I have a little problem (not consumer) and wondered if there is anyone who could provide a little guidance.

 

I resigned from my position last week and have a six month notice period due to the senior nature of the job. My new employer are happy to wait but want me to start earlier if possible, however my current compamy are being stubborn (and not really talking to me) saying that they will not be flexible.

 

Is there anything I can do?...any assistance welcome.

Terms of the contract?

 

My first thought would be that if you leave early there will be a penalty of some sort, probably financial loss, but possibly more than the time you don't work that you should.

 

This possibly could be compensated for in remuneration in your new employment by starting early.

 

Check the contracts thoroughly.

I am now in the office and will post the part from my current contract when I get home tonight.

 

It is interesting as I have spoken to recruitment consultants who have never seen a 6 month notice period and the general feeling seems to be they are unfair contact conditions.

I believe (but could be wrong) that unfairterms generally relate to consumer issues. contracts of employment are a different animal.

 

I am not suggesting you do this, but I know of a couple of people in a similar situation (but not 6 months) who went off sick and started their new job during that time.

 

It may well be worth speaking to an employment specialist to see if there is anything you can do legally that will be effective.

It's quite common to have these lock-out period, basically the longer you are out the industry, the less use the information gained from your previous employer is.

 

I would urge caution - if your new employer is in the same line of business as your old, then if things turn nasty, YOU'LL be the one facing a damages claim, not your new employer (or though they could be, they rarely are involved unless there's big money around).

 

Taking 'gardening leave' as it is called saves the problem, and whilst it could be construed as being unfair and detrimental of your livelihood, the lock-out would have been explained and signed up to by you, making any subsequent assertion that you didn't know or it was unreasonable unlikely to be upheld.

Thanks guys for the replys.

 

I had another look over my contract and I think I am stuck. I have asked a solicitor friend to cast an eye but it looks like I am here for 6 months.:mad:

 

On the positive side for some unknown reason they keep wanting me to play golf.....life can be funny.:lol:
