Hi I am new to the site and am just introducing myself !! Its nice to see that you are all giving so much support to each other. I am currently trying to recover charges from Abbey, but they have only sent me A years worth of statements and now it well over the forty days. I have sent them another letter stating that I want the rest sent within 7 days and I have heard nothing from them and that was well over 2 weeks ago ! Anybody know what I shoul do next ? Cheers :-)

If the bank fails to supply you with your data then you should complain to the bank. Give them 7 days to comply and tell them that you will begin a complaint to the Information Commissioner and also that you will begin a County Court action under the Data Protection Act.


If the bank does not respond to your 7 day warning then begin your complaint and start your action.

Hi molly - that's exactly what I have just had to do. My second claim is Abbey Credit Card - they ignored my SAR then sent me a letter telling me they were sorry I needed to complain? I sent the LBA letter - they responded by offering me £690 - how can I accept that offer when I don't even know how much the charges are? - I suspect thousands though!

I have just filled out the Data Protection complaint form on the Information Commissioners website (easy to do - just fill it in online and then print it out and sign it) and sent it off yesterday. Waiting to hear!


I would do that if I was you - if you've let the 40 days for the SAR go and then 7 days for the LBA - make a complaint!
