    • The sign says "Parking conditions apply 24/7". Mind you, that's after a huge wall of text. The whole thing is massively confusing.  Goodness knows what you're meant to do if you spend only a fiver in Iceland or you stay a few minutes over the hour there.
    • Hi and thanks It looks like they ticked all the boxes to me but I'll try and upload the notice. I was wondering if a witness to late delivery might be considered proof - I'm assuming they posted it as normal but Royal Mail stuffed up delivery. If not then they're really saying it just has to be posted within 12 days of the incident, regardless of when it is received.     • ROFL - dont get upset just because someone (quite a lot of someones) dont want smart meters - well unless you get paid for it .. in which case ...   I assume you haven't been with Octopus long enough to be on one of the very long fixed price tariffs they offered before the prices went bonkers .. and that you dont use your electricity in the evening/lunch time if you think the 'agile type tariffs are good value .. let alone worth installing a smart meter for - high price a good disincentive for an evening cuppa eh? Let alone all your computer/tv etc time in the peak price evening or lunch time. - and boy do those peak prices instantly hammer your bill when those Russian and middle eastern issues kick off.   I would only have considered a smart meter if solar panels had been an option for me - but roof is oriented completely the wrong way. Oh - and My opinion hasn't changed since the smart meter trials 40 years ago, because neither have the issues (well not enough) but I'm happy for you. Be happy for me.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

I have been reading al he threads with interest but none of them answer my question!! I am at the last stages of claiming, however the 'Abbey' took one of my letters as a complaint and are fobbing me off with nonsense letters that don't really say anything. What woul be better to do now?

1. write to them and threaten I will take action?

2.go to ombudsman?

3. Forget the above and apply direct to the court?

Or do I need to do all three

Can someone helllllp this is driving me mad

How far into your complaint are you...exactly? Have you filed N1.....AQ.... do you have a court date? More detail please!!

 

Also, what was in the letter they have taken as a complaint?

 

It would be good if you could write out a bit about the history of your complaint on your thread.....that way people know where you are at and are much more able to help!!

sorry bout that I will try to give details now, basically I wrote to Abbey requesting the money after they had sent my statements through, I just wrote to express my concerns that they were taking longer than the 40 days to get my documents in the first place adn that if i didnt receive them I would take advice from information commission!

so far I have received statements, written to request my money back, and now it is stale mate as they keep writing letters saying they are dealing with my 'complaint' and it will take 4 weeks, and then another 4 weeks! so I havent got to the point of court yet, as I am not sure how to respond to them, does this make more sense to you?

yes this is common delaying tactic by the bank if you have sentthe prelimary letter whcih gives them 14 days to resolve your complaint then the LBA which gives them another 14 days them issue your court claim thats the timetable to stick to not thiers

sorry to sound so thick but are you saying dont threaten them withombudsman or any thing just go straight to court?? do I have to let abbey know this? this is all getting complicated and scary:-?

Good advice from Michael spotty - I took it from your first post that you were much further on than you actually are.....you did say last stages of claim?

 

Read the bits Michael has suggested. Send the letters and stick to your timescale......not theirs. They will continue to give you the runaround.

 

Shout for help when you need it.

LBA is "letter before action", which should be the 2nd letter you send,14 days after the first one asking for you money back. see post #6

thank you charleyfarley! not forgetting i am slow hoe do I find post #6? I am not very good at threads etc! obviously I need to learn a lot which makes me wonder if I can get some conclusion to getting my bank charges back!! you all seem so 'on the button' I am totally disconbobulated!!

made me laugh so much.....discombobulated is one of my most favourite words but hardly anyone knows what it means....I know exactly!!

 

once you've sent the LBA they have 7 days to respond......after that you file your claim. search out the N1 claim form in the bank template library so you can get things prepared. you can either file at Moneyclaim online (MCOL) or take it to your local county court...this is usually a bit quicker...not much though. you will have to pay a fee depending on the size of your claim - mine was £120.

 

do a search for 'particulars of claim' as it is important to use the correct wording. you will also need to do a spreadsheet of the charges you are claiming - again, in the bank template library (this needs to be attached to your N1)

 

if you get stuck - just yell!!

Hi guys, its me again!! lots of questions....

1. I received a letter from the bank offereing me £200 as a good will gesture, the amount I was claiming was £5000 with interest! I have read and watched the info on the site but there are several letters I could send, would be grateful for help here! need clarity on what to do pretty please!!

2. why would they offer such a low amount and should I ring them first or send the letter

3. court does actually scare me as I really dont know what I am talking about as I am sure you can tell!!

 

I basically just want to scream, nothing in my life is ever straight forward and this is the icing on the cake!

the court action does look and seem scary but once you actually follow it step by step it's a walk in the park.............read on the A/Qs and threads and you'll do ok.

It will be letter 4 from here if you not yet filed your claim, or letter 5 if you have. Sorry, I couldn't see on your thread if had submitted yet.

 

Check your bank account to see how much they actually credit - sometimes they cancel future charges, which are obviously not on your schedule, so you should only deduct the actual refunded amount from your claim.

 

The amounts they offer seem to be pulled out a hat - there is no rhyme or reason to the amounts, and they bear no relation to the value of your claim whatsoever.

 

Court scares the pants off me too - but not any where near as much as it scares Abbey!!;):D

 

I have not had an easy ride either, and without CAG buddies I would have crumbled long ago. That's what is so fantastic about this site.

 

So stick with it; with the support and advice here you will be fine, and you will get your money back!:)

Hi - its me again!

 

No, you shouldn't have asked for the interest in the LBA; you are only entitled to claim Statutory Interest once you submit a Court claim.

 

However, it is not a major problem - lets them know how much extra they will have to pay out.:D

 

I think you could rectify this by adding a paragraph to your rejection letter. This is my own compilation - so if anyone thinks its pants and could do better, feel free!;)

 

I realise I may have mislead you somewhat ;) in my previous correspondence regarding the 8% interest; what I should have made clear was that this would be the figure, accruing daily, that I would have to add to a Court claim, should you force me into commencing legal proceedings against you for the reimbursement of unlawful charges.
