      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just out of interest, if citcards have received all your previous letters and replied (even just thr standard reply) and then at the last minute ask for a 'set aside' because they claim they never received the original claim - then can they leave a message to that effect here. Im trying to find out exactly how many times they do this - and then maybe we can get a list together - as they have for the banks who settle before court date arrives, and then maybe it can be printed off and used to send maybe a letter ( someone maybe to draw up a letter and leave template on the site?) to the court BEFORE citi get to have their hearing for a set aside.

Its just a thought but surely the courts must be aware of the stalling tactics citi are using by employing this method all the time? I would also suggest to any new claimnats that when you put your claim into MCOL that you use this address:

This is the address on the court papers that they have given for replies and to prevent them saying they dont receive something - why not photocopy your N205 - Notice of issue from the court and send it to citi cards by recorded delivery!.:)

Happened to me, I received the Decree/Warrant, as citi did not file a defence.

I then sent them a letter prior to getting the bailiffs to serve them and they responded by saying ohh we never actually received the original summons.

 

If you or the mods need my case number to compile a list let me know.

Citi seem to be trying every trick in the book.

Advice offered by ENRON is without prejudice and is for your judgement as to whether to take it. You should seek the assistance or hire of a solicitor or other paid professional if in doubt.

They are doing exactly the same to me, I dont know why they go to all of the effort in tyring to defend claims because their defence is laughable they just ignore what you put in your particulars of claim and make up what they want, OFT this OFT that, no we want you to provide a break down of how it costs your computer £12 to print out a letter - this is all done by machine, it prints the letter and puts it in an envelope. Madness....

I have a Citi account (god help me) and I am trying to strat the process of claiming charges but they are behaving like a stuborn mule. set letter early april for list of charges, then reiterated my request, wrote to the Information Comissioners office ( has office in Citibank I think). still not got the print out of charges 75 days after filing for them.

 

Any suggestions on how to aplly pressure as my calls them are gfet more irrate and not good for the children in the house to hear!!!!

I think CITI are one of the worst to deal with and I think the mods agree so how about we have a speacial CITI sectio - or keep this thread so that can all compare notes and find out how we proceed? - just a thought:)

I was just thinking aswell as having all the individual names v citi - we could have one 'part' where we can all put things that might help each other - and others can add anything they know and its all under one section? I was just thinking it might be easier to get the info we need all in one section rather than everyone opening new threads up - as C ITI are proving to be one of the most stubborn and devious of all the banks to deal with :(

im dealing wth citi they are awful. I had to write to them 3 times didnt get reply. When i phoned them i spoke to a "lady" who has to be the most ignorant person i have had the "pleasure" i mean misfortune to speak to. good luck to everone who takes these on. Im just starting the process and im pulling hair out with them.

I agree with all the comments on Citi, someone got the B......s word before me!!

 

Has anyone manager to get statement of charges from them yet, they are not budging just now despite a letter from the info comissioner who advised the FOS route. I think that will be a waste of time, so when I get my charges collated its 14 days to pay up then MCOL will be getting new customer.

 

lets keep the pressure on them, the more we complain via the regulatory bodies the more bad press they get!!:D

The format of this site is that each claimant has a thread in the relevant forum for each claim.

As you will be aware we keep a lot of Citi stuff off the public boards as it is monitored by Citi, and they have been known to take print outs of comments from claimants off this site into court.

When the time is right we will make info into stickies.

i finally had statements sent but i had to write a complaint to the financial omubus to get them. it took 3 weeks after i complained but i got them. They think they above complaints im sure. Anyone thinking of taking a loan or card or mortage with them PLEASE BE CAREFUL.

Hi, does anyone know if , after court case is won and your waiting for your cash and they are stalling (again) can you make them bankrupt.

 

Is it not time to send the bailif in if you won your case in court..GC
