CCA them anyway so will await their reply to that next.

Sorry Tom Tom their letter isn't very clear, they haven't sold the debt on as yet, although their own debt collection dept have been harrasing me. I took this to refer to the account being "sold" to me. I thought the letter sounded very fishy. Will await the CCA, but given that the account was opened online and that I recently found the paper agreement they asked me to sign and return unposted in a drawer upstairs I don't know what I will get.

littlewoods have admitted they don`t have a credit agreement for me but they are still demanding payment and have passed me over to theit dca,i wrote to the FOS and this is their reply...thank you for your recent enquiry.i am sorry to disappoint you but,after further investigation,your complaint does not appear to be one we are able to deal with.that is because the business you have complained about only became covered by us on 6 april 2007,and we have no authority to deal with complaints against things that happened before that date.from what you have told me,your complaint is about something that happened before 6 april 2007 which means that-even though you are still in dispute with littlewoods shop direct shopping limited-we are not able to look into the matter.

has anyone else been fobbed off with this letter or has littlewoods found themselves a nice little loop-hole??:confused: thanks for your help xx

Surprise, thanks for that, but if this complaint started after 6 April, then the FOS can get involved (that is my understanding) ?!

Or does this mean that accounts sign for BEFORE that date cannot be refered ?

 

The FOS response seem slightly confused.

I am assuming it is accounts signed before 6th April 07. It so happens I have been in battle with Littlewoods since 3rd March and when I said I was going to refer this to the FOS they said that they wouldn't be interested as they were not a member prior to 6th April 07.

 

I can say now though that I have successfully dealt with Littlewoods now, however, they don't go away lightly despite the fact that they have no signed agreement. Before it was settled they sent me two agreements with just my name and address on and one blank one and tried to tell me that was sufficient.

I didn't go to TS as I realised I had Littlewoods on the back foot anyway so I just carried on corresponding with them to eventually they actually wrote the debt off. Also, I reported CapOne to TS who directed me to Consumer Direct who then wrote and said it was outside their remit. A complaint is also in at ICO about CapOne. PeterBard as actually used my case with CapOne as an example in his letter to the DTI.

Sorry I don't have faith in any of these organisations now, so I shall carry on battling with them as they say "onwards and upwards".

yeah, and you can send a new scredit agreement request, and that'll give you a new cause for complaint.

I had exactly the same response from FOS, but there is a way around it! As soon as the debt is passed on to a DCA (after April 6th) FOS will accept your complaint because a 'third party' has become involved.

 

I'm complaining about Cap1>Lowlife>Red Collection>Mackensie Hall at the moment. FOS wouldn't accept my complaint until Lowlife/Red Collection passed it on to Mackenzie Hall after the 6th

Ok sent littlewoods a CCA request in June. Waited till in criminal default and wrote again. I now hold a letter from them confirming no agreement held and none ever held, they agreed the debt was unenforceable and so they would no longer ask for payment. But they insist on the fact they think they can still process my data and state I owe them for goods delivered. I was going to push for them removing all data later in the meanwhile I have been dealing with other CCA requests.

Now had a letter to say they have passed this alleged debt onto NDR (I understand they own this DCA in house), but the amount they are requesting appears to be just for the alledged goods delivered. However as some payments were made on this account the amount is incorrect anyway.They are threatening to default the account, but surely without an agreement there is no contract/agreement to default on? Never mind the fact it is still in default of my CCA request.

Obviously I intend to write back and point out the above issues, but just wondering should I ask for "proof" that any items were delivered or not even touch on that issue at this point?

In my opinion they cant enforce the debt.

 

I would write to the NDR and tell them this account is in default and advise them to return the papers to Littlewoods or you will be reporting them to T/S

I would report Littlewoods to Trading Standards anyway, as they have now gone into criminal default.

 

By passing the debt to a DCA for collection, they are still trying to enforce the agreement!

Trading Standards at Liverpool are dealing with a lot of complaints about Littlewoods. Report them to your local TS and say that you understand that there are other complaints and that the Liverpool TS were going into see Littlewoods and could they pass your complaint on. The more the merrier.

 

The trouble is I sent documentation to the CRA's and they say that Littlewoods are entitled to process data. I have also complained to the ICO who are looking into this.

Thanks for the replies everyone. Gonna do a letter for NDR to tell em to "bog off" and get my complaint ready to send to trading standards. Gives me something to do whilst sat here on maternity leave :) Not going to touch on the goods issue unless they push it.

I would send the details of to your local trading standards office.

 

That way they cant argue that you dont pay your council tax to them
