Bank fodder has posted a sticky regarding complaints about the behaviour of all solicitors involved with bank charge cases.

So far only two of us from the Abbey forum have actually lodged a complaint.

 

I have posted the mails that I have sent and received in the above post if anyone needs guidelines on how to complain.

 

Abbey are using a firm of Solicitors called Ashursts and it is only by complaining en mass that will get anything achieved.This could be very important and another way of potentially getting claims speeded up and dealt with in a proper manner without sham template defences and intimadatory delay tactics that are currently being employed.

 

PLease get a complaint off and follow it up. Post in the sticky thread with whatever findings you get.

I haven't yet had any run-ins with Ashursts to complain about - I'm still waiting for my AQ form to come through from the courts

Perhaps we are missing the point here... the complaint is the abuse of the court system. The very fact that they submit a defence they have no intention of using as they have no intention of stepping into court. That is the very complaint we must make.

 

If there is a complaint upheld this will mean that Ashursts and other solicitors will not be allowed to delay your claim as they are currently doing. They have a duty to the courts first and foremost and they are currently abusing that duty. By having a complaint upheld they will be forced to stop this current practice and either defend the cases properly or advise immediate settlement. That is why it is so important.

Hi Noob, I emailed my complaint to them this morning and have received the following reply:-

 

Thank you for your enquiry.

 

The Legal Complaints Service deals with complaints about the service that solicitors in England or Wales provide to their clients. However, because solicitors are professionally obliged to try to resolve complaints, the Legal Complaints Service is unable to become involved until this procedure has been exhausted.

 

Solicitors in England and Wales are required to operate a complaints procedure and must take all reasonable steps to resolve any complaint about their service which has been put to them by their client. Your complaint should be made to the complaints handling partner of the firm.

 

To assist you in making the complaint, I enclose Resolution and Complaint forms together with an information booklet, which explains our function and the complaint process in more detail. Please complete the Resolution form and send the pink copy to your solicitor, retaining the blue and green copies.

 

Experience has proved that in the majority of instances once a solicitor is aware that their client is dissatisfied, they will do their utmost to resolve that complaint and I very much hope that that will be the situation with your complaint.

 

If your solicitor does not resolve your complaint to your satisfaction, you should contact this Office. Please provide us with the following:

 

a) an explanation of why you remain dissatisfied, using the enclosed Complaint Form

b) a copy of the Resolution Form

c) copies of the firms response to your complaint

d) any other correspondence relating to your complaint.

 

Please note that you may refer your complaint back to this Office within 6 months of your matter completing (termination of the retainer). Therefore, if the matter is currently ongoing you may wish to wait until its conclusion before referring the complaint back to us. If you do need to return to us please send is copies of all correspondence dealing with your complaint and explain to us why you remain unhappy.

Hi noobrider.......I will do this today. I had read it before but assumed it meant after your claim was finished.....as I am due in court on the 28th June....and have heard absolutely nothing from Abbey.....I didn't think it applied to me. Thanks for the explanation.

I attended court last month and the abbey attended. We now have a court date for the 9th July 2007. It is ordered that there is a time estimate for 2 hours and that the cost to be reserved to the adjourned hearing. I would appreciate some advice as i am preparing my arguments

If you are one of the tens of thousands who are being delayed and obstructed by sham defences which are being conducted by your bank in response to your bank charges claim, then when you have received your money, complain to the Legal Complaints Service.

 

Ah, noobrider........I just read BankFodder's post.......in fact, the recommendation is that you do not complain until after you have received your money. As I have not received either my money or an offer yet, I think it had better wait until after the hearing date.

You see I'm still a little wary about this - I haven't got to the AQ stage yet as my own court is 3 weeks behind due to the amount of work currently going through the system - Therefore although I'm happy to submit a complaint - I don't really think that I have enough to complain about yet - I did receive the template defences for both of my claims against the Abbey - infact they were almost identical - Is this enough to complain about ?

OK Clarification...Yes wait until your claim has been settled.. complaints cannot be dealt with whilst you are still in litigation. There are a lot of us that are on 2nd claims but equally there are a lot still here that have settled and are still around to offer advice. It is these people I am chasing in order to assist those currently with claims and future claimants.
